Box 447 Quogue, NY 11959-0447 RE: CURTIS-HARVEY REVOCABLE TRUST 220 RESERVOIR ROAD, FISHERS ISLAND SCTM#: 1000-9-8-3.4 Dear Mr. Just: The Southold Town Board of Trustees reviewed your letter dated November 29, 2023, and the survey prepared by CHA Companies, dated October 9, 2023, and had previously conducted a site visit to the above-mentioned property on August 2, 2023. The Trustees found the proposed construction of an addition of a first-floor screen porch and a second story addition onto an existing 1 % story single family dwelling to be located greater than 100' from the tidal wetlands line along Silver Eel Cove and accordingly out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no clearing, no removal of vegetation, no cut or fill of land or removal of sod, no construction, sedimentation, or disturbance of any kind may take place within 100' landward from the top of the bluff, or seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, without further application to, and written authorization from, the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. "T'owa Law 267-Ia 3I(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Although a portion of the proposed addition falls within the front yard setbacks,a majority of the addition does not. The addition is just an extension of the existing line of the house, and will not affect any nearby properties, as the addition will only be seen partly from the road. Therefore,the proposed addition will not affect the character of the neighborhood. 2. Town Law 267-b 3 b U2 . The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue,other than an area variance. Due to the location of the existing house and the shape of the property, most any addition will require variance relief. The variance granted herein is mathematically substantial, representing 29% relief from the code. However, the amount of relief lessens as the addition continues towards the rear of the house. There has already been variance relief for this same setback for a covered porch,and this proposed addition follows the line of the house and requires the same relief as the previous variance for the covered porch. 4. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law 4267- . The sizing of the Cluster System is calculated according to the most recent version of the Suffolk County Department of Health Services Division of Environmental Quality Standards forApproval of Plans and Construction for Sewage Disposal Systems for Other than Single Family Residences, dated July 21,2020. In accordance with these standards,the sanitary flow from each of the three single family residences connected to the Cluster System is calculated as 300 gallons per day. As long as the proposed 5th bedroom is to serve as an additional bedroom for single family occupancy only, no change or upgrade to the Cluster System is required. If the purpose of this addition is to create an gc &essofy dwellin unit or to reclassify the residence as a two family residence further,evaluation of the pro2osed addition will be re oared.
