(631) 765-1809xnou-ux �/9 Southold Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF JUNE 20, 2024 ZBA FILE: 7912 NAME OF APPLICANT: Andrea Spinaris PROPERTY LOCATION: 3175 Kennys Road, Southold SCTM No. 1000-59-6-26 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated February 20, 2024 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated May 16, 2024. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. Policy 4. Minimize the loss of life, structures, and natural resources from flooding and erosion. The proposed 22.2 percent lot coverage on the parcel is contrary to preventing loss of structure in and near flood hazards. The entire parcel is located in the FEMA AE EL 9 Floodway Zone Special Flood Hazard Area. The structure within these areas is subject to repetitive loss from storm surge-induced events and should be avoided and/or minimized. This policy does not support expansion over the maximum permitted lot coverage of 20%. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 10,443 sq. ft. parcel located in an R-40 Zoning District. The property had a road frontage of 100.00 feet along Kennys Road,then turns southwest for 110.00 feet before angling northwest for 25.00 feet towards Great Pond, then has 97.73 ft adjacent to Great Pond before returning 75 feet east back to Kennys Road. The property is improved with an existing one-story frame Page 2,June 20,2024 #7912, Spinaris SCTM No. 1000-59-6-26 dwelling, and an "as-built" deck and hot tub currently the basis for this application. This is based on a survey by Peter V. Brabazon, LLS of Eagle Eye Land Surveying, last revised November 14, 2023. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124; and the Building Inspector's January 30,2024 Notice of Disapproval based on an application for a permit to legalize`as-built' platform decks and a hot tub attached to an existing single family dwelling; 1) less than the code required minimum rear yard setback of 35 feet; 2) more than the code permitted maximum lot coverage of 20%; located at: 3175 Kennys Road (Adj. to Great Pond), Southold,NY. SCTM No. 1000-59-6-26. RELIEF REQUESTED: The applicant requests variances to for an as-built deck and hot tub at the rear of the house with a rear yard setback of 17.08 ft where a minimum of 35 is required. There is also a lot coverage of 22.2%where a maximum of 20% is permitted by Town Code. ADDITIONAL INFORMATION: During testimony at the public hearing of June 6,2024,the owners' representative and the owner of the property gave testimony that the property is currently in litigation at the Town Justice Court regarding as builts. They gave no examples of prior variances in the area for like conditions. When it was brought up by board members who visited the site and submitted evidence of high water closer to the rear deck than noted on the drawings, both the owner and his representative gave no answer for the current field conditions, and stated that they put in a buffer as per the Town Trustees. With the current high-water conditions, during personal inspections of the property, Board members observed that this buffer is totally underwater. Multiple letters of objection were submitted by neighbors to the Board, and there was also testimony given by neighbors as to the nature of the use of the property as a short-term rental. It was also noted by staff that the property is currently listed on Apartments.com as a rental without the benefit of a Southold Rental Permit. The applicants testified that there was currently a Southold Trustees Permit is pending site inspection. On April 19,2023,the Board of Trustees issued an Administrative Permit and stamped approved a survey prepared by Peter V. Brabazon, LLS, subject to a follow-up -site inspection which has not taken place to date. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 6,2024 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Due to the fluctuation of the water levels of Great Pond, and the house is already too close to the wetlands without the attached deck, any construction would further endanger this fragile ecosystem. The"as-built"deck and hot tub currently sits just feet from the water as per a site visit on June 4, 2024. Due to the fact that this structure was constructed without the benefit of a permit, there were no remediation measures taken to mitigate the environmental impacts of this structure. Therefore;the granting of this variance will produce an undesirable change in the character of the neighborhood, and a detriment to the environment. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue,other than an area variance. Due to the location of the house on the property any addition to the rear of the house would require variance relief, as well as Southold Board of Trustees and New York State Department of Conservation(NYSDEC) relief. 3. Town Law U67-b(3)(b)(3). The variances granted herein are mathematically substantial, the rear yard setback variance represents a 52% relief from the code. The lot coverage variance represents an 11% relief from the code. However, due to the fact that these additions are"As-built", and the water levels of Great Pond have increased there _t Page 3,June 20,2024 #7912, Spinaris SCTM No. 1000-59-6-26 is no mitigation that can take place on this property other than the removal of these structures to bring the subject property more in conformance with the code. 4. Town Law§267-b(3)(b)(4). Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. There is some severe flooding on the site and into Kennys Road from Great Pond. The as built structures do not comply wit the required wetlands setback or the Board of Trustees required non turf buffer landward of the pond which is currently under water. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law 4267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an"As-built"deck with hot tub while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The structure must be removed in order to mitigate the impacts to both the character of the neighborhood, and the environmental impacts of being adjacent to Great Pond. I am cc'ing the Trustees since this issue has much to do with Wetlands. Did this new owner ever request a permit for building in the wetlands? Three years ago they built a deck. It is not grandfathered in.There was no deck before them and now they want a variance to hold onto it. They also installed pavers by the water, now probably submerged. Several of you live in our area and have seen Great Pond flooding with spring rains. Water often breached Kenneys Rd. right next to this property. Water levels have exceeded any in distant memory. Numerous complaints have been made against this house. It is listed on Airbnb as a four bedroom/two bath/8 guests.There is a continual flow of rental cars on weekends-3 to 4 at a time.
