The applicant proposes constructing eight(8)one-bedroom apartments under 400 square feet, requiring 110 GPD per unit, and four(4)one-bedroom apartments under 600 square feet, generating 150 GPD per unit. An existing 3,825 GPD sanitary system supporting a full-service restaurant;dry retail, and one-bedroom apartment was approved by the Suffolk County Department of Health Services in 2022. The applicant seeks the existing, approved system to accept an additional 950 GPD density flow rate. Seven(7)sanitary flow credits are required due to the shortfall of GPD appropriated to the parcel and the number of apartments proposed. The action has been reviewed to Chapter 130 Environmental Quality Review of the Southold Town Code and the New York State Department of Environmental Conservation regulation 6NYCCRR Part 617 State Environmental Quality Review and it is my recommendation that the Town Board,as lead agency, issue a Negative Declaration for this Unlisted Action pursuant to 6 NYCRR Part 617, Section 617.7 of the State Environmental Quality Review Act(SEQRA). This determination was based upon the information provided in the file, the Short Environmental Assessment Form dated July 13,2024,and the results from the NYSDEC Environmental Mapper Program, the Town of Southold Local Waterfront Revitalization Program Coastal Consistency Review consistent recommendation, and lastly, the Southold Town Planning Board report dated August 19,2024. Krupski Jr., Town Supervisor Members of the Town Board Denis Noncarrow, Town Clerk From: James H. Rich III, Chairman cc,`U Members of the Planning Board' Date: August 23, 2024 Re: Transfer of Sanitary Flow Credits to Hard Corners Partners LLC SCTM#1000-141.-4-6.2 Location: 245 Love Lane, Mattituck,NY--; .' The Planning Board supports the transfer of seven(7) sanitary flow credits. The proposed action involves the request for the transfer of seven (7) sanitary flow credits to create twelve (12) affordable accessory apartments in the renovation of an existing building (former Capital One) in the Hamlet Business Zoning District. Chapter 117. Sanitary Flow Credits, Transfer of§ 117-3. Definitions. Permits such a transfer for an Eligible Project defined as:, "Projects located in a receiving district that are permitted uses in the zoning district where the subject property is located. " A receiving district is defined as: "RECEIVING DISTRICT-An area of the Town that is desirable to be developed more intensively than areas outside the district. " The proposed action meets the definition of a receiving district. The building is located within the Hamlet Business (HB) Zoning District, and accessory apartment use is permitted. It is also located within the Mattituck Hamlet Center, an area with supporting amenities, public transportation, and infrastructure to support increased residential density for affordable housing opportunities. ....... _...... ............ ...... ... . ... ........ .................. ......... ......... .. .. ..... . I Page Chapter 117 Sanitary Flow Credits, Transfer of the Southold Town Code requires that the Planning Board evaluate the application to the following criteria: 1. The effects of potential increased development which is possible under the transfer of development rights; The property is zoned HB and is located within an eligible receiving district. The purpose of the zoning district states: The purpose of the Hamlet Business (HB) District is to provide for business development in the hamlet central business areas, including retail, office and service uses, public and semi-public uses, as well as hotel and motel and multifamily residential development that will support and enhance the retail development and provide a focus for the hamlet area. The proposed transfer of sanitary flow credits to construct affordable housing in a mixed-use building does not conflict with the purpose of the HB Zoning District. 2. That the district contains adequate resources, environmental quality and public facilities, including adequate transportation, water supply, waste disposal and fire protection; Built Environment and Existing Conditions The parcel is located west of Love Lane in the Mattituck Hamlet Center and south of Pike Street near many commercial uses that would support the residents of the units. The United States Post Office, LIRR Train Station, religious institutions, grocery stores, restaurants, and other commercial businesses are located nearby and are easily within walking distance. The parcel is located within the Mattituck Union Free School District. Public schools available to residents of units would be available. There are no soil or topographical limitations on site. The parcel is not located within a FEMA-mapped flood zone: The building is not listed on The Society for the Preservation of Long Island Antiquities (SPLIA) map. Transportation and Infrastructure Parcel Access Impacts on transportation from constructing twelve (12) units are expected to be low. _._.....................___.._..................._ _....................................... .._....................................._.... . 