Page 2 - Minutes Regular Meeting held March 20, 2003 Southold Town Zoning Board of Appeals PUBLIC HEARINGS: The following public hearings were held, with Chairwoman Tortora introducing each application, and Member reading of the Legal Notice as published: 9:46 a.m. Rory Forrestal #5243 - Applicant requests a Variance under Section 100-244B, based on the Building Department's October 2, 2002 Notice of Disapproval, amended December 9, 2002. Applicant proposes a second-story addition and porch to the existing dwelling at less than the code's 35 ft. setback requirement for total side yards, and less than 15 fl. setback on one side, at 1065 Saltaire Way, Mattituck; County Parcel 1000-100- 1-23. This Resolution was duly adopted (5-0). 9:51 a.m. SanR Lee Farms #5324 - This is a request for a Special Exception, based on the Building Department's August 19, 2002 Notice of Disapproval which states that under Town Code Chapter 47.3A, a farm stand in excess of 1,000 sq. ft. is permitted only with site plan approval from the Planning Board and with special exception approval from the ZoninR Board of Appeals. Applicant is proposing to construct a farm building (or structure) which will be enclosed on all sides and used as a sales area, open to the public, in addition to the existing farm stand sales area. This is an application based on the Building Department's August 20, 2002 Notice of Disapproval, amended January 22, 2003, in a proposal to demolish the existing dwelling and construct a new dwelling: (1) at less than 75 feet from the rear lot line and bulkhead. Also requested is a new swimming pool structure at less than 75 feet from the bulkhead, and Variances under Section 100-235A(1 ) Page 3 - Minutes Regular Meeting held March 20, 2003 Southold Town Zoning Board of Appeals and Town Law Section 280-A, for a determination regarding improvements over an existing private right-of-way for sufficient access by fire and emergency vehicles. The right-of-way extends over privately owned lands now or formerly of Kaytis, and land of McDonald, from a point starting along the east side of Paradise Point Road, Southold, to the applicant's lot, referred lo as 780 Private Road 17, Southold, Parcel #81-3-27.1. No. 5324 - SANG LEE FARMS Property Location: 25180 County Road 48, Peconic CTM Parcel: 84-5-1.3 and 1.2 (combined) SEQRA DETERMINATION.~ The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Unlisted Action category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's land is an agricultural farm consisting of 15.3+ acres located on the south side of C.R. 48 (a/ida North Road or Middle Road) in Peconic. Existing on the property are a dwelling and greenhouses as shown on the site plan map prepared by Samuels & Steelman Architects dated 8/5/02. Of the entire 15.3 acres, 14.361 acres has development rights sold. BASIS OF APPLICATION: Building Department's July 29, 2002 Notice of Disapproval, amended August 19, 2002, citing Chapter 47 (Farm Stands) Section 47.3A, for the reason that "...farm stands in excess of 1~000 sq. ft. in floor area are permitted only with site plan approval from the Planning Board and with special exception approval from the Zoning Board of Appeals." FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 20, 2003, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board makes the following findings: 1) The applicant seeks approval for the construction of an agricultural retail farm stand, which is a permitted use 'n the A/C zone in which this parcel is located. Proposed inside of the existing farm building is installation of a heating/cooling system in the structure, for the expressed purpose of providing for the ability to operate on a year-round basis, within a comfortable environment, for the benefit of his customers and employees. It is the determination of this board that the operation of a farm stand on a year round basis rather than just seasonally, will not in any way alter the character of the neighborhood or district. 2) A vanance was obtained under Appl. No. 5204, granting relief from the code requirement that limits the size of a farm stand to 1000 sq. feet. presenting to the board a proposal for a singte-story building containing approximately 1300 square feet. 3) In addition, the rBoard has reviewed the General Standards governing Special Exception uses set forth in Section 100-263 and finds: Page ~-- March 20, 2003 ~Ap~I. BOARD RESOLUTION: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion waS offered by Chairwoman Tortora, seconded by Member Oliva, and duly carried to GRANT a Special Exception authorizing enclosure a farm building with a floor area of 1300 sq. ft. as applied for, sUbject to the following CONDITIONS: 1. The accessory farm stand, permitted by the granting of these variances, shall only be used for the purposes delineated in the submitted application, and only those uses as allowed by Town Code. 2- There will be no habitable space within this structure. The applicant must provide adequate on-premises parking. 4. The applicant wilt secure the necessary site plan approval for the project. 5.
