Re: Transfer of Sanitary Flow Credits to Hard Corners Partners LLC

Location: 245 Love Lane, Mattituck,NY
The Planning Board supports the transfer of seven (7) sanitary flow credits.
The proposed action involves the request for the transfer of seven (7) sanitary flow credits to
create twelve (12) affordable accessory apartments in the renovation of an existing building
(former Capital One) in the Hamlet Business Zoning District. Chapter 117. Sanitary Flow
Credits, Transfer of§ 117-3. Definitions. Permits such a transfer for an Eligible Project defined
as:
"Projects located in a receiving district that are permitted uses in the zoning district
where the subject property is located. "
A receiving district is defined as:
"RECEIVING DISTRICT-An area of the Town that is desirable to be developed more
intensively than areas outside the district. "
The proposed action meets the definition of a receiving district. The building is located within
the Hamlet Business (HB) Zoning District, and accessory apartment use is permitted. It is also
located within the Mattituck Hamlet Center, an area with supporting amenities, public
transportation, and infrastructure to support increased residential density for affordable housing
opportunities.

Chapter 117 Sanitary Flaw Credits, Transfer of the Southold Town Code requires that the
Planning Board evaluate the application to the following criteria:
1. The effects ofpotential increased development which is possible under the transfer of
development rights;
The property is zoned HB and is located within an eligible receiving district. The purpose of the
zoning district states:
The purpose of the Hamlet Business (HB) District is to provide for business
development in the hamlet central business areas, including retail, office and
service uses,public and semi-public uses, as well as hotel and motel and
multifamily residential development that will support and enhance the retail
development and provide a focus for the hamlet area.
The proposed transfer of sanitary flow credits to construct affordable housing in a mixed-use
building does not conflict with the purpose of the HB Zoning District.
2. That the district contains adequate resources, environmental quality and public
facilities, including adequate transportation, water supply, waste disposal and fire
protection;
Built Environment and Existing Conditions
The parcel is located west of Love Lane in the Mattituck Hamlet Center and south of Pike Street
near many commercial uses that would support the residents of the units. The United States Post
Office, LIRR Train Station, religious institutions, grocery stores, restaurants, and other
commercial businesses are located nearby and are easily within walking distance.
The parcel is located within the Mattituck Union Free School District. Public schools available to
residents of units would be available.
There are no soil or topographical limitations on site.
The parcel is not located within a FEMA-mapped flood zone.
The building is not listed on The Society for the Preservation of Long Island Antiquities (SPLIA)
map.
Transportation and Infrastructure
Parcel Access
Impacts on transportation from constructing twelve (12) units are expected to be low.

Twenty-four vehicle parking spaces are required. Vehicle parking is proposed in an improved
parking area located at the rear of the parcel or along Pike Street and Love Lane, both public
streets. Additional parking is available in the Southold Town parking area south of the parcel.
Infrastructure
Public sidewalks and painted crosswalks are located both in front and on the side of the building
and are adequate for pedestrians to travel between Love Lane and Pike Street safely. Supporting
pedestrian infrastructure will lessen dependency on vehicle use.
Distance to Public Transportation
Public transportation is accessible to tenants and customers within .10 miles of the site. The
Long Island Railroad train station and service are located across the street from the building. Bus
transportation is available.
Access to Public Water and Sewers
Suffolk County Water Authority public water is connected to the building.
The parcel is located within SCDHS Groundwater Management Zone IV, not over a Special
Groundwater Protection Area(SPGA).
Waste Disposal
The applicant proposes constructing eight(8) one-bedroom apartments under 400 square feet,
requiring 110 GPD per unit, and four(4) one-bedroom apartments under 600 square feet,
generating 150 GPD per unit. An existing 3,825 GPD sanitary system supporting a full-service
restaurant, dry retail, and one-bedroom apartment was approved by the Suffolk County
Department of Health Services in 2022. The applicant seeks the existing, approved system to
accept an additional 950 GPD density flow rate.
Seven(7) sanitary flow credits are required due to the shortfall of GPD appropriated to the parcel
and the apartments proposed. The total number of sanitary flow credits in the
Mattituck/Cutchogue Sanitary Flow Credit Bank is 41.02.
3. That there will be no significant environmentally damaging consequences; and that
such increased development is compatible with comprehensive planning and the
development otherwise permitted by the Town and by the federal, state and county
agencies having jurisdiction to approve permissible development within the district.
The addition of the units is compatible with and supports the 2007-2008 Hamlet Study and
Mattituck Stakeholder recommendations, Policies 1, 5 and 6 of the Town of Southold Local
Waterfront Revitalization Program and is consistent with the Southold Town Comprehensive
Plan(2020) Land Use, Economic Development, and Housing Chapters' goals and objectives for
creating affordable/attainable housing through adaptive re-use of an existing commercial
building through renovation.
No significant environmentally damaging consequences are expected to occur due to this action.
4. Sanitary flow credits shall not be transferred out of the school, special assessment or
tax districts unless the Town Board determines that there is no other available lot
within said districts to which a sanitary flow credit may reasonably be transferred
and that the transfer does not unreasonably transfer the tax burden between the
taxpayers of such districts.
The proposal includes transferring sanitary flow credits within the same school district.

THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2024-685 WAS
ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON
JULY 30, 2024:
RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the
application of Hard Corners, LLC for transfer of seven (7) Sanitary Flow Credits at the Southold
Town Hall, 53095 Main Road, Southold,New York, on the 27th day of August,2024, at 7:00
p.m., at which time all interested persons will be given an opportunity to be heard. The applicant
has requested the transfer of Sanitary Flow Credits in order to allow for the renovation of an
existing building at 245 Love Lane, Mattituck, NY 11952 to create twelve (12) affordable
housing apartments,two retail stores and a small cafe. The Town Board has classified this action
as Type II under SEQRA, and requests reports from Planning Board and Building Department to
be submitted prior to the public hearing date.