2 1 P a g e Twenty-four vehicle parking spaces are required. Vehicle parking is proposed in an improved parking area located at the rear of the parcel or along Pike Street and Love Lane, both public streets. Additional parking is available in the Southold Town parking area south of the parcel. Infrastructure Public sidewalks and painted crosswalks are located both in front and on the side of the building and are adequate for pedestrians to travel between Love Lane and Pike Street safely. Supporting pedestrian infrastructure will lessen dependency on vehicle use. Distance to Public Transportation Public transportation is accessible to tenants and customers within .10 miles of the site. The Long Island Railroad train station and service are located across the street from the building. Bus transportation is available. Access to Public Water and Sewers Suffolk County Water Authority public water is connected to the building. The parcel is located within SCDHS Groundwater Management Zone IV, not over a Special Groundwater Protection Area(SPGA). Waste Disposal The applicant proposes constructing eight(8) one-bedroom apartments under 400 square feet, requiring 110 GPD per unit, and four(4) one-bedroom apartments under 600 square feet, generating 150 GPD per unit. An existing 3,825 GPD sanitary system supporting a full-service restaurant, dry retail, and one-bedroom apartment was approved by the Suffolk County Department of Health Services in 2022. The applicant seeks the existing, approved system to accept an additional 950 GPD density flow rate. Seven(7) sanitary flow credits are required due to the shortfall of GPD appropriated to the parcel and the apartments proposed. The total number of sanitary flow credits in the Mattituck/Cutchogue Sanitary Flow Credit Bank is 41.02. 3. That there will be no significant environmentally damaging consequences; and that such increased development is compatible with comprehensive planning and the development otherwise permitted by the Town and by the federal, state and county agencies having jurisdiction to approve permissible development within the district. The addition of the units is compatible with and supports the 2007-2008 Hamlet Study and Mattituck Stakeholder recommendations, Policies 1, 5 and 6 of the Town of Southold Local Waterfront Revitalization Program and is consistent with the Southold Town Comprehensive Plan(2020) Land Use, Economic Development, and Housing Chapters' goals and objectives for creating affordable/attainable housing through adaptive re-use of an existing commercial building through renovation. No significant environmentally damaging consequences are expected to occur due to this action. .......................................................................................................................... . ................................................._.._....._......................................................._...................................................................................._..............................._........................... ................................. .. 3 Page 4. Sanitary flow credits shall not be transferred out of the school, special assessment or tax districts unless the Town Board determines that there is no other available lot within said districts to which a sanitary flow credit may reasonably be transferred and that the transfer does not unreasonably transfer the tax burden between the taxpayers of such districts. The proposal includes transferring sanitary flow credits within the same school district. The current approval is for a mixed use building containing a 56 seat restaurant, several dry retail stores, and one Affordable Housing Apartment Unit. The approvals include the transfer of 1.6 units of sanitary flow credits. The applicant has determined that a revision of the plans to much larger residential component, consisting of twelve affordable housing units, and a reduction in the commercial uses to two dry retail spaces and a small caf6, is desirable. This revised plan can be accommodated with the sanitary system currently approved by the Health Department, and without expansion of the existing footprint of the building. In order to accommodate the additional affordable apartments, the applicant would like to acquire an additional seven (7) sanitary credits. Application will be made to the Suffolk County Department of Health Services for revised approval of the water supply, which is furnished by public water through Suffolk County Water Authority, and the sanitary system, which is being upgraded to current standards from the existing system. The property is located in the Hamlet Business zone, virtually at the center of the Mattituck Halo area. Since the project is a repurposing of a well known, large existing and outdated building, the revitalization of the building is important to the community and to the Love Lane district. There are no sensitive wetlands or vegetated environmental issues as no wetlands are nearby and the property is already fully developed. The plan is in keeping with the Love Lane area purpose and atmosphere, as well as the goals and guidelines for location of affordable housing. A summary of the septic system analysis for the proposed project is set forth in the attached letter dated June 11, 2024 from NJ Mazzaferro, PE attached to this application. In order to accommodate the additional affordable apartments, additional sanitary flow credits are needed to meet the Suffolk County Dept. of Health requirements for the sanitary system and super-offset computations. This transfer would not have a significant effect on the number of remaining Mattituck-based credits, which were banked as a result of preservation of many sensitive properties in the Mattituck Embayment Area. This project is in the center of that map, in an area that is significantly less envirom-nentally sensitive than those preserved areas. 