JORDAN AND WENDY HANDLER#7842: Request for Variances from Article III, Section 280- 13C; Article III, Section 280-15; and the Building Inspector's August 29, 2023,Notice of Disapproval based on an application for a permit to construct additions and alterations to a non- conforming accessary building; at; 1)proposed conditioned,habitable space is not customarily incidental to the principal use, and furthermore,not a permitted use; 2) located in other than the code permitted rear yard; located at: 1225 North Sea Drive, (adj. to Long Island Sound) Southold,NY. SCTM#1000-54-4-14. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed two story addition is INCONSISTENT with the Policy Standard 4 and therefore is INCONSISTENT with the LWRP. This determination is based upon the following: 4.1 Minimize losses of human life and structures from flooding and erosion hazards. 1. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures that functionally require a location on the coast or in coastal waters. The single-family residence does not require a location on the coast. The location places it seaward of the Coastal Erosion Hazard Area(CEHA) line in an environmentally sensitive coastal area. The CEHA line/area marks an area where erosion from storm events over time is most likely. The structures within these areas are subject to repetitive loss from storm surges and flooding and should be avoided and/or minimized. The second story addition is EXEMPT from LWPR CCR. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
