POLICY: At the beginning of scheduled Town Board meetings, the attending public is encouraged to
briefly address the Town Board relating to agenda resolutions prior to their enactment; the public will also be
given time at the conclusion of the regularly scheduled business agenda to address the Board on any given
topic.
ONLINE ACCESS: The Tentative Agenda is generally available the Friday before the meeting. The video of
the meeting is usually available to watch live during the meeting. Minutes with adopted resolutions are
available 1-2 days after the meeting. A full copy of the minutes, agenda and meeting video can be viewed by
going to the official Town of Southold website:

(1) Move pointer over "Government" on the Town website home page. You will find the title "Town
Supervisor/Town Board". Under this title you will see "Southold Town Board Meetings and Agendas". or
(2) Go to "How Do I", in the right upper corner of the Town website home page, Choose "Access", then
"Southold Town Board Meetings and Agendas.
Go to the date of the meeting and click on "Minutes Packet" this is the full copy of the resolutions. (Scroll to
bottom of page for KEY to symbols). You can view the live video of the meeting by clicking on the camera
symbol. All of this information is available 24/7.

Due to the expiration of the New York State Governor's Executive Orders regarding the COVID-19 pandemic
in-person access to the Public will now be permitted. The meeting will still be accessible via Zoom and
streamed live on the Town's website. The meeting can be viewed live by going to the Town's website at
www.southoldtownny.gov <http://www.southtownny.goy> home page. Click on the "Government"tab, once
the drop down menu appears, under "Town Supervisor/Town Board", click on "Southold Town Board Minutes
and Agendas"which takes the user to the Town of Southold Meeting Portal page. Once on the Meeting Portal
page, click on the date of the meeting you wish to view and then click on "Video". A recording of the meeting
will also air on Channel 22 and will be posted on the Town's website
Instructions and link to attend the meeting will be available on the Town's website or by calling the Town
Clerk's office at (631)765-1800. A telephone number will also be provided to allow members of the public to
attend via telephone.

Retirement Resolution for Elected Officials
WHEREAS, the State of New York has set additional reporting requirements in Section 315.4 of the New York Codes,
Rules and Regulations which requires all elected and appointed officials whose terms start on or after August 12, 2009,
who are members of the New York State and Local Retirement System and who do not participate in their employer's
time keeping system to prepare a log of their work-related activities for three consecutive months and submit their logs to
the clerk or secretary of the governing body within 150 days of the start of their term;
NOW THEREFORE, BE IT
RESOLVED that the Town Board of the Town of Southold hereby establishes the following as standard workdays for
elected and appointed officials and will report the following days worked to the New York State and the Local
Employees' Retirement System based on the record of activities maintained and submitted by these officials to the clerk
of this body:

Pederson Standard Subdivision Amended Agreement
RESOLVED that the Town Board of the Town of Southold hereby accepts the Amended Agreement, extending
the time to complete the Pederson Standard Subdivision improvements for an additional one (1) year from the
expiration of the 18-month period and incorporates the Agreement dated February 3, 2023 as so amended.
Previously, The Town Board accepted the Performance Bond on March 28, 2023, in the form of an official
bank check from CitiBank, check 4116497118 in the amount of$71,952.00 for the Pederson Standard

RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local
Law at Southold Town Hall, 53095 Main Road, Southold, New York, on the 8th day of October, 2024 at 4:30

