PROPERTY FACTS/DESCRIPTION: Applicant's property consists of 26;503 sq. ft. in area with
100 ft frontage along the north side of North Sea Drive, Southold, The property is 269.36 ft. deep
' and extends to the mean high water,fine of the Long Island Sound as shown on the December16,
1998 survey prepared by John T. Metzger, L.S.
BASIS OF APPEAL: Article III, Section 100-33C, as noted in the Building Inspector's Notice of
Disapproval dated January 3, 2001, denying an application dated October 27, 2000 for a permit to
build an accessory storage building (one-car garage) with a setback at less than the code
requirement of 40 feet from the front property line.
RELIEF REQUESTED: ApplicaPeAt

requested for the accessory bui

€ REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented,
materials submitted and personal inspection, the Board makes the following findings:
1. Grant of the area variance will not produce an undesirable change in the character of the
jl neighborhood or be a detriment to nearby properties. Location of the proposed accessory garage
is severely limited because the property is within an environmentally sensitive area, constrained by
FEMA regulations an the waterfront, northwest part of the property, and within the Coastal Erosion
Hazard area on the most southeast part of the property. Grant of a variance will permit the garage
to be outside of the Coastal Erosion Hazard line and in compliance with FEMA regulations.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance because construction within the Coastal Erosion
Hazard Area is prohibited, and without the variance, the owner would not be able to build the
garage.
3. The area variance is not substantial and relates to the environmental limitations of the property
and subsequent regulations restricting placement of structures on the property.
4. The proposed variance will not have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district because the variance will permit the

accessory garage to be located.within an, area that is in compliance with Federal and. State
regulations designed by protect the environment.
5. The action set forth below is the minimum necessary and at the same time,preserves,and
prbtects the character of the neighborhood and the health,'safety and welfareof the community.

f In reply to your October 29, 2001 letter, this will confirm that our Department has
confirmed with the Building Department that it has no objection to the proposed garage
location with a 33 ft. setback instead of the original request for a 34 ft. setback. The January
23, 2001 map showing the 33 ft. setback was considered and approved by the Board at the
time of decision-making.
A separate variance application is not necessary under the above circumstances.
