SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The property is a non-conforming 11,459.98 square foot parcel located in an R-40 Zoning District. The parcel runs 66.01 feet along Mary's Road,runs 174.19 feet on the North side,runs 66 feet on the West side, and 173.05 feet on the South side. The property is improved with a one and one-half story frame building,wood deck,enclosed porch,outdoor shower,frame shed and play house. All is shown on a survey prepared by Jason D. Leadingham, L.L.S., dated September 14,2023. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124; Article XXXVI, Section 280-207A(l)(b)and the Building Inspector's December 14, 2023 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling; l) located less than the code required minimum side yard setback of 10 feet;2)gross floor area exceeding permitted maximum square footage for lot containing up to 20,000 square feet in area; located at: 195 Mary's Road, Mattituck,NY. SCTM No. 1000-140- 2-36.3. RELIEF REQUESTED: The applicant requests variances to make additions and alterations to a single-family residence that will result in a side yard setback of 6 feet where town code requires a 10 feet minimum side yard setback. Further, the additions and alterations will result in a Gross Floor Area of 2,680.10 square feet (exceeding allowed GFA by 397.61 sq. ft.)where town code permits a total gross floor area of 2,282.49 square feet. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 6,2024 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and :j Page 2,June 20,2024 #7906,Antonucci SCTM No. 1000-140-2-36.3 surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a single-family neighborhood with residential houses on one side of the block and the school district's track and field located across the street. Houses on smaller lots are common in this neighborhood. The proposed non-conforming side yard setback is existing and the building's extension will be less non-conforming than the existing residence. The proposed non-conforming GFA is for a modest size home and it is created by a gable roof on the rear of the home and will not be visible from the street. The requested variance relief will not have any effect on the character of the neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant for the requested side yard setback cannot be achieved by some method,feasible for the applicant to pursue, other than an area variance. The existing home has a non-conforming side yard setback therefore any addition on the South side of the home will also have a non- conforming side yard setback. The benefit sought by the applicant for the requested non-conforming GFA can be achieved by some method feasible for the applicant to pursue other than an area variance. The applicant could propose additions and alterations with a code conforming Gross Floor Area. 3. Town Law 4267-b(3)(b)(3). The variance granted herein for the non-conforming side yard setback is mathematically substantial, representing 40% relief from the code. The variance granted herein for the non- conforming Gross Floor Area(GFA)is mathematically substantial,representing 17%relief from the code. However, the GFA is for a rear yard dormer addition and the house is an older home with an existing non-conforming side yard setback, and the size of the proposed addition will result in the subject dwelling being similar in size to other homes in the neighborhood. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law V67-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations to a home while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Weisman(Chairperson), and duly carried, to GRANT the variances as applied for, and shown on the Site Plans and Architectural Plans prepared by Hideaki Ariizumi, Architect, labeled PRO and PR02 dated November 13,2023. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The outdoor shed shall be moved to a code conforming location or demolished prior to receiving a Certificate of Occupancy for the dwelling addition. 2. The surrounding neighborhood is characterized by one-and two-story homes on sFAA154A. The proposed addition will be to the rear.of the existing home and will result in a home that is similar in size and in character to other homes in the community. The prop o��l�Ai9p l p{ IBEALS the existing side setback, building form,and materials. The existing home has only 1,517 SF of GFA which is small for this neighborhood. Letters in support from immediately adjacent neighbors confirm that the granting of the requested relief will not be a detriment to nearby properties. 2. In light of the recently adopted GFA restrictions and the pre-existing nonconforming side yard setback,the Applicant is not able to achieve the desired benefit of additional bedroom and living space for their growing children in the absence of variance relief. The side yard relief is necessary to maintain the pre-existing nonconforming 6-foot setback on the south side of the property.We tested several schemes complying with side setbacks and found that there is no other way we can achieve comfortable interior spaces without impacting the space significantly as well as creating an awkward fagade. 3. While the required side yard relief may be mathematically substantial at 40%,the Applicant submits that it is not practically substantial in light of the pre-existing nonconforming setback. The proposed extension maintains the same setback as the existing house, but does set back further on the second floor,complying with the pyramid rule. The required GFA variance represents only 15%relief from the code requirement which is arguably insubstantial in light of the size of neighboring homes and the expansion to the rear of the home which will screen much of the addition from view. It should be noted that the GFA is actually less than the allowable lot coverage,with which this project is compliant. Normally GFA would allow more square footage than lot coverage. 4. As a Type II action under SEQRA,the granting of a GFA and side yard setback variance will have no perceivable adverse impacts on the physical or environmental conditions in the neighborhood. The proposal includes upgrading to an I/A sanitary system,which reduces the physical environmental impact.The proposed house maintains the existing character of both the existing house and neighborhood.The addition is screened from view by both the existing house and a neighbor's garage. S. To the extent that the difficulty is self-created, pursuant to New York Town Law§267-b (3),a self- created hardship"shall not necessarily preclude the granting of an area variance." The setback matched is preexisting and built before the introduction of codes.The newly introduced GFA limitation is too stringent for the small property,where GFA is less than allowable lot coverage. Finnegan, Esq. 13250 Main Road Mattituck, New York 11952 (631) 315-6070 Dated: June 3, 2024 STATEMENT OF FACTS The Applicants, Lauren and Russell Antonucci, are seeking by way of this appeal from the Building Inspector's Notice of Disapproval, dated