SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply
dated February 15, 2024 stating that this application is considered a matter for local determination as there appears
to be no significant county-wide or inter-community impact.
LWRP DETERMINATION: The relief, pennit, or interpretation requested in this application is listed under the
Minor Actions exempt list and is not subject to review under Chapter 268.
PROPERTY FACTS/DESCRIPTION: The subject, rectangular-shaped, non-conforming, 12,317.4 square feet, .28
acre parcel located in the R40 Zoning District measures 90.84 feet along Youngs Road, then runs west 144.20 feet
along an unpaved right of way,then continues along the same right of way,90.18 feet north,and returns east, 129.19
feet along a residentially developed lot to the north. The property is improved with a one and half story frame
residence with an attached single car garage, wood entry stoop, rear enclosed wood deck, bilco-type cellar access,
central air conditioning condenser and an unpaved driveway, as shown on the survey prepared by Andre K. Miller,
Licensed Land Surveyor, and dated November 27, 2018.
BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; Article XXIII, Section 280-
124; and the Building Inspector's January 25, 2024 Notice of Disapproval based on an application for a pen-nit to
construct additions and alterations to an existing single-family dwelling and to construct an accessory in-ground
swimming pool; 1) located less than the code required minimum rear yard setback of 35 feet; 2) swimming pool is
located in other than the code permitted rear yard; located at: 295 Youngs Road, Orient,NY. SCTM No. 1000-18-
1-12.
RELIEF REQUESTED: The applicant requests two (2) variances for the following improvements: 1) A reduced
rear yard setback of 17.3 feet where a minimum rear yard setback of 35 feet is required by code for the proposed
addition of a wood deck measuring 15 feet by 16 feet and; 2)The installation of an inground swimming pool,plunge-
style, measuring 10 feet by 6 feet, located in a front yard where the code limits such improvements to the rear yard
only, as part of an overall renovation and expansion of the existing single-family residence.

ADDITIONAL INFORMATION: The subject parcel is the beneficiary of prior Board relief:
#4361 dated February 14, 1996 Covering a reduced rear yard setback
#4372 dated April 5, 1996 Establishing the building lot by waiver of merger
Improvements on the subject parcel are covered by the following Certificate of Occupancy:
#25900 dated August 18, 1998 covering the construction of a single-family residence with attached garage
and screened in porch.
The applicant provided architectural plans labeled ZBA-01 to ZBA-04 prepared by Anthony M. Portillo, Registered
Architect, dated December 22, 2023 and an updated site plan, labeled ZBA-01 dated May 23, 2024 illustrating all
additions and alterations proposed to the home, including those not requiring Board relief(expansion of the footprint
of the residence to include a new one-story addition, for a `great room',to the front of the house and the addition of
dormers to expand the second floor living space).
During the public hearing the applicant indicated that the existing, residential, sanitary system is located on the
northside of the house and that a new system is not necessary as there is no proposed expansion of the number of
bedrooms. Additionally,the applicant stated as a result of the location of the sanitary system,there is limited area to
place an inground swimming pool on the subject property given three(out of four)road fronts abutting the site.
The applicant provided the Board with examples of variance relief granted within the Hamlet of Orient,NY, relative
to reduced setbacks. The applicant did not provide the Board with any examples of relief granted for swimming
pools located in front yard settings.
In advance of the public hearing, members of the public wrote letters in opposition to the relief requested. During
the public hearing immediate neighbors spoke against this application, focusing mainly on the request to place the
swimming pool in a front yard location, where the code requires a rear yard location for such improvements.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on June 6,2024 at which time written and
oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and
surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant
and makes the following findings:
1. Town Law 4267-b(3)(b)(1). Grant of the variance relative to a rear yard setback for the addition of a deck will
not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Prior
Board relief for a reduced rear yard setback was granted under appeal #4361 in 1996. The applicant proposes to
construct a new deck measuring 15 feet by 16 feet, which will line up with the existing rear fagade and rear yard
setback created by the existing enclosed screen porch. The deck will wrap around to meet a proposed one-story
addition to the dwelling facing Youngs Road with conforming front yard setbacks.Therefore, no discernible change
to the existing rear yard will be established which is in keeping with the existing house. Decks are common
appurtenances to single-family homes throughout the Town of Southold and the immediate neighborhood. However,
grant of the variance relative to an inground swimming pool in a front yard location will produce an undesirable
change in the character of the neighborhood or a detriment to nearby properties. While swimming pools are common
accessory improvements to homes in the community, they are not commonly located in front yards and no evidence
was submitted to indicate that any specifically exist in front yards on Youngs Road.
2. Town Law V67-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for
the applicant to pursue, other than an area variance. The applicant could build a smaller deck with a compliant rear
yard setback, but, stylistically, maintaining the existing rear fagade setback created by the screened-in porch is the

