SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's consists of a total area of 40,153 sq. ft, shown on the filed map of Long Pond Estates, Section Two as Lot No. 36. The property has 150.04 ft. frontage along the south side of Pond Avenue and an average depth of 268+- feet. The lot is improved with a 1584+- sq. ft. one-story single-family dwelling with attached two-car garage and deck, as shown on the April 16, 1991 survey prepared by Young &Young, L.S., also referred to in C.O. Z-19859 dated April 18, 1991 and C.O. Z-20427 dated December 23, 1991. BASIS OF APPLICATION: Building Department's May 15, 2003 Notice of Disapproval, citing Section 100-32, in its denial of a building permit to construct an addition to the existing single-family dwelling on a nonconforming sq:ft lot in the R-80 Residential Zone District, for the reason that by design, for a proposed eat-in kitchen, living room, bathroom and two bedrooms with the second-story addition, will create a two-family dwelling. ADDITIONAL INFORMATION: Also referred to in the Notice of Disapproval is THE Building Department's reference to Code Section 100-31 B which states that a two-family dwellingis a permitted use by special exception with a minimum requirement of 80,000 sq. ft per dwelling unit. For the reasons noted below, the Variances were addressed in this ,aapprovai Therefore, there it will not be necessary to render a determination regarding the applicants' secondary application for a Special Exception. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 21, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants wish to construct a second-story addition containing, 977+- sq. ft. The new addition will include a separate entrance, an., Page 2-September 11, 2007' Appl. No. 5409—P. and B. Calderone 56-1-2.30 at Southold eat-in kitchen, living room, bathroom, and two bedrooms, over the existing first floor living area. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials sub4mitted and personal inspections,the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The purpose of the addition is to provide dose living arrangements in the home for the applicant/owner's daughter, a nurse, who will provide care for her father/applicant/owner. The use of the existing dwelling will continue to remain as a single-family and is not proposed for a second apartment or as a two-family dwelling or rented as a separate unit. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance: The addition will be over the existing first floor of the dwelling which is 51 feet from the front line along Pond Avenue, 32.9 ft; on each side yard,65.8 total side yards, and a very large rear yard. 3. Therelief granted herein is not substantial because the use of the dwelling will remain as a single-family dwelling. 4. The difficulty was not self-created. 5. There is no evidence that the grant of the relief requested will have an adverse effect or impact on physical or environmental conditions in the neighborhood or district. 6. Grant of the relief requested is the minimum action necessary and adequate to enable the applicant to benefit from expanded living area for occupancy by the daughter, to care for her father in their family home. The relief granted will preserve and protect the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairwoman Tortora, seconded by Member Oliva, and duly carried,to GRANT the variances, as applied for, and subject to the following CONDITIONS: 1. Mrs. Calderone said her architect, with a Selden address, told her to file the Special Exception application. After going over the requirements of the Town Code (Cos shall be issued-prior to Jan. 1984), she explained she did not want a rental apartment, but a small second kitchen for her daughter, and that the house would remain one-family. We explained a similar procedure that was taken by Frank Murphy for a second kitchen, and walked her over to the Building Department. We explained that if she received a Notice of Disapproval, she could use the set of appeal forms made available to her. And that if she was not disapproved in the next step applied for by the Building Depaitrrrent, that their office would also explain what was needed as the next step.
