The existing setback is noted)as+/-4 feet: ` FINDINGS OF FACT The Zoning Board of Appeals held a public hearing- on this application on January 16, 2003, at which time,wdtten and oraC evidence were presented: Based upon all testimony, documentation, personal inspection of the property, and other'evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants request a Variance under Sections 100-242A and 100=244, based on the concerning proposed additions/alterations to the existing dwelling; portions'of which will be less than 15 feet from the side property line, and less than 35 ft. total side, yards, on this 25,003 sq. ft. nonconforming sized parcel. The applicants' survey revised 1/13/03, prepared by John C. Ehlers, L.S. shows new foundation dimensions of 22' x 29,.8' proposed at the south end (garage area), and new deck, replacing the existing steps, stoop and patio,and a new'Bilco door proposed at 5.5 ft. from the southerly side yard. The new setback for the foundation is confirmed by the surveyor to'be 4:6 ft. (or -i P,47" plus 1 or 2 inches larger with siding). The setback of the new deck is 10.8`from the southerly side yard, exclusive of the Bilco door. j PROPERTY FACTS/DESCRIPTION: Applicants' property is located on the east side of Haywaters Road, Cutchogue. The property is also referred to as Lot#376 on the Map of Section D, Nassau Point Club Properties, Inc., consisting of 25,000 sq. ft. in area. Grant of the variance will not produce an undesirable change,in the character�of the neighborhood or a detriment to nearby properties, The proposed new addition of 22'ft, by 29.8 ft. will mirror the existing footprint and will not increase the existing setback of 4.5 ft so there will be no undesirable change in the neighborhood 2. The benefit sought by the,applicant cannot be achieved by some other method feasible to pursue than a variance. The applicant wishes to,expand daue tc growirtg fatrtil need on a small.lot. Number 1000-111-7-3, it has come to our attention that we are unable to process your permit application without the following information: 1.) An amendment to the size of the deck, due to in sufficient side yard setbacks or relief from the Southold Town Zoning Board of Appeals. At this time, we are returning the application as incomplete. We are sorry for any inconvenience;but when the plans were submitted you noted that, if need be, you would!, reduce the size of the deck. Therefore, you must submit amended plans as well as an amended survey. You are required to have at least a 15-foot setback on the south side of the parcel. As we, suspected the Bilco door you have proposed is exempt from our zoning requirements. However,the deck is setback just 10 feet from the south property line. Therefore,both the deck and the Bilco should be moved back at least five feet. Of course, the other option is to seek reliefe from the Southold Town Zoning Board of p g Appeals.