most logical and in keeping with prior variance relief. However, locating a swimming pool,while small in size and
defined as a plunge-style pool as proposed, in the front yard is not the only available option. During the public
hearing, the applicant stated that they could place the pool in the code required rear yard, but preferred the
front yard location. Although the code conforming rear yard is relatively small, there is sufficient space to place
the proposed pool.
3. Town Law V67-b(3)(b)(3). The variances requested herein are mathematically substantial, representing 50.6%
relief from the code relative to a reduced rear yard setback and 100% relief from the code relative to locating the
pool in the front yard. However, the property is well landscaped and screened from the roadway with a tall private
hedge. Few passersby or neighbors will perceive the reduced rear yard setback for the proposed deck,given the fact
that it follows the fagade of the existing residence. However, locating a pool in the front yard, despite any screening
will set an unnecessary precedent for the community at large.
4. Town Law V67-b(3)(b)(4). Evidence has been submitted to suggest that a variance in this residential community
will have an adverse impact on the physical or environmental conditions in the neighborhood relative to locating the
swimming pool in a front yard, but not in establishing a deck with a reduced rear yard setback. The applicant must
comply with Chapter 236 of the Town's Storm Water Management Code.
5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6. Town Law V67-b. Grant of the requested relief relative to a reduced rear yard setback is the minimum action
necessary and adequate to enable the applicant to enjoy the benefit of the construction of a deck measuring 15 feet
by 16 feet, while preserving and protecting the character of the neighborhood and health, safety and welfare of the
community. Denial of the requested relief relative to the placement of a swimming pool, measuring 10 feet by six
feet, in a front yard location, is not the minimum action necessary to enable the applicant to enjoy the benefit of an
inground swimming pool, while preserving and protecting the character of the neighborhood and the health, safety,
and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New
York Town Law 267-13, motion was offered by Member Planamento,seconded by Member Dantes,and duly carried,
to
GRANT the variance as applied for relative to the reduced rear yard setback of 17.3 feet,as shown on Architectural
Drawings labeled ZBA-01 to ZBA-04 prepared by Anthony M. Portillo, Registered Architect and last dated May 23,
2024, and,
DENY the variance as applied for relative to the placement of the inground swimming pool in a front yard location.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. The applicant shall submit an updated,stamped, site plan to the Zoning Board of Appeals,with the pool
removed. All other design features are to remain the same.
2. All rain water runoff from the existing dwelling and proposed additions, and from the existing irrigation
system, shall be contained on the subject property in compliance with Chapter 236 of the Town's
Stormwater Management Code.
This approval shall not be deemed effective until the required conditions have been met.At the discretion of
the Board of Appealsfailure to comply with the above conditions may render this decision null and
void

That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does
not increase the degree of nonconformity.

Please Read Carefully
Any deviation from the survey, site plan and/or architectural drawings cited in this decision, or work exceeding
the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department
of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public
hearing before the Zoning Board of Appeals.
Any deviation from the variance(s)granted herein as shown on the architectural drawings,site plan and/or survey
cited above,such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted
herein, are not authorized under this application when involving nonconformities under the zoning code. This
action does not authorize or condone any current or future use, setback or other feature of the subject property
that may violate the Zoning Code, other than such uses,setbacks and other features as are expressly addressed in
this action.
TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town
of Southold any variance granted by the Board of Appeals shall become null and void where a
Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with
the Suffolk County Clerk, within three (3)years from the date such variance was granted. The
Board of Appeals may, upon written request prior to the date of expiration, grant an extension not
to exceed three(3) consecutive one (1)year terms. IT IS THE PROPERTY OWNER'S
RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REOUIRED TIME
FRAME DESCRIBED HEREIN. Failure to comply in a timely manner may result in the denial by
the Building Department of a Certificate of Occupancy, nullify the approved variance relief, and
require a new variance application with public hearing before the Board of Appeals

