PARISA GOLESTANEH/LITTLE POQUATUCK#7808: Request for Variances from Article III, Section 280-15; Article XXIII, Section 280-124, and the Building Inspector's February 2, 2023, AMENDED March 7, 2023 and August 23, 2023,Notice of Disapproval based on an application for a permit to construct an accessory in-ground swimming pool; 1)more than the code permitted maximum lot coverage of 20%; 2) located in other than the code permitted rear yard; located at: 960 Willow Terrace (Adj. to Orient Harbor), Orient,NY. SCTM#1000-26-2-21. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standard 4 and therefore is INCONSISTENT with the LWRP. This determination is based upon the following: 4.1 Minimize losses of human life and structures from flooding and erosion hazards. 1. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures that functionally require a location on the coast or in coastal waters. The single-family residence does not require a location on the coast. The pool location places it partially seaward of the Coastal Erosion Hazard Area(CEHA) line in an environmentally sensitive coastal area. The CEHA line/area marks an area where erosion from storm events over time is most likely. It is recommended that the pool be relocated outside of the CEHA area. The proposed 28 percent lot coverage on the parcel is contrary to preventing loss of structure in hazardous areas. The structures within these areas are subject to repetitive loss from storm surges and flooding and should be avoided and/or minimized. Pursuant to Chapter 268,the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The petitioner is seeking relief from: 9 NYCRR 719.2(a)(2),which stipulates that foam plastic insulation,when tested in conformity with Reference Standard RS-8, and having a surface flame-spread rating no greater than 75 and a smoke density rating no greater than 450, is permitted on the interior surface of concrete or masonry walls, provided the foam plastic insulation is protected by a thermal barrier. The building that is the subject of this petition is constructed with an expanded polystyrene concrete forming unit which is used to construct a one-piece monolithic concrete wall.The forms remain in place and provide an energy efficient concrete wall which are finished with conventional interior and exterior wall coverings.While the above grade portions of these walls are protected as per the Uniform Code, the petitioner wishes to leave the foam plastic insulation on the interior of the cellar walls uncovered. 2. In 1998, a code amendment was approved to allow foam plastic insulation on the interior surface of concrete or 0 printed on recycled paper Petition No. 0780-98 Page 2 masonry walls without a thermal barrier provided that the material has satisfied the requirements for acceptable performance set forth in UBC Standard 26-3, Room Fire Test Standard for Interior of Foam Plastic Systems, 1994. However as of the date of this decision this amendment has not been published in the Uniform Code. 3. 9 NYCRR 719.2(a)requires that foam plastic insulation when tested in conformity with Reference Standard RS-8, shall have a surface flame-spread rating of no greater than 75 and a smoke density rating of no greater than 450.The specifications provided to this office by the petitioner state that the surface flame-spread rating for the material that is the subject of this petition is 10 and the smoke density rating is less than 300. 4. The specifications for the material that is the subject of this petition states that the total toxicity factors(carbon monoxide, carbon dioxide, and poisonous chemicals)found I�� the smoke of burning materials is comparable to that of the smoke from burning red oak. 5. The local Code Enforcement Official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 450.6. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 719.2(a)(2),to permit foam plastic insulation on the interior surface of concrete or masonry walls without being protected by a thermal barrier when tested in conformity with Reference Standard RS-8,and having a surface flame-spread rating no greater than 75 and a smoke density rating no greater than 450, be and is hereby PROPOSED TO BE GRANTED. The property is approximately 22,500 sq. ft. in total area with 100 ft. frontage along Willow Terrace Lane. BASIS OF APPEAL: 'The Building Inspector's December 29, 1998 Notice of Disapproval, under Article III, Section 100-239.4B for an "as built" concrete patio, variably elevated between 5" above ground and 161, located at less than 75 feet from the existing bulkhead. AREA VARIANCE RELIEF REQUESTED: "As built" patio, which requires a building permit due to its elevation above ground (variable between 5"above ground at one end and 16" at the opposite end). The patio is approximately 50 feet from the existing bulkhead and does not extend into the side yard (beyond the sides of the existing dwelling). REASONS FOR BOARD ACTION DESCRIBED BELOW: After considering the testimony presented and personal inspections, the Board makes the following determination: 1) Grant of the alternative area variance will not produce an undesirable change in the character of neighborhood or a detriment to nearby properties because the patio is basically low to the ground. 2) The benefit sought by the applicant cannot be achieved by some method feasible for applicant to pursue, other than an area variance because the code is not clear with respect to the definition of ground level "patio construction," although it is clear that patios do not require building permits. In considering this application, the Board deems that the grant of a patio at 5" to 16" elevation above grade to be the minimum necessary and adequate to preserve and protect the character of the neighborhood, and the health, safety, welfare of the community.
