Re: Planning Board Comments on"A Local Law in Relation to Accessory Building
Exemptions"
The Planning Board supports the amendments proposed in relation to Accessory Building
Exemptions with the following recommendation:
Consider the amendment with a time frame requirement. The reason is to prevent creating a
loophole that could be achieved by building the accessory structure with the intent to expand the
principal structure in the future,thereby causing it to be in the side yard.
Consider a time frame in which the principal structure must exist to avoid the loophole. Or
consider a date in the code that recognizes the principal structure and establishes applicability "as
of the date of enactment of this law."

The Southold Town Board at their regular meeting held on July 16, 2024 adopted the resolution
referenced above. A Certified copy is enclosed.
Please prepare an official report defining the Planning Department's recommendations with
regard to the proposed Local Laws and forward it to me at a suitable time in order to allow
sufficient time for the Town Board to review it before the public hearing. The date and time for

THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2024-649 WAS
ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON
JULY 16, 2024:
RESOLVED that the Town Board of the Town of Southold hereby amends resolution #2024-
586, adopted at the July 2, 2024 regular Town Board meeting to read as follows:
WHEREAS there has been presented to the Town Board of the Town of Southold, Suffolk
County,New York on the 2nd day of July 2024, a Local Law entitled "A Local Law in Relation
to Accessory Buildings and Structures", now, therefore, be it
RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the
aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold New York on the
431-h 27"1 day of August, 2024 at 440 7:00 p.m., at which time all interested persons will be
given an opportunity to be heard and be it further
RESOLVED that the Town Board of the Town of Southold requests that the Planning Board
prepare a report and recommendations on the proposed zoning, including SEQRA and LWRP
report and recommendations; and be it further
RESOLVED that the Town Board of the Town of Southold requests that the Suffolk County
Planning Commission prepare a report and recommendations on the proposed zoning;
This proposed "Local Law in Relation to Accessory Buildings and Structures", which reads as
follows:
Local Law No. 2024
I. Purpose - The purpose of this local law is to allow for accessory structure exemption.
II. Chapter 280 of the Code of the Town of Southold is hereby amended to include the
underlined words and remove the struck through words as follows:
§280-15 Accessory Buildings and Structures
In the Agricultural-Conservation District and Low-Density Residential R-80, R-120, R-200 and
R-400 Districts, accessory buildings and structures or other accessory uses shall be located in the
required rear yard, subject to the following requirements:
G. Accessory structures that have a Certificate of Occu ancv ore uivalent located in a
rear yard or in a waterfront front vard which are renderedartially or com letely in a

side yard, due to additions or alterations to a single-family dwelling shall be exempt from
this requirement.
II1. SEVERABILITY
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.