A Local Law entitled, "A Local Law in relation to Amendments to Chapter 280 Zoning"
BE IT ENACTED by the Town Board of the Town of Southold as follows:
L Purpose - The purpose of this local law is to allow fees to be determined by Town Board resolution.
IL Chapter 280 of the Code of the Town of Southold is hereby amended to include the underlined words and
remove the struck through words as follows:
Article I General Provisions
§ 280-4 Definitions.
B. Definitions and usages. Unless otherwise expressly stated, the following terms shall, for the purpose of this
chapter, have the meanings as herein defined. Any word or term not noted below shall be used with a meaning
as defined in Webster's Third New International Dictionary of the English Language, unabridged(or latest
edition).
DAY-CARE CENTER
Any premises or part thereof maintained for the care of infants, toddlers and children, away from their
own homes, for more than three hours but fewer than 24 hours per day per child in accordance with all
applicable regulations.
HOUSEHOLD PET
Any animal that has been bred or raised to live in the habitation of humans and is food and shelter
dependent. Household pets include, but are not limited to, does, cats,birds, fish and rabbits.
PET BOARDING SERVICE
The provision of housing and care of a household pet in the absence of the owner for a period of 24 hours
or more with the exception of veterinary hospitals, so lone as the boarding area is in accordance with the
applicable town, county and state regulations.
PET GROOMING ESTABLISHMENT
A building, or part thereof, or premises maintained for the purpose of offering bathing, clipping or
combine of animals and for which a fee is charged. This definition includes facilities that offer self-service
bathing or grooming.
PET DAY-CARE
Any premises, or part thereof, maintained for the purpose of providing socialization, training or housing,
in the absence of the owner, for less than 24 hours for household pets owned by the general public for
which a fee is charged.
PET CARE FACILITY
A facility that provides one or more household pet care services, including a pet momin2 business, pet
day care, pet boarding service, obedience training, socialization and accessory retail sales of pet products.
The breeding and/or sale of animals shall not be permitted in such a facility. Use of outdoor areas for the
services provided must be supervised to prevent the occurrence of obiectionable noise or other nuisances
beyond the boundaries of the site on which it is located. All household pets must be controlled at all times
to prevent their escape or trespass onto nei2hborin2 properties. Animal waste must be disposed of in a
manner that will not pollute groundwater or cause odors to leave the premises, and in accordance with
the applicable town, county and state regulations.
Article VIII Residential Office (RO) District
§ 280-38 Use regulations
In the Residential Office (RO) District, no building or premises shall be used and no building or part of a
building shall be erected or altered which is arranged, intended or designed to be used, in whole or in part, for
any uses except the following:
A. Permitted uses.
(3) The following uses are permitted uses subject to site plan approval by the
Planning Board:
(h) Day-Care Center
Article IX Limited Business (LB) District
§ 280-41 Use regulations.
In the LB District, no building or premises shall be used and no building or part of a building shall be erected or
altered which is arranged, intended or designed to be used, in whole or in part, for any uses except the
following:
A. Permitted uses. The following uses are permitted uses. All permitted uses except single-
family and owner-occupied two-family residences require site plan approval.
(13) Day-Care Center
Article X Hamlet Business (HB) District
§ 280-45 Use regulations.
In the HB District, no building or premises shall be used and no building or part of a building shall be erected or
altered which is arranged, intended or designed to be used, in whole or in part, for any uses except the
following:
A. Permitted uses. The following are permitted uses and, except for those uses permitted
under Subsection A(1), (2), (3) and(20) hereof, are subject to site plan approval by the
Planning Board:
(24) Day-Care Center
Article XI General Business (B) District
§ 280-48 Use regulations.
In the B District, no building or premises shall be used and no building or part thereof shall be erected or altered
which is arranged, intended or designed to be used, in whole or in part, for any uses except the following:
A. Permitted uses. The following uses are permitted uses and, except for those uses
permitted under Subsection A(1), (12) and (13) hereof, are subject to site plan approval
by the Planning Board:

(16) Pet Care Facility
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of
competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part
thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law.

