Please keep in mind that we are in the middle of revamping our Sanitary Flow Credit bank and procedures to comply with SC Health Dcpt`s occd to see the scodiogpurcclhl from which sanitary flow credits are issued. TYc have been working oo this for several weeks and expect tn have it completed soon. We will, however, need a couple more weeks before we can issue a Sanitary Flow Credit certificate, which is what l believe the Health Department needs. There are many requirements in the code and we are organizing those into a clear procedure so we can process these quickly io the near future. z And we are making a map of the sending parcels so we can track their location, the receiving parcels to which they send credits and the overall balance of credits in the bank. The Health Dept needs to track the locations of sending and receiving. We will be back to Town Board with these procedures after Paul and I and Town Clerk's office have gone over them to make sure the system is feasible and we all know who will be expected to do what. At that time we will also ask the Town Board to memorialize the price of the sanitary flow credits by resolution (all agreed to $0 for affordable, and some undetermined value for commercial use). This should not hold up this project as it seems there are a few other items in the site plan application that need attention. Not huge things, but Brian can provide an overview of those to the applicant if he would like to get this moving again. These are all things we can get done so this project can get moving again. Phase 1-Conversion of the existing house to 2 affordable apartments, Phase 2-Completion of the new construction in the rear of the property. Please tell me what is needed to get site plan approval for this plan so that we can get to a building permit. You can start rehabilitation of the existing house now. All we need is a letter to the Planning Board requesting such. Check with Brian (631-765-1938) that all approvals regarding the Historic District obligations have been received. I believe that the point we reached in the past is that the planning board would not approve the site plan without full health department approval, but the health department would not provide full approval without the actual transfer of 2 sanitary flow credits to the parcel, and the town would not transfer the sanitary flow credits to the parcel without site plan approval. There must be a way for the site plan to be conditionally approved based upon the health department's existing board of review decision, subject to final health department approval once the credits are transferred. Our records show that a resolution setting the public hearing on the transfer of 15 Sanitary Flow Credits was withdrawn on SEPTEMBER 22, 2020. I recommend that you contact Councilwoman Doherty or Smith (631-765-1889) to place the resolution setting the public hearing back on. The new administration has tentatively agreed that the price is "0" for sanitary flow credits. The price is set in the resolution so there is no need to wait. We will work with you to ensure the sanitary flow credit certificate is granted so the application can receive Health Dept approval prior to final site plan approval. This may involve a conditional site plan approval. I will ask Brian what is exactly needed to receive it and will get back to you. I spoke to Councilwoman Doherty and Councilwoman Smith in a recent meeting and they assured me that the Town Board is eager to move forward on your request for credits. Additionally, here is a summary of the other open items that we discussed at the meeting that would need to be addressed: 1) Code language regarding preference for first responders being expanded to all of Suffolk County was changed in the new code section regarding the transfer tax funds, but was not changed in the AHD section of the code. This language should be consistent. We agree and this will be brought to a Code Committee meeting and changes are expected. As we discussed, it would be beneficial to designate 20 percent of the unit build to persons providing firematic protection, emergency medical or ambulance services. The Town would alert those on the list that the units are available six months before CO issuance and meet all other notice obligations. Since the parcel is zoned AHD, any units that are constructed would require a lottery system for eligible applicants. Is this a concern for your current tenants? 2)Affordable rental rates-Town Code 280-30-F "The pricing structure for rental properties must not exceed the rent limits as established by the Suffolk County Affordable Housing Opportunities Program.The Town Board may, at its discretion, impose restrictions regarding rentals." We do not use the Suffolk County Affordable Housing Opportunities Program; we use HUD — this section of the code will be discussed as a Code Committee and proposed to be struck. There are 2 issues with this language. a) I have not been able to locate the Suffolk County Affordable Housing Opportunities Program. As far as I am aware, 3 the Suffolk County programs related to affordable/workforce housing all reference HUD-established FMRs and income levels. Is it possible that this language in the town code referencing "Suffolk County Affordable Housing Opportunities Program" is no longer valid? If this is a valid program and I'm just missing it, please direct me to see where these rates are published. It is no longer valid. b) Historically the rates set by the town board each year have been equal to the published HUD-established FMRs. Even if we assume that the "rent limits as established by the Suffolk County Affordable Housing Opportunities Program" are equal to the HUD-established FMRs, the current language in the code gives the town board discretion to set rental rates at any number equal to or less than those rates. I believe that the code section needs to be changed so that the rates are set at this published benchmark, rather than left up to whim of future town boards on an annual basis. Under the existing language, a future town board could theoretically set rents at$1 per month which would obviously make it economically impossible to build units under this program. To be clear, I am not looking to change the way that the rates have been set historically, I'm only interested in making sure that the process is consistent going forward. This is necessary so that the income from the property keeps pace with inflation as the expenses will. The Planning Board can discuss with the Town Board a condition that allows the rates to increase but not fall below a certain amount or potentially change the Town code so it ties the rental rates more definitively with a benchmark and isn't open-ended. The condition could be in the Resolution and a C&R filed with Suffolk County. 3) Cost of wastewater credits-The town has never provided me with a number for the cost of purchasing wastewater credits. In the context of the town trying to support the construction of affordable units, I believe that the cost should be as close to zero as possible. They are projected to be "0". 4) Grants-What types of grants or other funds are available from Southold Town for the 2 phase plan outlined above? We are currently working on a subsidy per unit with Town funding. This is direct negotiation with the Town Board. A low interest loan is also an option as a public private partnership. The loan funding may be used for construction of a sanitary system. 5) Property tax-The property is currently taxed at the regular rate for a single family, market-rate home which is roughly $7,000 per year. Vineyard View's current property tax bill for a 50-unit completed project is$6,814. I would like to see the project taxed consistent with the way that Vineyard View is being taxed. Please speak to Kevin Webster, Tax Assessor (631-765-1937). The Town is exploring tax incentives for workforce housing units, however, we do not have the framework in place now. The zoning as Affordable Housing District could come into consideration.
