ADDITIONAL INFORMATION:The Zoning Board has received two letters of support from neighbors. There is no Certificate of Occupancy for the original dwelling on file with the Town of Southold. FINDINGS OF FACT/ ASONS FOR BOARD M`01ON', The Zoning Board of Appeals held a public hearing on this application on September 7,202 , at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Laww 6 -b 3 b 1 , Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This is a waterfront community that has seen much change over the years as owners have expanded small summer cottages to larger year-round residences many with the addition of swimming pools. The proposed swimming pool will measure 16 feet by 40 feet and will be located in the side yard as it is the only location on the property to accommodate a. pool without building further seaward. The applicant wishes to extend the rear screened porch by 3.3 feet to create a more functional room, The front entry way will be extended 14 feet by 9.3 feet and the den will be extended on the east side of the dwelling 13feet by 16feet with a second-story attic to be used for storage. The proposed additions and alterations are in keeping with the community character. The Board has granted variances in this area for additions and pools, as the majority of homes were built prior to the establishment of the zoning code. The design will emphasise the characteristics of the existing structure. The proposed pool located partially in the side yard will be like other pool's that have been granted variance relief. The pre-existing 7.6 feet side yard setback on the westerly side of the house will not change, all proposed work is on the east,side of the, structUre where a large side yard exists. The eastside of the property where the proposed pool to be located will be screened by mature evergreens in order to provide the owner and the neighbor privacy. 2. Town Law 267-b 3 'b ' . The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The original dwelling was built in the 1950's and the rooms are small and not up to the present standard. Both rear and side additions are partially situated in the side yard. he proposed proposed pool will be situated near the proposed den extension making entry to the residence easier from the patio and the pool which will face Pipe's Cove. 3. Town Law 67-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 49.3% relief from the code for the proposed alterations and additions to the house and 100% relief from the code for the proposed pool to be located in a side yard. However,there is no proposed expansion of the pre-existing setback on the westerly side of the dwelling and the existing side yard will remain 7.6 feet where 15 feet is required by code. As a result of the initial placement of the house, prior to Zoning, the only possible location to place a pool is in the side yard. 4. Town Law ` r7-b 3 'b 4,. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and Southold Town Board of Trustees must grant approval. 5 Town Law §267-b(3)(b)(5). The difficulty has, been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
