DECLARATION OF COVENANTS

residing at 91 Circle Drive,Syosset,NY 11791,hereinafter referred to as"DECLARANT":
WITNF,SSETH:
WHEREAS,DECLARANT is the owner of certain real property located at 4060 Ole Jule Lane,
Mattituck,Town of Southold, County of Suffolk, State of New York, described in the Suffolk County
Tax Map as District 1000, Section 122,Block 4,Lot 26.2,which is more particularly bounded and
described as set forth in Schedule"A" annexed hereto,hereinafter referred to as the Property; and
WHEREAS,the Property is situated on lands within the jurisdiction of the Board of Trustees of
the Town of Southold(hereinafter the"Trustees")pursuant to Chapter 275 of the Town Code of the Town
of Southold or its successor, and various activities conducted upon the property may thus be subject to the
regulation and approval of the Trustees prior to being conducted; and
WHEREAS,the DECLARANT therefore made application to the Trustees for a permit pursuant to
the Wetlands Law of the Town of Southold to undertake certain regulated activities; and
WHEREAS,on July 14,2021,the Trustees approved the application and issued a pernrit with terms
and conditions;and
WHEREAS,on April 13,2022,the Trustees approved an"Administrative Amendment"to the
permit;and
WHEREAS,the issued permit,"Administrative Amendment," terms and conditions of the permit,
and the site plan prepared by AMP Architecture,LLC,last dated March 14,2022,and stamped approved on
April 13,2022,upon which the amended permit is based,are annexed hereto as Schedule`B;"and
WHEREAS, as a condition of the granting of a Wetlands Permit to undertake such regulated
activities,the Trustees required that a fifty-foot wide"non-disturbance buffer"be established and
perpetually maintained adjacent to the landward edge of tidal wetlands boundary; and
WHEREAS,the DECLARANT has considered the foregoing and has determined that the same
will be for the best interests of the DECLARANT and subsequent owners of the Property.
NOW, THEREFORE,the DECLARANT does hereby covenant and agree as follows:
1) Upon the substantial completion of the aforementioned permitted activities there shall be
established and perpetually maintained adjacent to the landward edge of tidal wetlands
boundary,a fifty-foot wide"non-disturbance buffer"as defined by Chapter 275 of the
Town Code, as depicted on the site plan prepared by AMP Architecture,LLC,last dated
March 14,2022,and stamped approved on April 13,2022.
2) The DECLARANT shall at all times comply with the Terms and Conditions of the permit,
a copy of which is attached hereto in Schedule"B"annexed hereto.
3) These covenants shall run with the land and shall be binding on the DECLARANT,his
heirs,assigns,purchasers,or successors in interest and may be modified only upon resolution
of the Board of Trustees.

l. That the said Board of Trustees and the Town of Southold are released from any and all
damages,or claims for damages,of suits arising directly or indirectly as a result of any
operation Per rormed pursuant to this permit„and the said Pertarittee will,at his or her own
expense,derend any and all such suits initiated by third parties,and the said Permittee
assumrres full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 24 nsonths, which is considered to be the estimated
time required to complete the work involved,but should eirc:rnwitances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
r ,r ents,and non-compliance with the provisions of the origiatating application may be cause
for revocation of thin Permit by resolution of the said Board
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6, Thal there shall he no intertirrence with the right of the public to pass and repass along the
beads between high and low water ntarks.
T That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work licrein authorized,or if,in the opinion of the Board of Trustees, the work
:shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice, to remove or alter this work project herein stated without expenses to the
TOIxtr of Southold.
9. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded Nvith ihe Suffolk eotmty Clerk's Office as a notice covenant and deed restriction to
the deed of[lie subject parcel., Such evidence shall be provided within ninety(90)calendar
days ol,issuance of'thi;s pernlit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized,
10, That the Pernlittee will obtain all other pertni'ts and consents that may be required
supplemental to this permit„which nmy be subject to revoke„upon failure to obtain same,
1], NO o-ight to trespass or interfere with riparian rights. 'I'his permit does not convey to thc:
permittec any right to trespass upon the lands or interfere with the riparian rights ofoilaers in
order to perform the permitted work nor does it authorize the impairment of any rights,title,

The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, April 13, 2022.
RESOLVED that the Southold Town Board of Trustees APPROVE the Administrative
Amendment to Wetland Permit#9957 to reduce areas of the proposed dwelling from 1996 to
1911sq.ft.; the covered patio from 376 to 357sq.ft.; and to increase the area of the proposed
grade-level pervious gravel patio from 530 to 644sq.ft; and as depicted on the site plan
prepared by Anthony M. Portillo, dated March 14, 2022 and stamped approved on April 13,
2022.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not an approval from any other agency.

Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, August 14, 2024 regarding the above matter:
WHEREAS, En-Consultants on behalf of WYANDANCH REAL ESTATE CORP. applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town
Code, the Wetland Ordinance of the Town of Southold, application dated June 27, 2024, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be found
Consistent with the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
August 14, 2024, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 275 of the Southold
Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent with the
Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees APPROVE the application of WYANDANCH REAL
ESTATE CORP. to construct a fixed timber dock consisting of a 4'x29' elevated catwalk with
open-grate decking, 3'x14' aluminum ramp, and a 5'x18' floating dock situated in a "T"
configuration and secured by two (2) 10" diameter pilings; and to clear and maintain a 4' wide
access path to dock through the 50' wide non-disturbance buffer; all as depicted on the site plan
prepared by En-Consultants, received on August 2, 2024, and stamped approved on August 14,
2024.
Permit to construct and complete project will expire three years from the date the permit is
signed. Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

TERMS AND CONDITIONS
The Permittee Wyandanch Real Estate Corp. 4060 Ole Jule Lane Mattituck New York as part
of the consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 36 months,which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice, to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

my recommendation that the action is CONSISTENT with the LWRP.

I TERMS AND CONDITIONS

The Permittee,Michael Monteforte residing at 4060 Ole Jule Lane,Mattituck,New York as part
of the consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages,or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will,at his or her own
expense,defend any and all such suits initiated by third parties,and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved,but should circumstances warrant,request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents,and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if,in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the

8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,

Permits: TIDAL WETLANDS
1. Post Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous
location on the worksite and adequately protected from the weather.
2. Conformance With Plans All activities authorized by this permit must be in strict conformance
with the approved plans submitted by the applicant or applicant's agent as part of the permit application.
Such approved plans were prepared by En-Consultants. dated 6/22/2024 and stamped 'NYSDL-C
Approved' on 7/19/2024.
3_ Notice of Commencement At least 48 hours prior to commencement of the project, the permittee
and contractor shall sign and return the top portion of the. enclosed notification form certifying that they
are fully aware of and understand all terms and conditions of this permit. Within 30 clays of completion
of project, the bottom portion of the form must also be signed and returned, along with photographs of
the completed work.
4. Precautions Against Contamination of Waters All necessary precautions shall be taken to
preclude contamination ofany wetland or waterway by suspended solids, sediments, Fuels. solvents,
lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials
associated with the project.
S. Storage of Equipment, Materials The storage of construction equipment and materials shall be
confined within the project work area and/or upland areas greater than 100 linear feet from the tidal
wetland boundary.
6. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from
construction of this project shall be completely removed from the adjacent area (upland) and removed to
an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas.

7. No Disturbance to Vegetated Tidal Wetlands "There shall be no disturbance to yCgetatCd octal
wetlands or protected buffer areas as a result of the permitted activities.

width of six feet. The pathilself is limited to a maximum width of four feet.
11. Cover Material For Footpath Cover material used for footpaths is limited to natural wood/bark
chips, stone, gravel or sand.
12. No Prop Dredging Prop dredging, or the act of utilizing and/or directing the propeller or
propulsion system of a motorized vessel and/or the water-borne forces created by said propeller or
propulsion system, to excavate or displace existin,,, bottom sediment and benthic habitat for the direct or
indirect purpose ofestablishing or increasing water depth, is a regulated activity and is not authorized by
this permit. Prop dredging- is strictly prohibited wlthOlil further lvritterl authorization (permit,
modification or amendment) from the department.
13, Wood Preservatives
a. Pressure treated wood used for construction of in-water structures must have undergone a
treatment process approved (stamped or otherwise marked as certified) by the American Wood
Preservative Association.
b. Wood treated with Pentachloropherlol (PCP) must not be used in marine or brackish waters. Wood
trebled with PCP must be aged in file open air for at least three months prior to in-water use.
c. The use of creosote treated wood is prohibited both. in the water and upland areas.
d. Chromated Copper Arsenate (CCA) pressure treated wood rllLisl be clean and free oPCCA surface
deposits. Wood with surface deposits must be washed for at least 5 i1 inLIteS Under rUnning water
prior to use. The washing Hoist occur greater than IOU feet landward of any regulated wetland
and/or water body. (Note "E;." below for handling wash water.)
e. Any wood debris such as sawdust or wash water must not enter any water body, including wetlands
or protected buffer areas.
14. Dock, Catwalk Size Dock or catwalk shall not exceed 4 Teel In width and shall be a minimum ol'4
feet above grade (as measured front ground to bottom of docideatwalk decking) over tidal wetland areas.

