The inspection covered the interior plumbing roughing for the Drainage Waste and Vent System (DWV) and the Water Supply System (WS). The inspection results are: 1 — DWV—System was fully exposed and readily viewed. I observed all drainage and vent lines. System constructed as required. New installation is connected to the existing system. The insulation provided was done in compliance with the applicable sections of the IRC, NYS and Southold Town Building Codes. In particular Section R402.1 of the 2018 IECC. 2—Ceiling/Roof—Insulation provided and installed by Robert Sal Construction Corp. Insulation provided rated as R-41 which included R-38 High Density Batt insulation for 2x12 cavities + a continuous layer of R3 Rigid Foam Insulation. The insulation provided was done in compliance with the applicable sections of the IRC, NYS and Southold Town Building Codes. In particular Section R402.1 of the 2018 IECC. 3-Ground Floor Walls/Cellar Ceiling—Insulation provided and installed by Robert Sal Construction Corp. Insulation provided rated as R-15 and R-30. The insulation provided was done in compliance with the applicable sections of the IRC, NYS and Southold Town Building Codes. In particular Section R402.1 of the 2018 IECC. ADDITIONAL INFORMATION: An area variance was granted in 1974, #1923, to construct an attached garage with an insufficient-side yard setback. The applicant explained that because of lack of access to the rear portion of the property, the garage was detached from the single-family dwelling. Also, in order to meet conforming lot coverage,the metal shed has been removed from the property resulting in an existing lot coverage of 19.83%.where the code permits a maximum of 20%. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 1,2023 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances for the single side yard setback and combined side yard setback and granting alternative relief for the non-conforming street setback will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a single family neighborhood that consists of single family homes on 50 foot wide lots. The proposed non-conforming single side yard setback and combined side yard setback is for a deck. The proposed non-conforming street setback for the steps is not characteristic of the neighborhood. Granting alternative relief for a 5 feet street setback is more characteristic of the neighborhood than the proposed.8 foot street setback. 2. Town Law 5267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue,other than an area variance. The lot is a pre-existing non-conforming lot that was created prior to zoning. The placement of the existing home on the lot makes it difficult to meet the required setbacks. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial,representing 50%relief from the code for the single side yard setback and 21%relief from the code for the combined side yard setback. The alternative relief granted for the street setback for the steps is mathematically substantial representing 66% relief from the code. However,the existing house was built prior to zoning making it difficult to build a code conforming deck and entranceway. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 5267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in erect and it is presumed that the applicant had actual.or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law 4267-b.