BASIS OF APPEAL: Notice of Disapproval issued by the Building Inspector
dated January 24 1996 which states grounds of ' "Insufficient rear 3Land
setback" and Article XXIV, Section 100-244B.
RELIEF REQUESTED: Rear yard setback proposed at 21 feet instead of the
required 35 feet for a proposed new dwelling location on this corner lot having
frontage along three streets or rights-of-way. The subject parcel consists of
an area of 12,318 sq. ft. All other yard areas are proposed to conform with
rode.

ACTION/RESOLUTION ADOPTED: Granted rear yard setback at 21 feet as
applied and with the condition that there be no further principal building
setback reductions in the rear yard unless a new variance application is
submitted for consideration. (This rule would not apply to accessory
buildings.)
REASONS/FINDINGS: The only yard area available (other than a front yard)
for a setback reduction is this remaining rear yard which faces north. The
subject property technically does not have "side yards," as defined by the
zoning code, and a front yard area is not recommended for reduction in most
cases. The house as proposed is minimal in size, and the request as submitted
is not unreasonable under the present circumstances.

ZONING CODE PROVISIONS: Article II, Sections 100-25, 100-26
DATE OF DISAPPROVAL FROM BUILDING INSPECTOR: March 14, 1996
BASIS OF MERGER: This lot contains 12,318+- sq. ft. created by deed dated
September 1961 at Liber 5060 page 370, and shown on the 1926 Map of the area
prepared by Otto W. VanTuyl, P.C. which was later again dated 1-21-58. This
lot is nonconforming in lot size and was conveyed to the applicant in the
settlement of her mother's estate on 6/17/95 by deed at Liber 11754 p. 863.
The applicant also owns a contiguous lot identified as 1000-18-1-9 which is also
nonconforming as to lot site. The merger provision provides that the same
ownership percentage joins contiguous nonconforming lots.
REASONS FOR GRANT OF WAIVER (also continued on Waiver Application) :
1. Original lot lines for each 1000-18-1-12 and 1000-18-1-9 were created during,
and before 1961 as shown by the above referenced information.
2. The Town issued two tax bills for two parcels since, and before, 1961, which
is prior to the enactment of (11/23/1971) of one-acre zoning.
3. Zoning adopted by Town between the period from 4/23/57 to 11/12/71
permitted lot sizes of 12,500 sq. ft. or larger, and prior to 1957, any size
was permitted provided all other agency permits were obtained as deemed
-ippropriate at that time. The lot merger rule was not applied in the Town
of Southold until about 1983 (due to Supreme Court rulings and precedents of
State Law applicable to the Southold Town Zoning Code).
5. In 1976 - County established County Parcel numbers from separate deeds,
and this lot has received County Health Department approval for a new
single-family dwelling and its facilities.
6. The subject parcel is more particularly described on the survey map prepared
by Roderick VanTuyl, P.C. dated July 5, 1995, amended December 20, 1995,
and consist of a lot width along Young's Avenue of 90.84 feet, lot depth of
144.20 feet, and lot area of 12,318 s.f.
7. This neighborhood consists of lots similar in size and character.
8. The natural details and character of the contours and slopes of the lot will
not .be significantly changed or altered in any manner, and there will not be
filling of the natural land area affecting nearby environmental or flood (#13
areas, or neighboring properties.
9. The lot is not an increase in density since proof has been submitted to show
this was always intended to remain a separate lot.
10. The grant of this waiver will avoid economic hardship to the owner.