WHEREAS, the Town Board of the Town of Southold (herein called the "Town"), in the County of Suffolk,
New York, on behalf of the Southold Solid Waste Management District, in the Town (herein called the
"District"), has determined that it is in the best interests of the District to increase and improve the facilities of
the District, by the acquisition of a grinder at an estimated maximum cost not to exceed $1,220,000,pursuant to
Section 202-b of the Town Law; and
WHEREAS, the Town Board, as lead agency, has given due consideration to the impact that the project may
have upon the environment and, on the basis of such consideration, the Town Board, acting as Lead Agency,
pursuant to the New York State Environmental Quality Review Act(hereinafter sometimes called "SEQRA")
has found and determined that the project is a Type II Action and no further environmental review is required;

ORDERED, that a meeting of the Town Board of the Town be held at the Town Hall, 53095 Main Road,
Southold, New York, on the August 13, 2024 at 9:00 A.M. (Prevailing Time) to consider said increase and
improvement of facilities of the District and to hear all persons interested in the subject thereof concerning the
same and for such other action on the part of the Town Board with relation thereto as may be required by law;

96, Boats, Docks and Wharfs," and
WHEREAS the Town Board of the Town of Southold held a public hearing on the aforesaid Local Law at
which time all interested persons were given an opportunity to be heard, now therefor be it
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local Law entitled,
"A Local Law in relation to an Amendment to Chapter 96, Boats, Docks and Wharfs,"which reads as
follows:
LOCAL LAW NO. 2024
A Local Law entitled, "A Local Law in relation to an Amendment to Chapter 96, Boats, Docks and
Wharfs,"
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose - The Purpose of the amendment is to address waterfowl blinds.
II. Amendment- The Southold Town Code is hereby amended by removing the struck
through words and adding the underlined words as follows:
§ 96-1 Permit required.
No person shall place any piles, stakes, buoys, piers, docks, waterfowl blinds, bulkheads or other objects in or
on any Town waters or public lands under or adjacent to Town waters in the Town of Southold, nor shall any
person remove any sand, gravel or other materials from lands under Town waters in the Town of Southold
without first obtaining a permit therefor from the Board of Trustees of the Town of Southold.
§ 96-3 Issuance of permits by Board of Trustees.
The Board of Trustees of the Town of Southold is hereby authorized and empowered:
A. To issue revocable permits for the placing of piles, stakes, buoys, docks, waterfowl
blinds or other objects in or on any Town waters or public lands under or adjacent to
Town waters, and for the removal of sand, gravel or other materials from lands under
Town waters, provided that the same do not obstruct or interfere with navigation or the
public use of said waters or lands.
§ 96-7 Definitions.
For the purpose of this article, the terms used herein are defined as follows:
Waterfowl Blind-Any structure or device,whether it be affixed, floating, portable or otherwise,
constructed or utilized for the purpose of hunting waterfowl.
§ 96-19 Bathing and swimming.
No person shall swim or bathe in the mouth of Mattituck Inlet between afeas designated Ns. 3 and 5.
§ 96-24 Mooring and Waterfowl Blind Ppermits.
A. The Town of Southold permits the installation of moorings for boats in specified
locations of Town waters. The use of moorings has increased to such an extent that the
number of moorings has begun to impair the fragile marine environment in the
surrounding Town waters. The Town Board therefore declares it to be the policy of the
Town to restrict and regulate the issuance of mooring permits as described herein. All
boats permitted to use a mooring shall be entitled to such use between the months
of April and December only.
D. The Town of Southold permits the installation of a limited number of waterfowl
blinds in specified locations of Town waters for a period from October 1 through
March 15.
E. Conditions:
1. Permitted functional blinds shall be in place by no later than December 1
each year or the permit will be rescinded. Blinds must be removed no later
than March 31st.
2. An applicant must provide an aerial image depicting a 500ft unobstructed
safety zone at least 1801 around the blind for firearm discharge in from of
the blind; this may not include any navigation channels.
3. A blind may be no closer than 500ft from another blind.
4. A copy of the permit must be posted inside the blind.
5. No more than one blind permit will be issued per person.
6. Existing permit holders may be eligible for 2randfatherin2 of positions at
the Trustee's discretion.
F. Severability:
1. Permitted, functional blinds shall be in place by no later than December
1st each year or the permit may be revoked.
2. Blinds must be removed no later than March 31st.
3. Waterfowl blind permits may be revoked at the discretion of the Board of
Trustees upon resolution at a noticed public meeting.
4. The Town may remove or cause to be removed any blind that is in violation
of the Town Code with the cost associated with removal and storne borne
by the owner/permittee.
5. The Board of Trustees reserves the right to regulate the placement of
waterfowl blinds, as well as the season and hours of operation to minimize
user conflict and promote safety.

