Nicholas Krupski,Vice President ,��� CIO 5 Route 25 P.O..Box 1179 Eric Sepenoski l Southold,New York 11971 Liz Gillooly epa Elizabeth Peeples � � Q Telephone(631) 765-1892 Fax(631) 765-6641 OOUNTY,� BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD August 29, 2024 Kate Rummel Cole Environmental Services, Inc. 425 Montauk Highway East Quogue, NY 11942 RE: CHRISTOPHER ROSS TRUST-2015 & MICHELLE ROSS TRUST-2015 3340 PARK AVENUE, MATTITUCK SCTM# 1000-123-8-11 Dear Ms. Rummel: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, July 17, 2024 regarding the above matter: WHEREAS, Cole Environmental Services on behalf of CHRISTOPHER ROSS TRUST- 2015 & MICHELLE ROSS TRUST-2015 applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated May 21, 2024, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the'imposition of the following Best Management Practice requirements: issuing a Wetland Permit; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on July 17, 2024, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the project complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVE the application of CHRISTOPHER ROSS TRUST-2015 & MICHELLE ROSS TRUST-2015 for the existing dwelling and to construct a 2"d story addition; raise the first floor elevation to 13'; proposed addition to existing basement with new concrete landing for egress door with excavated fill to be used for new I/A system; remove bilco door; existing front stairs to be removed and reconstructed with an irregular shaped deck; new stepping stone path; install gutters to leaders to drywells to contain roof runoff; raise existing rear deck to match new elevation; rear deck at grade to be removed and area to be planted with native vegetation; replace outdoor shower; rear walk to be removed; abandon existing septic and install a new I/A sanitary system in front yard with new 4' high concrete retaining walls along the side yard property lines with native vegetation planted to screen the retaining walls within property lines where possible; remove existing vinyl sheds; replace existing waterline; replace existing A/C condenser to be on pedestals; new above ground propane tank; and a 4' wide permeable access path to beach to remain; and add native vegetation; with the condition that, if during construction it becomes deemed a demolition (by Town Code definition) at any point, this permit will no longer be valid and a new permit and review would be required; retaining walls not to exceed 2' in height; and as depicted on the site plan prepared by Samuels & Steelman, received on August 16, 2024, and stamped approved on August 29, 2024. Permit to construct and complete project will expire three years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of$50.00 per inspection. PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 9,761 square foot parcel (4,698 square foot buildable land)located in the Residential R-40 Zoning District.The subject property is strangely shaped. The northeasterly property is 17 feet and is adjacent to Bungalow Lane (Bungalow Road) off of Park Avenue, the property then runs Southeasterly at 62.27 feet continuing Southeasterly at 56.56 feet,then continues Southwesterly at 49.25 feet continues Southeasterly at 62.13 feet, Southerly at 51.72 feet which is adjacent to Great Peconic Bay, Westerly the property line measures 179.40 feet continuing to the northeasterly property measuring 33.33 feet. The parcel is improved a one-story frame dwelling with an attached wood deck at the rear of the dwelling with two sheds located in the front(northerly location)as shown on the survey map prepared by Paul Barylski, LS and dated May 31,2023. BASIS OF APPLICATION: Request for Variances from Article XXIII,Sections 280-124;Article XXXVI,Section 280-208A;and the Building Inspector's December 5,2023 Notice of Disapproval based on an application for a permit to construct addition and alterations to an existing single-family dwelling; at 1) located less than the code required minimum side yard setback of 10 feet; 2)located less than the code required minimum combined side yard setback of 25 feet;3)more than the code permitted maximum lot coverage of 20%;4)the construction exceeds the permitted sky plane as defined in Article I, Section 2804 of the Town Code; located at 3340 Park Avenue (Adj. to Great Peconic Bay),Mattituck,NY. SCTM#1000.123-8-21. RELIEF REQUESTED: The applicant requests variances to construct additions and alterations to an existing single- family dwelling. The proposed construction, on this nonconforming 9,761 square foot lot (4,698 square foot buildable land) located in the Residential R40 Zoning District, is not permitted pursuant to Article XXIII, Section 280-124, which states lots measuring less than 20,000 square feet in total size require a minimum side yard of 10 feet,a combined side yard setback of 25 feet and maximum lot coverage of 20%. The proposed minimum side yard setback is 5 inches,the combined side yard setback is 1 foot 7 inches apd the proposed lot coverage is 46.5%. ADDITIONAL INFORMATION: The applicant's representative provided the Board with a list of prior ZBA decisions granting relief for variances in the community without indicating specific relief granted. Please see list below: Application#4524, 11/13/1997 Application#5231, 1/23/2003 Application#5403, 1/10/2000 Application#7589,2/17/2022 Application#7829, 10/19/2023 On January 18, 2024, the Southold Town Board of Trustees made a pre-submission inspection of the property and they relocated the Landward edge of the tidal wetlands which extends more landward than has previously been located by the surveyor. Due to this change the revised wetlands reduces the"buildable area"of the lot by almost one half of the parcel and results in a significant increase in lot coverage. The applicant will be required to apply to the Southold Town Board of Trustees for a Wetlands Permit. The existing structures on the subject lot were legally constructed and have Certificates of Occupancy issued by the Town of Southold. The applicant testified that two sheds in the front yard of the subject property are being removed and that adjacent dwellings are owned and occupied by family members. 1i Page 3,May 16,2024 #7896,Christopher Ross Trust SCTM No. 1000-123-8-21 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 2,2024 at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed new second floor over the existing structure will not change the character of the neighborhood or pose a detriment to the community. Two-story dwellings are common in the neighborhood and along the waterfront properties adjacent to the subject property. The one-story portion of the existing house is not changing, other than being raised two feet,and has a Certificate of Occupancy. The existing one-story dwelling in this location is pre-existing and nonconforming. 2. Town Law&2674(31(b)(2). The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue, other than an area variance. Any construction on the subject property is burdened with severe restrictions due to wetlands along Great Peconic Bay which limit the buildable area of the lot and create the preexisting non-conforming lot coverage;the very odd shape of the subject lot,and the pre-existing non-conforming setbacks of the subject dwelling. In addition,the existing one story as built dwelling already exceeds the sky plane setback which was built many years before this sky plane regulation was added to the Town Code. 3. Town Law§267-b(3)(b)(3). The variances granted herein are mathematically substantial,representing 96%relief from the code for the side yard, 93.6%relief for the combined side yard setback, and representing 133%relief for the lot coverage. However, the proposed addition on the east side of the residence will be 8 feet from the property line. The non-conforming footprint of the existing dwelling and decks will remain the same,as the proposed addition is for a second story over the existing dwelling. Due to the reduction in the"buildable area"of the parcel,the existing lot coverage is 47.1%. but the proposed lot coverage is 46.5%which is a reduction of 33 square feet. Also,the Site ' Plan drawings show that the existing dwelling is already within the sky plane and the elevation of the first floor also locates the second story addition within the sky plane and no further plans are in place to exceed what already exists. 4. Town Law 5267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code.The elevation of the subject dwelling by two feet,although not required by FEMA,will reduce flooding,and the installation of an IA waste water treatment system will improve environmental conditions by reducing nitrogen contamination. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of alterations and additions to the existing dwelling while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
