No. 5315 - DONALD AND VIVIAN SONNENBORN Property Location: 690 Old Woods Path, Southold; CTM #87-1-20. Southold Town Clerk SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 68,976.02 sq. ft. parcel has 13.96 ft. frontage along the edge of a private right-of-way referred to as Woods Path, in Southold. The property is improved with an existing one and 1-1/2 story frame house and garage as shown on the August 18, 2000 survey prepared by Joseph Ingegno, L.S. The dwelling has nonconforming side yards at 3.0 feet from the east side line and 7.6 feet from the west side line, at the closest points. The existing total of both side yards is nonconforming at 10.6 feet. BASIS OF APPLICATION: Building Department's January 9, 2003 Notice of Disapproval, citing Sections 100-242A and 100-244 in its denial of a building permit application for proposed additions/alterations to an existing dwelling with side yards at less than 20 feet on a single yard and less than 45 feet for both yards. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 15, 2003 and August 21, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct the following additions to the existing dwelling shown on the plans dated 1-2-03 and 2-3-03, prepared by Boulevard Planning East, P.C. (Project #245): (a) one-story addition extending 6' at the north side of the dwelling with a side yard variable between 4.9 and 5.1 feet from the east line; (b) second-story addition at 5.1 feet from the east line at its closest point; (c) proposed 7.9' x 23.25' deck with variables between 2' and 3' from the east side line. The total side yards for the proposed additions are requested at 9.6 feet. Page 2—September 11,2003 Appl. No.5315—Donald and Vivian Sonneborn 87-1-20 at Southold ADDITIONAL INFORMATION:AMENDED RELIEF: During the August 21, 2003 public hearing, the applicant was requested to increase the setbacks for the proposed easterly additions. After further discussion, the applicant agreed to an alternative plan, maintaining the existing nonconforming side yard (3 ft.) of the house for a proposed deck. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the alterative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed new construction is for: (a) one-story addition extending 6' at the north side of the dwelling with a side yard variable between 4.9 and 5.1 feet from the east line; (b) second-story addition at 5.1 feet from the east line at its closest point; (c) proposed 7.9' x 23.25' deck with variables between 2' and 3' from the east side line. The rear deck is open and extends 7.9 feet beyond the rear of the house, maintaining the same side yards. The front addition is a 6 ft. extension at one-story in height; the second-story addition will be set back at a greater distance than the existing nonconforming setbacks. The alternative relief for minimum side yard variables between 3 ft. and 5.1 will maintain or exceed the preexisting side setbacks of the dwelling. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The property is wooded and is a unique, long and narrow lot with a 1, 1-1/2 and 2-story dwelling with significantly reduced side yards that are preexisting. 3. The alternative relief granted herein is substantial because the side yards are substantially nonconforming as exists. The Code requirement is for a minimum combined side yard area of 45 feet, and the relief is a total of 10.6 (3. ft. and 7.6 ft.) 4. The difficulty was self-created when the additions were planned with a design which did not conform to the current Town Code requirements. 5. There is no evidence that the grant of the alternative relief will have an adverse effect or impact on physical or environmental conditions in the neighborhood or district. No evidence has been submitted to suggest that a variance in this small beach community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions to the preexisting dwelling, while Page 3—September 11,2003 Appl. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairwoman Tortora, seconded by Member Oliva, and duly carried, to DENY the variance as applied for with respect to the proposed rear deck addition, and to GRANT Alternative Relief for a minimum 3 ft. side setback for the open deck addition, and GRANT the variance as applied for with respect to the second-story addition and one-story addition at the north side of the dwelling, as shown on the plans dated 1-2-03 and 2-3-03, prepared by Boulevard Planning East, P.C. (Project#245). This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The proposed project remains in scale and character to the existing structure on the property. Both the massing and the architectural elements are in keeping with the original design of the structure. It is in ouropinion that the granting of this variance will not produce a change in the character of the neighborhood. Question #2: Due to the location of the subject structure on the property, as it currently is sited it violates the setbacks from the property line. The proposed additions and alterations to the house do not exceed the existing setbacks in any way. The proposed deck exceeds the setback lines,of the existing house by 1 foot, and as it is a deck , we feel that this will not cause a change in the character of the neighborhood. Question#3: The amount of relief that we seek is of a minor character. We are asking for relief for an additional 1 foot, and the proposed structure is an exterior deck. Question#4: The variance we are asking for would be the minimum necessary to fulfill the goals of this project, • while protecting the character of the neighborhood, and the health, safety, and welfare of the surrounding community.