construct additions and alteration to an existing family dwelling and to construct an accessory in-
ground swimming pool.The applicant's home at 295 Young's Road, Orient is adjacent to my own.
• The proposed construction is located less than the code-required minimum rear yard
setback of 35 feet.
• The proposed swimming pool is located other than the code permitted rear yard—it is
proposed for the front yard.
The applicant's request disregards the Southold Town zoning code. Our codes are in place,
"as a set of laws used as a tool to govern physical development within (our)municipality...Zoning
sets forth the standards that must be met and processes that must be followed in order to develop
a parcel of land.... The granting or denial of an area variance is based on a "balancing test"
consisting of six factors dictated by NYS Town Law used to determine if the benefit to the applicant
outweighs the possible detriment to the health, safety, and welfare of the community, or vice
versa. (from Southold Town Zoning Code Handbook)
The health, safety, and welfare of our community neighborhood on our already densely
populated street, outweigh this applicant's benefit to construct a pool in the front yard or any
other construction within a setback of 35 feet. Wedging new development within the existing
structures in violation of the Southold Town zoning code,would exacerbate and harm an already
crowded and fragile neighborhood.
I strongly object to this variance and ask our Zoning Board of Appeals to uphold the
Building Inspector's already clear disapproval of this application and to deny this applicant's
appeal. The applicant has not considered the quality of life in our neighborhood. Our Southold
Town code must be adhered to and unconditionally reinforced.

I'd like to bring to the Committee's attention another issue related to Richard Fisher's
# 7905, application and appeal for a building and pool variance --our neighborhood's
extreme concern for our well water safety.
Not long ago, Mr. Fisher removed old growth trees and replaced them with an
underground irrigation system in his front yard; this is the same front yard where pool, deck
and addition are proposed His front yard is pitched to a degree that when the irrigation
system turns on, sufficient amounts of water run-off onto Young's Road, creating sand and
gravel rivets on Young's Road, as well run-off into neighbor's yards. Unfortunately, Mr. Fisher
is rarely home to observe this, but those who are,we are concerned about pools of standing
water on Young's Road, the wastefulness to our aquifer, and the fact that his irrigating
system does not absorb into his yard. I am particularly concerned about this run-off
because it is compounded by the routine application of lawn herbicide and this poison's
subsequent run-off. Just two mornings ago, 1 watched landscapers apply,a broadleaf
herbicide not only to his lawn, but to town property on Young's Road shoulder-- outside the
homeowner's front yard privet hedge. The runoff from this herbicide application goes
directly into our aquifer&well water.
• All of us on Young's Road have private wells.This run-off, combined with the
application of harmful herbicides is a serious threat to our fresh well water supply
and to our fragile aquiferwhich we are all dependent.
• Clearly, there already exists a serious problem with run-off from the homeowner's
irrigation system. We can only speculate how the proposed addition, pool, and deck
construction, removal of soil and berming of landscape, will exacerbate and damage
our environment.
I ask the Zoning Board Committee members, please do not set a precedent, and allow a
pool to be constructed in this or any front yard, no matter what'size the pool.

The applicant's home at 295 Young's Road, Orient is directly across the street from the house my
partner, Jeanne Betancourt, owns at 250 Young's Road and we have lived there for over ten years.
Two obvious concerns:
• The proposed construction is located less than the code-required minimum rear yard setback
of 35 feet.
• The proposed swimming pool is located other than the code permitted rear yard, but in the
front yard.
The applicant's request disregards the Southold Town zoning code. The health, safety, welfare of our
community neighborhood on our already densely populated street, outweigh this applicant's benefit to
construct a pool in front yard or any other construction within a setback of 35 feet.
The setback for the houses on the streets are at a relatively equal distance from the street- allowing
this variance would make this an unsightly exception.
I strongly encourage our Zoning Board of Appeals to uphold the Building Inspector's already clear
disapproval of this application and to deny this applicant's appeal. The applicant has not considered
the quality of life in our neighborhood. Our Southold Town code must be adhered to and
unconditionally reinforced.

