SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if I the project is implemented as planned. PROPERTY,FACTS/DESCRIPTION: The applicants' 87,466 sq. ft. parcel has 272.93;ft. frontage along a private right-of-way off Westphalia Road in Mattituck. The property is improved with a single-family, two-story frame dwelling with accessory garage in the rear yard and as-built accessory shed. BASIS OF APPLICATION: Building Department's March 25, 2003 Notice of Disapproval, citing Section 100-33, in its denial of a building permit application for an `".as built" location of an accessory building in area other than required rear yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on September 25, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants request approval of the side yard location of their as-built, 12' x 16' shed at +10 115 ft from the westerly front property line, 11.2 feet from the northerly side line, and 20.9 feet from the easterly lot line, at its closest points, as shown on the April 21, 2000 survey, revised 7-2-02, by Kenneth M. Woychuk, L.S. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Applicant indicated that he was given the present shed as a gift from a friend, unaware that after placing the shed in its present location that he had a yard violation of the zoning code. At the hearing, the applicant was asked if he could move the shed to a conforming location, and he replied he could, but the rear yard was totally landscaped, and it would disrupt much of the rear Page 2—October 9,2003 ZB#5379—K. and D.Woychuk 113.-12-6 at Mattituck yard landscaped if it were to be moved. After inspection and testimony from the applicant, it was decided that if the applicant installed a landscape buffer on both the neighbors side to the north and the side facing the right-of-way, the approval of the as- built location of the shed would not impact either the immediate neighborhood or district: 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The shed was built in its present location, and the landscaping completed, and there are other sheds and garages in similar yard locations in the immediate neighborhood. 3. The variance granted herein is substantial because the code requires accessory buildings,to be located in a rear yard, rather than a side yard, as built. 5. The difficulty was self-created when the shed was planned in its present location without conformity to the current Town Code requirements. 6. There is no evidence;that the grant of the relief requested will have an adverse effect or impact on physical or environmental conditions in the neighborhood or district: The applicants' property is on a private right-of-way which services only a few parcels. The landowner closest to the shed is to the north„ who did not voice an objection or concerns at the hearing or in the record. The buffer of evergreen screening will lessen any possible impact of this 10`x 12'shed at 11.2 feet from the closest side lot line. . 7. Grant of the relief requested is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a shed, 'while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Member Goehringer, and duly carried, to GRANT the variance as applied for, as shown on the survey prepared by Kenneth M. Woychuk, L.S. revised 7-2-02, subject to the condition that the north and west sides of the shed be landscaped with evergreens. CHAIRWOMAN TORTORA: Yes, George . 20 BOARD MEMBER HORNING: Briefly tell us how it got to be placed where it is . 21 MR. WOYCHUK: When we purchased the lot, somebody had given me the shed, and 22 at the time I didn' t realize that you couldn' t have anything on the side yard. All it was 23 small cherry trees and things there, and we were able to drive the truck into the area, 24 and I just off-loaded the shed there . I knew it had to be a distance from the property 25 line, but I didn' t realize at the time there was no side yard thing. The property, if you see it, it' s a wide piece, and there' s a little extra piece 4 that jogs in. I envisioned putting my garden there at one time, and we were going to use 5 the shed for the garden in the back. And that' s the original construction. 6 BOARD MEMBER HORNING: Can you put the shed in the back with the garden? 7 MR. WOYCHUK: I can, but I' d have to clear out some more trees in the back to do 8 that .
