An associated brick patio will be installed surrounding the pool with varied dimensions approximately 4' surrounding the north, and east sides of pool and 14' x 17' area extending on the east side; a 2' tall landscape retaining wall will be placed along the north and west sides and planted with native vegetation; steps to the existing patio and deck will be constructed and existing trees will be protected. A proposed 4'x6' temporary storage shed will be installed to store pool toys and chairs. A pool compliant fence will be installed on the north and east sides of the pool and the west and south sides will utilize the pool wall as a barrier, all work will be a minimum of 75' (except landscape retaining wall 72.60") from the tidal wetland boundary and protected from runoff at all times. Given your information below and having the Building Dept. give your plans a quick review, at this time the proposed pool/patio is considered an accessory structure because it is raised on some of the sides. The current proposal as submitted will require a ZBA variance as the proposed accessory structure is less than 25ft.from the side yard lot line. In order to not need a ZBA variance you would have to reconfigure all of the proposed (including stairs)to be no closer than 25 ft.from the lot line. If your client wants to move forward with a ZBA variance, please start that process. The Wetland Permit application needs to be postponed until either a ZBA variance has been issued or the plans are revised for the structure to be beyond 25 ft.from the side yard lot line. I don't know exactly how many feet above grade, but the pool builder said that there will not be a need for a fence around most of the pool because the high side walls will serve as the fence.So essentially,the pool will be elevated,and the surrounding patio will act as a retaining wall.
