(see neighborhood plan) Two story structures: *The proposed second floor addition is in keeping with the neighboring houses on the same street which are all two story residences. Front yard setback: *The front yard setback(20 ft) of the proposed house has an approved ZBA variance from March 13, 1969, #1229. *There are two houses within two hundred feet of the proposed addition, that have front yard setbacks (25 feet and 15 feet) equal to or less than_the proposed addition. Rear yard setback: *There are three houses within one hundred feet of the proposed addition, that have rear yard setbacks (15 feet, 25.7 feet, 26.7 feet) less than the proposed second floor addition of 30.75 feet. 2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: the existing lot coverage is 17.5% the allowable lot coverage allowed by zoning is 20%. To build an increase of square footage to the house that the owner is asking for (+1,480) would mean building in the existing front yard of the existing house, 520 sf to the exisiting 1,480 sf (520 sf +1,480 sf= 2,000 sf) will not be enough of an addition (allowable 20% lot coverage is 2,000 sf buildable area). The request for a second floor addition to the house structure is an additional 1,480 sf. The total gross floor area for the fist and second floor will be 2,960 sf which puts the increase of allowable gross square footage from 2,100 sf to 2,960 sf, an increase of 860 sf(40.95%) beyond the 2,100 sf. 3) The amount of relief is not substantial because: other adjacent houses and other houses in the area (see neighborhood plan), are all two story houses and the owner would like to be able to add a second story addition to the existing one story house structure. This addition will be in keeping with the scale of the neighboring two story house structures. The rear yard setback of other existing structures in the neighborhood (15 feet, 25.7 feet, 26.7 feet) is less than what is proposed to be built over the existing first floor (30.75')for the proposed second floor. 4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: the proposed structure is built on the existing foot print of the existing house. There will be no increase of bedrooms so the existing septic system for the 3 bedroom house will accommodate the proposed new addition. The rain water runoff from the roof gutters will be directed to new underground drywelis. 5) The alleged difficulty has NOT been self-created, The size of the lot is existing (10,000 sf). The existing building is 1,480 sf, with the allowable 20% lot coverage that would be 2,000 sf and the allowable gross square footage is 2,100 sf. Zoning in the past would have allowed the second floor addition (+1,480 sf and a total gross square footage of 2,960 sf ). Since the zoning code has changed, the addition to the second floor will need a variance. The difficulty has be created by the changed zoning code. There are NO Covenants nor Restrictions concerning this land. This is the MINIMUM that is necessary and adequate, and at the same time preserve and protect the character of the neighborhood and the health, safety and welfare of the community.