December 14, 2023, for a building permit to construct additions and alterations to their existing single-family residence, the following relief from this Board: 1) A variance from the requirements of Section 280-124 to allow construction of the proposed addition along the pre-existing nonconforming 6-foot side yard setback where 10 feet is the minimum setback; and 2) A variance from the requirements of Section 280-207 to allow construction of the home with a Gross Floor Area (GFA) of 2,680 SF where the maximum per code is 2283 SF (a difference of 397 SF on two floors). The subject parcel is a nonconforming 11,460 SF parcel in the R40 zoning district located on Mary's Road in Mattituck adjacent to the Mattituck High School track and fields. The relief sought is to allow the proposed construction of a two-story addition to the rear of the property to create much needed functional living space for the Applicants' growing family. Although the existing . parcel was historically larger, a prior owner transferred nearly 6,000 SF to the neighboring property to the east by way of a lot line modification that was approved in 1992. As a result of that the existing house lies on a parcel that is rather constrained making compliance with new GFA rules impracticable. 2 All of the proposed construction will be in the rear yard, within the existing side yard setback and despite the exceedance of GFA, lot coverage will only be 17.48%. For the following reasons, the Applicants submit that variance relief from the side yard setback requirement in Section 280-124 and the GFA regulation in 280-207 is warranted. POINT I THE APPLICANT HAS MET THE TEST FOR THE GRANT OF AN AREA VARIANCE SET FORTH IN TOWN LAW §267-B Under §267-13, the Applicant must demonstrate compliance with the following standards to be eligible for the issuance of a variance: (a) whether the grant of the variance will cause an undesirable change in the character of the neighborhood or will create a detriment to nearby properties; (b) whether the benefits sought by the applicant can be achieved by some method feasible for the applicant to pursue other than an area variance; (c) whether the requested area variance is substantial; (d) whether the grant of the variance will have an adverse effect or impact upon the physical or environmental conditions in the neighborhood or in the affected area of the Town; and (e) whether the difficulty causing the applicant to request an area variance was self-created which consideration shall be relevant to the determination of the Board but shall not necessarily preclude the grant of the variance. It is respectfully submitted that under the facts and circumstances 3 presented here, the Applicants can clearly meet the standards set forth in Town Law §267-B and as a result, the relief requested herein should be granted. 1. The Grant of Variance Relief Will Not Cause an Undesirable Change in The Character of the Neighborhood or Create a Detriment to Nearby Properties. , The surrounding neighborhood is characterized by one- and two-story homes on substandard lots. The proposed addition will be to the rear of the existing home and will result in a home that is similar in size and in character to other homes in the community. The proposed addition will follow the existing side yard setback and be well within the rear yard and lot coverage limitations. The existing home has only 1,517 SF of GFA which is small by comparison to other homes in the immediate area. Letters in support from immediately adjacent neighbors confirm that the granting of the requested relief will not be a detriment to nearby properties. 2. The Benefits Sought to Be Achieved by Applicant Cannot Be Feasibly Achieved by Some Method Other Than the Requested Area Variance In light of the recently adopted GFA restrictions and the pre-existing nonconforming side yard setback, the Applicants are not able to achieve the desired benefit of additional bedroom and functional living space for their growing children in the absence of variance relief. The side yard relief is necessary to maintain the pre-existing nonconforming 6-foot setback on the south side of the property. A design that would comply with the ten-foot side yard setback would hinder the creation of comfortable interior spaces and 4 create an awkward facade. 3. The Area Variance Sought is Not Substantial. While the required side yard relief may appear mathematically substantial at 40%, the Applicants submit that it is not practically substantial in light of the pre-existing nonconforming setback. The proposed extension maintains the same setback as the existing house, but does set back further on the second floor, complying with the Pyramid Law in the Town Code. The required GFA variance represents only 17% relief from the code requirement which is arguably insubstantial in light of the size of neighboring homes and the expansion to the rear of the home which will screen much of the addition from view. It should be noted that the GFA is actually less than the allowable lot coverage, with which this project is compliant. It is noteworthy that, although the GFA regulations were recently adopted, variance relief has been granted to permit construction on substandard lots with lot area that limited allowable GFA (See, ZBA File # 7813 where 26% relief was granted for GFA on 13,750 SF parcel and ZBA File #7809 where 46% relief was granted for GFA on a parcel with 16,595 SF of buildable land). The relief sought here is far less substantial. 5 4. The Grant of the Variance Will Not Have an Adverse Impact on the Physical or Environmental Conditions in the Neighborhood or District. As a Type II action pursuant to SEQRA, the requested variances, if granted, are not expected to have any adverse environmental impacts on the neighborhood or district. The rear yard addition will be substantially screened from view from the east by the existing house, and to the south by the neighbors' garages and existing vegetation. The Applicants will comply with the Town's Storm Water Management Code and will be upgrading to an I/A low-nitrogen sanitary system, resulting in a net environmental benefit from this project. The granting of relief will permit construction of a home that is entirely consistent with the character of homes in the surrounding neighborhood. 5. The Self Created Nature Of the Alleged Difficulty Should Not Preclude the Granting of Area Variance Relief. It is respectfully submitted that the difficulty is not self-created to the extent that the subject property is constrained by its substandard lot size and pre-existing nonconforming side yard setback. Even if it is determined that the difficulty is self-created, pursuant to New York Town Law §267-b (3), a self- created hardship "shall not necessarily preclude the granting of an area variance." 6 CONCLUSION For the reasons set forth herein, it is respectfully submitted that the standards of Town Law Section 267-B have been met and, as such, relief from the requirements set forth in Southold Town Code Sections 280-124 and 280- 207 is warranted.
