The applicant has secured Site Plan Approval and Health Department approval for the
renovation and repurposing of the former North Fork Bank/Capital One building located
at the center of the Love Lane business area. The current approval is for a mixed use
building containing a 56 seat restaurant, several dry retail stores, and one Affordable
Housing Apartment Unit. The approvals include the transfer of 1.6 units of sanitary flow
credits.
The applicant has determined that a revision of the plans to much larger residential
component, consisting of twelve affordable housing units, and a reduction in the
commercial uses to two dry retail spaces and a small caf6, is desirable. This revised plan
can be accommodated with the sanitary system currently approved by the Health
Department, and without expansion of the existing footprint of the building. In order to
accommodate the additional affordable apartments, the applicant would like to acquire an
additional seven (7) sanitary credits. Application will be made to the Suffolk County
Department of Health Services for revised approval of the water supply, which is
furnished by public water through Suffolk County Water Authority, and the sanitary
system, which is being upgraded to current standards from the existing system.
The property is located in the Hamlet Business zone, virtually at the center of the
Mattituck Halo area. Since the project is a repurposing of a well known, large existing
and outdated building, the revitalization of the building is important to the community
and to the Love Lane district. There are no sensitive wetlands or vegetated
environmental issues as no wetlands are nearby and the property is already fully
developed. The plan is in keeping with the Love Lane area purpose and atmosphere, as
well as the goals and guidelines for location of affordable housing.
A summary of the septic system analysis for the proposed project is set forth in the
attached letter dated June 11, 2024 from NJ Mazzaferro, PE attached to this application.
In order to accommodate the additional affordable apartments, additional sanitary flow
credits are needed to meet the Suffolk County Dept. of Health requirements for the
sanitary system and super-offset computations.
This transfer would not have a significant effect on the number of remaining
Mattituck-based credits, which were banked as a result of preservation of many sensitive
properties in the Mattituck Embayment Area. This project is in the center of that map, in
an area that is significantly less envirom-nentally sensitive than those preserved areas.

Therefore, it is an appropriate candidate for such a transfer and is in conformity with
the goals of the transfer program for the following reasons:
a. The proposed transfer will not significantly increase development, as the building
already exists, and housed a large number of employees for many years. While the uses
proposed will generate a need for additional sanitary flow, that use is desirable for and
compatible with the community nature of the Love Lane district.
b. The district contains adequate parks, public facilities, and fire protection. Water
supply and waste disposal will be thoroughly addressed by the Health Department.
c. The redevelopment is compatible with good environmental planning by allowing
re-use of an antiquated building, rather than new construction on raw land.
d. The plan is compatible with the goals of the draft comprehensive plan and the
Mattituck stakeholder goals, is in the epicenter of the Mattituck Hamlet Center, and is
otherwise permitted by applicable zoning.
The project is an Eligible Project under Town Code Section 117-3 because it is
located in a receiving distribution which permits the proposed uses.
Accordingly the applicant respectfully requests a transfer of seven (7) sanitary credits
for use in connection with this project.

Summary — Septic System Analysis
There is a mixed used design for this property that was initially submitted to SCDOH in
2021. The proposed Septic System was approved by SCDOH on 4/4/22 (Reference
Number C-21-0045). The approved system supports a full service restaurant, dry retail
and a one bedroom apartment.
The proposed design was analyzed for the Septic System Daily Load. The design density
and kitchen/gray load were considered. (See Attached Chart)
The proposed revision (by nastasi architects dated 6-4-24) will result in the following
design sewage flow rate for full build out without restrictions:
Total Hydraulic Load = 1,821.20 GPD
Total Gray Load = 143.30 GPD
Total Density Load = 1,677.90 GPD
If the basement storage areas are restricted by deed the design flow may be reduced.
Assuming a 100% reduction:
Total Hydraulic Load = 1,725.40 GPD
Total Gray Load = 143.30 GPD
Total Density Load = 1,5 82.10 GPD
The proposed revision will require the SCDOH approved volume level (Density Flow
Rate) for septic processing to be increased. The approved infrastructure design already
includes all the elements necessary for the uses, the size of the elements will not need to
be altered to handle the updated Design Flow Rates. The summary details septic
requirements for the revised uses.

The proposed revision (by nastasi architects dated 6-4-24) will result in the following
design sewage flow rate for full build out without restrictions:
Total Hydraulic Load = 1,821 GPD
(Total Gray Load = 143 GPD and Total Density Load = 1,667 GPD)
If the basement storage areas are restricted by deed the density flow may be reduced.
Assuming a 100% reduction:
Total Hydraulic Load = 1,725 GPD
(Total Gray Load = 143 GPD and Total Density Load = 1,582 GPD)
It is noted that:
I - This is a basic analysis and the proposed uses do not have an approved final design.
2 —The proposed concept requires increasing the current SCDOH approved Density Flow
Rate. (Using 950 GPD - exceeds by 67%)
3 —The SCDOH approved design for the new system contains all the infrastructure
elements necessary to meet the proposed uses.
4—From an engineering standpoint; the approved septic system can be slightly modified
to properly size the greatly reduced Kitchen/Gray Load. The same elements will be used
including the precast concrete septic tank and leaching field. The size of the grease trap
can be reduced. The locations for the system installation previously shown on the
approved site plan continue to be used.
From the technical perspective, the current approved system design has a
processing capacity of 3,825 gpd. If the additional density flow of 632 gallons per
day was granted, the build out would include— 12 apartments (8 under 450sf, 4
under 600st) 2 dry retail uses at approximately 1975 sf, and 1 wet retail use at 1195
sf. The septic system for this build-out would be based upon the existing approved
system design and location. The revised system would still use a 12' diameter
precast concrete septic tank and gallery leaching field with a properly sized grease
trap.

for the transfer of seven sanitary transfer credits from the Town's Sanitary Credit Bank in
connection with its renovation of the building. The proposed mixed use building will
better serve the community, will complement the existing businesses, and will include 12
affordable apartments.