III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of
competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part
thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law.

§ 275-11 Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction
f the Trustees:
(4) Fences.
(f) Fences shall not be permitted within 20 feet of any wetland
boundary.
C. In water. The following standards are required for all in-water operations
adjacent to residential properties. Operations conducted on properties zoned
MI or M2 may be given greater flexibility in these requirements given the
water-dependent nature of their use.
(2) Docks
(b) Dock locations and lengths.
[2] Within creeks and other narrow waterways, no dock length
shall exceed 441/4 the total width of the water body.
Determination of the length of the dock must include the
dimensions of the vessel.
§ 275-12.1 Stop-work orders.
A. The Bay Constable, Harbor Master, Zoning Inspector, Ordinance Inspector or
Code Enforcement Officer is are authorized to issue stop-work orders pursuant to

(1) Any work that is determined by the Bay Constable, Zoning inspeeter

in the opinion of the Harbor Master Bay Constable, Zoning
Inspector, Ordinance Inspector or Code Enforcement Officer,
without regard to whether such work is or is not work for which a
Trustee permit is required, and without regard to whether a Trustee
permit has or has not been issued for such work; or
B. Stop-work orders shall:

§ 275-15 Coordination and enforcement.
The Harbor Master Difeetef of(`ode Efif,feet,o„t Zoning Inspector, Ordinance Inspector and/or the
Bay Coast-' lee Code Enforcement Officer are responsible for coordination and enforcement of the

§ 275-16 Compliance requirements; penalties for offenses.
A. It shall be unlawful for any carter, owner, occupant, builder, architect, contractor
or their agents or any other person to fail to comply with any provisions of this
chapter or to fail in any manner to comply with a written notice, directive or order
of the Harbor Master Difeetef of(`ode Efif,,-,etne„t, Zoning Inspector,
Ordinance Inspector or Bay Constable Code Enforcement Officer or to
conduct any operation in a manner not in compliance with a permit issued
pursuant to this chapter.
B. For each offense against any of the provisions of this chapter or any regulations
made pursuant thereto, or failure to comply with a written notice or order of any
Harbor Master Difeetef of Code >!~„fefee,,,e„*, Zoning Inspector, Ordinance
Inspector or Bay Coast hie Code Enforcement Officer within the time fixed for
compliance therewith, the owner, occupant, builder, architect, contractor or their
agents or any other person who commits or participates , takes r^ft of assists in
the commission of any such offense or who shall fail to comply with a written
order or notice of the Harbor Master Difeetef of Code Efif fee,,,e„t, Zoning
Inspector, Ordinance Inspector or Bay Constable Code Enforcement Officer
shall be subject to the following fine schedule. Each day on which such violation
occurs may constitute a separate, additional offense.
(1) Failure to obtain a permit.Any person conducting operations within the
jurisdiction of the Trustees without first obtaining a permit according to
the procedures outlined in this chapter shall be subject to a fine not to

(2) Failure to comply with the terms of a permit.
(a) Any person failing to comply with the terms of a permit shall be

direct contradiction to the terms of a stop-work order shall be subject to a

of this section within the proscribed period of time for completion
shall be guilty of an offense and subject to a fine not to exceed $25,000,

(7) Mitigation. When on-site wetlands restoration and creation may be
unfeasible due to technical or other constraints, other mitigative measures,
such as off-site wetland restoration or creation, may be required.
(8) Other offenses. For an offense against any of the provisions of this chapter
not specifically designated above, a violator shall be subject to a fine not

III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of
competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part
thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law.
