The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, the proposal is recommended as INCONSISTENT with the below LWRP policies. Policy 4. Minimize the loss of life, structures, and natural resources from flooding and erosion. The proposed new ground construction is located within a FEMA El 6' flood hazard zone. The structures within these areas are subject to repetitive loss from storm surge-induced events and should be avoided and/or minimized. Setbacks should be maximized. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. An undesirable change will not be produced in the CHARACTER of the neighbor or a detriment to nearby properties if granted, because: The existing house predates current zoning regulations. The application for a small addition to the existing house maintains the same line of the existing house but because the house is slightly angled the front yard setback is reduced to 13.4. The front stoop is replaced with a wider stoop to add character to the front of the house. This is the applicant's primary residence, and the existing house is small. The proposed addition is making the existing bedroom, master bathroom and kitchen a little more spacious. The setbacks of the house are preexisting. The front yard setback remains the same as the existing. The average setback of the this house and the two adjacent homes are as follows: Dubon 1000-137-4-3.2: 13.8 to the house with 6' x10' stoop. Neighbor: 1000-137-4-4: 22.5 setback to house with 4.5 x 8.4 covered porch (ZBA 7072) Neighbor: 1000-137-4-1.1: 19.4 setback to roofed over front porch. Average Setback: three parcels: 18.56' Average Setback of two parcels: 20.99' These setbacks are all preexisting and nonconforming. Due to the proximity of the house to the wetlands, the front yards setbacks are reduced. The rear yard remains unchanged. The lot size was established when the Map of Fleetwood-Cove was created (Lot 18 & 19-were-combined) The-filed maps were only @50' x 80' The subject lot is 90.55 (40.73 + 49.83) and according to the filed map 84.55' to a line on Eugene's Creek. Over the years the measurement has been taken to the MHW which will change. The existing rear yard setback is maintained and due to the change to the MHW line shown as 31.5 rather than 35, as required. The deck is proposed on the east side and 25.9 feet from the rear yard. The homes along Eugene's Creek have been substantially renovated and many are two story homes. The subject house is one of the few homes which have not been reconstructed. Numerous variances including setback variances were granted on this neighborhood. The shed holds the garden tools and there is no other location for a shed. If.placed in the rear yard it would be located too close to the wetlands.. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: the combined lot is preexisting nonconforming. The new sanitary system takes up a large portion of the east side of the lot. The east side of Filed Lot#19 is encumbered by a Pedestrian Easement. The sanitary system can be within the easement area. The existing house remains with a small addition. The existing nonconforming setbacks remain and can not be made more conforming. The shed is small and there is no other storage for tools. 3. The amount of relief requested is not substantial because: the variances are less than the code required setbacks in that the average front yard setback is applicable: average of the two adjacent homes is 20.99 and proposed is 13.5 to the house and the stoop setback is 11.3. The rear yard setback of the proposed deck is 32.3'. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The existing setbacks are being maintained to the extent possible. The IA sanitary system will be.a benefit to the existing environmental conditions. A drywell is proposed, and the Trustees have requested a non-disturbance buffer with wetland plantings which would require filing a C&R. s.