16. Docks at Property lines Docks/catwalks/floats must not:

17. No Permanent Structures on Dock No permanent structures shall he installed on
clock/catwalk/float without first obtaining written Department approval (permit, modification, or
arllendrllent).
18. No Structures on Pilings No structures, other than structures specifically authorized by this
permit, shall be constructed on pilings wilhout further authorization from the department (permit,
modification of amendment).
19. Pilings at Property Lines Pilings shall not:
a. extend laterally beyond property lines.
b. interfere with navigation, or
c. interfere with other landowners riparian rights.
20. State May Require Site Restoration If upon the expiration or revocation of this permit, the
project hereby authorized has not been Completed, the applicant shall, without expense to the State, and
to SUCI7 extent and In SLICK time and nlallner as the Department of Environmental Conservation I1lay
lawfully require, remove all or any portion of the uncompleted strUcLUI'C or fill and restore the site to Its
former condition. No claim shall be made against the State of New York on account of any such
removal or alteration.
21. State May Order Removal or Alteration of Work If future operations by the State of New York
require an alteration in the position of the structure or wort: herein authorized, or if; in the opinion of the
Department of-Environniental Conservation it shall cause unreasonable obstruction to the free navigation
of said waters or flood flows or endanger the health, safety or welfare of the people ofthe State, or cause-
loss or destruction of the natural resources of the State, the owner may be ordered by the Department to
remove or Alter the structural work, obstructions, or hazards caused thereby without expense to the State,
and it; upon the expiration or revocation of this permit, the structure, fall, excavation, or other
modification of the watercourse hereby authorized shall not be completed, the owners, shall. without
expense to the State, and to such extent and Ill SLICK tlllle alld nlallner as the Department of
Environmental Conservation inay require, remove all or any portion of the Uncompleted structure or fill
and restore to its former condition the navigable and flood capacity ofthe watercourse. No claim shall
be made against the State of New York on account of any such removal or alteration.

GENERAL CONDITIONS Apply to ALL Authorized Permits:
i. Facility Inspection by The Department The permitted site or facility, including relevant records, is
subject to inspection at reasonable hours and intervals by an authorized representative of the Department
of Environmental Conservation (the Department) to determine whether the permittee Is complying with
this permit and the LCL. Such representative may order the wort: suspended pursuant to EC'L 71- 0301
and SAPA 401(3).
The permittee shall provide a person to accompany the Department's representative during all inspection
to the permit area when requested by the Department.
A copy of this permit, including all referenced maps, drawings and special conditions, must be available
for inspection by the Department at all tinles at the project site or facility. Failure to produce a copy of'
the permit upon request by a Department representative is a violation of this permit.
2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly
provided for by the Department, issuance ofthis permit does not modify, supersede or rescind any order
or determination previously issued by the Department or any of the terns, conditions or requirements
contained in such order or determination.

The proposed dock,which is consistent in all ways with the"construction and operation standards"for docks set forth by
Town Code Section 275-11(C)(2),would be located inside a dredged canal characterized by numerous other residential
and commerical dock structures, including those located at the adjacent properties to the northeast(Permit No. 1709)and
southwest(Permit No. 1914),and the marina basin across the canal(Permit No.7912).Due to the undulating shoreline
and the fact that the two adjacent docks are located partially to completely within a dredged basin,there is no discernible
"pier line"established by the adjacent docks.However,together with a vessel having a maximum berth of 7 feet,the dock
would extend approximately 29 feet seaward of mean low water(MLW)where the creek is approximately 88 feet wide,
thus compliant with the maximum allowable seaward encroachment of one-third of the width of the waterway.And to
maintain and protect the existing tidal marsh vegetation,the catwalk would be elevated 4 feet above the grade of marsh
and constructed with untreated,open-grate decking to allow for light penetration through the dock.The proposed dock
would thus have no adverse impacts on existing navigational conditions or otherwise affect the public and recreational use
of the waterway,nor would it create a"fragmentation of ecological communities"along the developed shoreline;result in
the physical loss,degradation,or functional loss of ecological components;or otherwise adversely impact the adjacent
vegetated tidal wetlands or surface waters.

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its si nig ficant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