1 Therefore, it is an appropriate candidate for such a transfer and is in conformity with the goals of the transfer program for the following reasons: a. The proposed transfer will not significantly increase development, as the building already exists, and housed a large number of employees for many years. While the uses proposed will generate a need for additional sanitary flow, that use is desirable for and compatible with the community nature of the Love Lane district. b. The district contains adequate parks, public facilities, and fire protection. Water supply and waste disposal will be thoroughly addressed by the Health Department. c. The redevelopment is compatible with good environmental planning by allowing re-use of an antiquated building, rather than new construction on raw land. d. The plan is compatible with the goals of the draft comprehensive plan and the Mattituck stakeholder goals, is in the epicenter of the Mattituck Hamlet Center, and is otherwise permitted by applicable zoning. The project is an Eligible Project under Town Code Section 117-3 because it is located in a receiving distribution which permits the proposed uses. Accordingly the applicant respectfully requests a transfer of seven (7) sanitary credits for use in connection with this project. 2 Sanitary Flow Credit Transfer Application Form Applicant Transactional Disclosure Form The Town of Southold's Code of Ethics prohibits conflicts of interest on the part of town officers and employees. The proposed Septic System was approved by SCDOH on 4/4/22 (Reference Number C-21-0045). The approved system supports a full service restaurant, dry retail and a one bedroom apartment. The proposed design was analyzed for the Septic System Daily Load. The design density and kitchen/gray load were considered. (See Attached Chart) The proposed revision (by nastasi architects dated 6-4-24) will result in the following design sewage flow rate for full build out without restrictions: Total Hydraulic Load = 1,821.20 GPD Total Gray Load = 143.30 GPD Total Density Load = 1,677.90 GPD If the basement storage areas are restricted by deed the design flow may be reduced. Assuming a 100% reduction: Total Hydraulic Load = 1,725.40 GPD Total Gray Load = 143.30 GPD Total Density Load = 1,5 82.10 GPD The proposed revision will require the SCDOH approved volume level (Density Flow Rate) for septic processing to be increased. The approved infrastructure design already includes all the elements necessary for the uses, the size of the elements will not need to be altered to handle the updated Design Flow Rates. The summary details septic requirements for the revised uses. Flow Analysis— SCDOH Standards: (See Attached Chart) Original Approved Site Sanitary Flow with Transfer Credits—Density 950 GPD SCDOH - Original Project Approval — 8/4/21 - Total Design Flow= 1910 GDP Includes - Density = 940 GPD, Kitchen/Gray = 970 GPD, The proposed revision (by nastasi architects dated 6-4-24) will result in the following design sewage flow rate for full build out without restrictions: Total Hydraulic Load = 1,821 GPD (Total Gray Load = 143 GPD and Total Density Load = 1,667 GPD) If the basement storage areas are restricted by deed the density flow may be reduced. Assuming a 100% reduction: Total Hydraulic Load = 1,725 GPD (Total Gray Load = 143 GPD and Total Density Load = 1,582 GPD) It is noted that: I - This is a basic analysis and the proposed uses do not have an approved final design. 2 —The proposed concept requires increasing the current SCDOH approved Density Flow Rate. (Using 950 GPD - exceeds by 67%) 3 —The SCDOH approved design for the new system contains all the infrastructure elements necessary to meet the proposed uses. 4—From an engineering standpoint; the approved septic system can be slightly modified to properly size the greatly reduced Kitchen/Gray Load. The same elements will be used including the precast concrete septic tank and leaching field. The size of the grease trap can be reduced. The locations for the system installation previously shown on the approved site plan continue to be used. From the technical perspective, the current approved system design has a processing capacity of 3,825 gpd. If the additional density flow of 632 gallons per day was granted, the build out would include— 12 apartments (8 under 450sf, 4 under 600st) 2 dry retail uses at approximately 1975 sf, and 1 wet retail use at 1195 sf. The septic system for this build-out would be based upon the existing approved system design and location. The revised system would still use a 12' diameter precast concrete septic tank and gallery leaching field with a properly sized grease trap. Nicholas J. Mazzaferro, P.E.