Thank you for taking the time to review our variance request for our home located at 295 Youngs
Road in Orient. My wife and I purchased the home in 2018 after a long search and have made
many improvements to the home over the past six years. At the time of purchase the home needed
extensive refurbishment, both inside and out, and needed rehabilitation of the landscaping of the
property, which we have completed. During this refurbishment .we have been thoughtful to
maintain the charm and character of the home, while remaining true to the spirit of Orient. In
completing these renovations, I believe we have positively contributed to improving property
values on the street.
My wife's family, the Townsends,and relatives, the Dormans, are long time Orient residents. We
reside full time in Poughkeepsie, NY, however, with our two grown children, return to Orient
throughout the year. We have never rented our home in Orient, nor do we have plans to rent the
home. The proposed small addition, with patio and small plunge pool, is for much needed
additional first floor and outdoor space for family gatherings. The current first floor layout
provides a single room for common area space,including the kitchen, which is really quite small.

I understand that homeowner, Richard Fisher#7905 is applying for variances on building disapproval
from ArticlelII, section280-154 and ArticleXXIII, section 280-124 which . On January 25,2024 a notice
of disapproval was issued regarding the permit requested by Mr. Fisher to construct additions and a
front yard swimming pool. This request disregards Southold Town Zoning Code.
As I have rarely seen this house occupied it is my guess that the owner might be planning to turn this
into a VBRO property further deteriorating the cherished quality of life that full time residents of
Orient hold so dear. I know that pool owners are required to bring in water to fill their pools but I'm
sure that when the water starts to evaporate they are using their garden hoses to top off their pools.
I strongly object to this variance and ask you to uphold the building inspectors determination.

Dear Zoning Board of Appeals:
Live across the street from 295 Youngs Road. I strongly encourage the ZBA to respect the
two codes they have in place that are being challenged by Richard Fisher's appeal for
variances. The tranquility on our street would be significantly disturbed by the presence of a
swimming pool that is in the portion of 295's yard fronting Young's Road and a proposed
construction that is located less than the code-required minimum rear-yard setback of 35
feet. In addition to disturbing the peace of our street, allowing these exemptions will lead to
an increase in such special exemptions. Avery bad precedent to set.
When I first bought 250 Youngs Road the view across the street was a small bucolic
woodland with a modest wood frame house tucked into a forest setting. The trees are gone
and now there is this proposal to extend the house closer to the road and put in a pool. If you
allow the variances named in this appear, the house and pool will be closer to the road than
the houses of all the properties on both sides of the street leading to the sound. Another bad
precedent for future development on our street.
Please turn down this appeal for two variances.

The June 6, 2024 Zoning Board of Appeals Regular Meeting will be held BOTH in person in
the Town Hall Meeting Room at 53095 Main Road, Southold AND via video conferencing(Zoom
Webinar), and a transcript will be provided at a later date. The public will have an opportunity to
see and hear the meeting live, and make comments.
Below, please see instructions required to prepare for the ZBA public hearing which includes:
PLEASE READ CAR+E�FULLI'.
1. Yellow sign to post on your property a minimum of seven(7) days prior to your hearing,to be
placed not more than 10 feet from the front property line (within your property) bordering the
street. If you border more than one street or roadway, an extra sign is supplied for posting on
both street frontages. Posting should be done no later than May 30, 2024.To avoid
weather damage to your sign please affix it to a sturdy surface such as plywood. If your
sign is damaged please call the office and we will provide you with another one. Prior to

Transmitted for your records are copies of the Board's June 20, 2024 Findings, Deliberations and Determination,
the originals of which were filed with the Town Clerk regarding the above variance application.
Pursuant to the condition of the determination, please submit an updated, stamped, site plan with the
pool removed.
Before commencing any construction activities, a building permit is necessary. Please be sure to submit an
application along with a copy of the attached determination to the Building Department.
Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board
of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a
subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date
such variance was granted. The Board of Appeals may, upon written request prior to the date of
expiration,grant an extension not to exceed three(3) consecutive one (1)year terms. IT IS THE
PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE
REQUIRED TIME FRAME DESCRIBED HEREIN. Failure to comply in a timely manner may result in
the denial by the Building Department of a Certificate of Occupancy, nullify the approved variance relief,
and require a new variance application with public hearing before the Board of Appeals
