This meeting is public. The Planning Board may add or remove applications from the Agenda upon its discretion, without further notice. Applications may not be heard in the order they appear on this agenda. SETTING OF THENEXT PLANNING BOARD MEETING Chairman Rich: The first order of business is to Monday, June 3, 2024 at 6:00 p.m. at the Southold Town Hall, Main Road, Southold, as the time and place for the next regular Planning Board Meeting. SITE PLAN APPLICATIONS SEQRA CLASSIFICATION & SET HEARING Chairman Rich: Silver Sands Hotel Restaurant—This Site Plan is for the proposed conversion of an existing accessory storage building (boathouse) to a freestanding restaurant with office and storage space for restaurant operations, and conversion of an existing single-family dwelling to a commercial kitchen for the restaurant to include 111 indoor/outdoor seats and 19 parking stalls on 2.1 acres in the Resort Residential (RR) Zoning District. The property is located at 1135 Silvermere Road, Greenport. SCTM#1000-47.-2-15 Pierce Rafferty: WHEREAS, this Site Plan is for the proposed conversion of an existing accessory storage building (boathouse) to a freestanding restaurant with office and storage space for restaurant operations, and conversion of an existing single-family dwelling to a commercial kitchen for the restaurant to include 111 indoor/outdoor seats and 19 parking stalls on 2.1 acres in the Resort Residential (RR) Zoning District; and WHEREAS, the Southold Town Planning Board, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined that the proposed action is a Type II Action as it falls within the following description for 6 NYCRR, Part 617.5(c)(18) "reuse of a residential or commercial structure, or of a structure containing mixed residential and commercial uses, where the residential or commercial use is a permitted use under the applicable zoning law or ordinance, including permitted by special-use permit, and the action does not meet or exceeds any of the thresholds in section 617.4 of this Part"; be it therefore RESOLVED, that the Southold Town Planning Board has determined that this proposed action is a Type II Action under SEQRA as described above; Mia Jealous-Dank: Second. STATE ENVIRONMENTAL QUALITY REVIEW ACT (SEQRA — Final Environmental Impact Statement (FEIS)) Chairman Rich: Strong's Storage Buildings Final Environmental Impact Statement (FEIS) —The Final Environmental Impact Statement for the Strong's Storage Buildings Site Plan has been completed and is ready to be accepted. The subject of this FEIS is the proposed construction of two (2) buildings for boat storage, one at 52,500 sq. ft. and the other at 49,000 sq. ft., located on 32.6 acres in the MII and R-80 Zoning Districts where there are 69,245 sq. ft. of existing boatyard buildings. The property is located at 3430 Mill Road, Mattituck. SCTM#1000-106-6-13.4 & 10 Before we move forward, I just want to make a couple of comments here to clarify: Strongs SEQR Process Accepting the Final Environmental Impact Statement Southold Town Planning Board Public Meeting — May 6, 2024— Page 4 The decision the Planning Board is making tonight is to accept the Final Environmental Impact Statement— also known as the FEIS. • There is no comment period • There is a 10-day waiting period before the Board can make their Findings & decision. This is not the end of the process. The next steps to finish: 1. Publish the FEIS in the State DEC's Environmental Notice Bulletin 2. Send the FEIS to SC Planning so they can complete their review and make a decision (they meet on June 5th). 3. After SC Planning makes a decision, the Planning Board will make a Findings Statement 4. The final step is a decision by the Planning Board on the site plan application 5. We expect this all to be completed in the next couple months. Just so everyone understands the process. Heather, thank you for making that so clear. Charles Cuddy: Mr. Chairman, I'm appearing for the applicant. My name is Charles Cuddy. I would like to— I'm asking for at least a moment to address something. Heather Lanza: There's no hearing. Charles Cuddy: This is not a hearing; all I'm doing is making a statement this evening on behalf of the applicant. The statement is very short: It's taken 8 months to get us to this point, we just need additional time. SEQRA says at least 10 days and I want to point out— and I think it's a deficiency in this whole process... James Squicciarini: Mr. Cuddy, this is not a hearing. Charles Cuddy: I understand that, there's just two points... James Squicciarini: It's not appropriate to make these comments at this time. As you know. Charles Cuddy: I would like to finish them. I just want to say one more thing: I think that this is deficient because all you're doing is looking at the DEIS, the applicant has never had a chance to comment on the public comments and that's what I'm seeking. Thank you. Chairman Rich: I've been advised we're following the procedure correctly, so we are going to move forward with this resolution at this time. Southold Town Planning Board Public Meeting — May 6, 2024 — Page 5 Mia Jealous-Dank: Mr. Chairman, WHEREAS, this site plan is for the proposed construction of two (2) buildings for boat storage, one at 52,500 sq. ft. and the other at 49,000 sq. ft., located on 32.6 acres in the MII and R-80 Zoning Districts where there are 69,245 sq. ft. of existing boatyard buildings; and WHEREAS, the Southold Town Planning Board, as lead agency and pursuant to the State Environmental Quality Review Act, found the Draft Environmental Impact Statement for the application referenced above to be adequate and acceptable for public review on March 13, 2023, held the requisite public hearing and public comment period, reviewed all comments and completed a Final Environmental Impact Statement (FEIS); and WHEREAS, upon review of the FEIS, the Southold Town Planning Board finds that it responds to all substantive comments, is complete, and will facilitate the preparation of findings; therefore, be it RESOLVED, that the Southold Town Planning Board accepts the Final Environmental Impact Statement entitled "Final Environmental Impact Statement for Strong's Yacht Center-Proposed Boat Storage Buildings" dated May, 2024, and hereby authorizes and directs the Planning Board Chairman to submit the Notice of Completion pursuant to Part 617.12 of the SEQRA regulations within five business days of this resolution Martin Sidor: Second. PUBLIC HEARINGS Chairman Rich: 5:02 PM -Apodiacos Standard Subdivision —This proposal is for a Standard Subdivision of a 3.26-acre parcel into four lots, where Lot 1 is 0.9 acres and contains an existing house, Lot 2 is 0.9 acres and Lot 3 is 1.2 acres. A fourth lot includes Southold Town Planning Board Public Meeting — May 6, 2024 — Page 6 an existing right-of-way easement across the property and equals 0.2 acres. The property is located at 4260 Main Road, Greenport. SCTM#1000-35.-5-3 If anyone wishes to speak to the Planning Board on this, please step forward. Please state and write your name. Mr. Apodiacos, are you there? Ted Apodiacos: Yes. Chairman Rich: Mr. Apodiacos, would you like to address the Board? You have a right to state what you would like to do in your own words. Ted Apodiacos: Yes. It's just a standard subdivision of a 3.26-acre parcel that we've owned in our family since 1976, and we just want to subdivide it. A standard subdivision is what we're looking to do. Thank you. Christine Malone: Christine Malone. I am here representing Place Point Property Owners Association and I'm also a resident of Wiggins Lane, to the east. Our main concern is that Wiggins on the east is part of a private community and we don't want that opened up - the way it cuts through from Wiggins west to Wiggins east through their property -we just want to make sure that we maintain our private road on our side. We hope you received a letter from our president of our HOA, Gail Rerisi (inaudible). As long as the lots are (inaudible) right to proceed with his plans, we just want to make sure that our side stays within our (inaudible).
