Cremers, Member Martin H. Sidor, Member Mark Terry, Senior Environmental Planner Bruno Semon, Senior Site Plan Reviewer Carol Kalin, Secretary Chairman Orlowski: Good afternoon. I'd like to call this Special Meeting to order. MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES, SET-OFF APPLICATIONS - STATE ENVIRONMENTAL QUALITY REVIEW ACT Lead Agency Coordination: Chairman Odowski: Zoumas at Bayview - This proposed major subdivision is for 6 lots on 47.71 acres of which 36.32 acres (Lot 6) have been sold fee title to the Town of Southold. The property is located north of Bayview Road, _+200' west of Brigantine Drive in Southold. SCTM#1000-79-4-17.17 Mr. Ca,q,qiano: Mr. Chairman, '11 offer the following: WHEREAS, this proposal is to subdivide a 47.71 acre parcel into 5 residential lots where Lot 1 equals 91,226 sq. ft.; Lot 2, 86,235 sq ft.; Lot 3, 82,606 sq. ft.; Lot 4, Southold Town Plann nR Board PaRe Two Auqust18,2003 82,635 sq. ft. and Lot 5, 83,210 sq, ft. and two parcels: Parcel A (36.59 acres) and Parcel B (1.11 acres) which are proposed for preservation; and WHEREAS, on August 12, 2003, the Town of Southold Town Board approved the Fee Title AcquisitiOn of (34.1+ acres); of Parcel A (36.59 acres) exblusive of an 8,359 SCl. ft. Drainage Easement serving the subdivision of Harbor Lights Estates, Section 4, and a 10,000 sq. ft. right,of-way serving the Albert & Rosemary Bertos and the Gay Reese pai'Cels; and WHEREAS, it is the understanding of the Planning Board that the applicant has agreed to file a ConServation Easement upon Lots I through 5 that limits clearing to 1 acre~ upon each lot; and WHEREAS, this action also involves the creation of a clustered 21,500 sq. ft. parcel labeled as Gay Reese on the plat dated March 26, 2003; and WHEREAS, prior to clustering to 21,500 sq. ft., a total of 1.1 acres (Parcel B) of SCTM# 1000~79-4-17.17 and the 10,000 sq. ft. right-of-access contributes to and comprisets the required minimum pre-clustered acreage of the Gay Reese parcel; therefore be it RESOLVED, that the Southold Town Planning Board start the SEQR lead agency coordination process for this Unlisted Action Mr. Cremers: Secono the motion Chairman Orlowski: Motion made and seconded. SITE PLANS Final Determinations: Chairman Orlowski: Gulf Service Station - This site plan is for a 135 sq. ft. addition to an existing service station. The property is located on the Main Road in Southold. SCTM#1000-70-7-4 Mr. Cremers: Mr. Chairman, I'll offer the following: WHEREAS, on February 12, 2001, the Southold Town Planning Board granted conditional final approval; and SOuthold Town Planninq Board Page Three Auqu~ 18,2003 WHEREAS, on July 17, 2001, the Southold Town Planning Board authorized the Chairmal~ to etidorse the final surveys, last revised April 4, 2001; and WHEREAS, the site was inspected and the variations from the site plan are as follows: I. The landscape material changed from grass to evergreen groundcover with annual and perennial plantings. 2. Identificati~)n of parking space numbers 5 & 6 to be located on the Main Road ~ide for employee parking. WHEREAS, on August 13, 2003, the Planning Board received a letter from the architect, Garr;e[t Strang, in which he concurred with the Planning Board's findings; be it therefore RESOLVED that the Southold Town F~lanning Board accepts these variations from the final approved site plan. Chairman Odowski: Opposed? The motion carries. Being nothing left on my agenda, if there is anyone who would like to comment, they may. John Abele: My name is John Abele. I live at 255 Windjammer Drive in Southold, in the Harbor Lights Section. I really - as far as the proposal of Zoumas at Bayview- I am certainly not opposed to it. It is probably the best deal we can work out. I do have a feeling, however, that th s train is running on a very fast track. It was only last week that the Town Board decided to buy this property and the other part of the property. And ~ would question -were owners of adjacent properties notified that all of this is going o~q? Chairman Orlowski: As far as the purchase of - John Abele: The purchase and the proposed development site? Chairman Orlowski: Well, anybody can - if you are going to sell your land, you don't - everybody does not tell you - John Abele: Yes, I know but if you - here you are approving a development that is going to have significant impact on the area and if somebody applies for a zoning change o~r a variance, you have to notify the people in the area and here - Southold Town Planning [3oard Pa.qe Four August18,2003 Chairman Odowski: We have not done that yet. John Abele: The first time these people are going to see something is when the bulldozer shows up next door? Chairman Orlowski: But it is not going to happen until we go through the public heating process. John Abele; You have not gone through a public hearing process yet?. Chairman O rlowski: No, this is just a SEQRA and what we did on SEQRA is to get the process started. The public hearing will be down the road and - John Abele: How far down the road? Chairman Orlowski: I don't know. The attorney could probably tell us where she is right now but - Patricia Moore, ESq.: Let me just clarify for this gentleman. We are talking about t~ o separate actions - you have the Town Board that, through the Land Preservation, I~as negotiated after significant discussions and time frame so, it is not overnight. They agreed on a price; they went to contract and what the Town Board did is, through ublic headng process - the Town Board public hearing process which does not require specific notice to all the adjacent property owners - it was a public hearing authori; ng the Supervisor to execute the contract and put his name on the contract that Zourr as will, in fact - or the Town will, in fact, purchase the Development Rights of this piec .~. Second step is before this Board, which is the subdivision process, and that process we a.re starting with the SEQRA - the procedures to do the environmental review. We,re discussing the preliminary design of the map. Once we submi! a preliminary plan aJnd the Board approves'that preliminary plan, we can go - we don t have to go throughI sketch, we can go sketch, preliminary. The Health Department will approve it and t[hen you Wil get.the final procesS. So, every step of the Planning .B, oard process, excepI obviously this one - the SEQRA process - requires neighbors notice. So, when th9 map is approved in a certain final form, you will ha~/e a public hearing and everyone willlhave a chance to see it o~' discuss it. But this is a very limited development and if you h~ve questions along the way, just call me directly. I don't mind answering any questions~ in the hopes that information will hopefully lead to more euibk process. John Abele: I do have one question. Does this property go all the way over to the intersection of Jacobs Lane? Patdcia Moore, Esq.: Yes, this property abuts both North Bayview, Jacobs Lane and Bayview - North Bayview Road. Yes. What I will do is, I will show him the design of the proposed map right now. There will be some tweaking of the map but, hopefully, it will be close to being in its final form. O.K.? And for the record, we have withdrawn ou~' previous major subdivision application. Southold Town Planning Board Page Five August18,2003 John Abele; I 'would make just one other observation that there are an awful lot of big itrees of~ this property and I hope we can do as much to preservethose as possible becaus~ tf~ey really determine the character of the area.
