PEP seeks to carry out the Goals and Actions of their Comprehensive Conservation Management Plan (CCMP) htt s: indd.ado,be.com,lviewr 01ca273 3 `78 44ee-b907- 308ec3d4a5 in partnership with the East End Towns of Long Island.As part of their commitment to PEP,the own of Southold has agreed to contribute funds to over the next several years to the Peconic Estuary Partnership. For the 2024-2026 time frame,the Southold contribution to PEP is$66,413 annually. Purpose. The purpose of this local law is to address issues concerning the maximum size of one and two family dwellings in certain zoning districts consistent with the Southold Town Comprehensive Plan adopted September 8, 2020,the Vision Statement of which calls for future planning within the Town to be consistent with existing community character and a periodic review and amendment of the Town Code to that end. The Town Board because of objectives outlined in the plan, especially Chapter 3 Land Use and Zoning, finds it necessary to draft and adopt new code that establishes standards for the construction and reconstruction of residential dwellings in certain zoning districts. Such standards will establish maximum limits on house size based on lot size and are necessary to maintain the community character of the residential communities as called for in the Comprehensive Plan. II. Chapter 280 of the Code of the Town of Southold is hereby amended to include the underlined words and remove the struck through words as follows: 280-4 Definitions. FIYC desires to obtain authorization for the longstanding (early 1990s) sailing and training dock as well as adding new finger piers on the east side of A Dock in the most recessed part of West Harbor.There is berthing/storage for small sailboats on the surface of the float. The new finger piers are to be four wood pile retained floating wood timber fingers and wood pile and timber finger pier and all have been authorized by the Trustees in the Tidal Wetlands Permits, copy attached. According to Trustees records, the Sailing Program float was not specifically included in past permits and was thus included in the most recent permit finger pier application. The location of the Sailing Program float, built more than 30 years ago, is on the west side of Dock A where it avoids documented boulders and patches of eel grass maintaining habitat preservation standards to balance boating access for the small training sail boats with separation from the other club seasonal slips and weekend boating activities. Somehow the Sailing Program float was not documented back in the early 1990s and so its inclusion in this permit is now requested. Permits for this sailing dock retention are required from the USACE,NY DOS, NY DEC and these permits we all issued decades ago. These other agencies have either issued their permits or indicated their intent to permit minor finger pier modifications to the east side of A Dock. Permits have been applied for to the State of New York, both Department of State and Department of Environmental Conservation, to the U.S. Army Corps of Engineers, and to the Town of Southold for a Wetlands and Coastal Erosion Permit.The Town of Southold Trustees have approved the Wetlands Permit for the retention and continued use and maintenance of this large dock facility. Each one of these permit applications has acknowledged the occasional exposure of this site to adverse sea conditions and the susceptibility of the Fishers Island shoreline to erosive and damaging forces associated with agitated sea states.The respective agencies have accepted the permanent berthing location design of this sailing program float as adequate and appropriate considering these factors in every permit obtained by Docko since 2002. The DOS has indicated their intent to issue consistency determination and the USACOE their permits.The DEC Marine Habitat Protection Bureau review is underway and their permit is expected shortly. The dock facility is defined as a structure in Chapter 111 of the Town of Southold Code, Coastal Erosion Hazard Areas.The area of the pre existing Sailing Program floating dock facility exceeds 200 SF in order to accommodate day sailing training boats of 12-15 foot length and to meet the regulatory and policy requirements for habitat protection of the State, federal and local permit agencies. This dock retention and construction activity is not"unregulated"and must conform to the Coastal Erosion Hazard Area factors for consideration,notably, "being removable if they exceed 200SF." The large square Sailing Program float sections are heavy duty, difficult to haul and launch without damaging the components or destroying the integrity of the connections and the flotation billets. It is best left in place. Some of the new fingers,on the other hand, can be removable. On Wednesday,May 15,2024,the Trustees denied the application by the Fishers Island Yach Club to retain a 30+/-year old Sailing Program floating dock of 84+/-LF x12 feet wide with an 8 foot by 18LF finger at the southwesterly end and 10 foot by 30LF narrower section along the launch ramp at the northeasterly end and to install 5 fingers on the west of"A"Dock at their facility in the southwest corner of West Harbor on I Fishers Island.The Trustees stated that their denial was based on the need to be consistent with their current policies which are balanced with the NY DOS and DEC policies. The policy which is the subject in this case is that a dock facility in the Coastal Erosion Zone must be either less than 200SF in gross or it must be removable. We respectfully request to appeal the denial decision of the Trustees May 15, 2024 referencing paragraph 111-10 B because of the nature of the project and the demonstrated history of these and other docks in this club facility area,the structural stability and effectiveness of this dock facility required for the training use and the climatic and sea conditions which are experienced at this site. This requirement for a"removable" structure is contrary to proper facility design and construction for waters adjacent to Fishers Island Sound and would be detrimental to the environment and resource conservation because of repetitive disturbances of the sediments and resulting water quality, noise and benthic habitat impacts. These floating docks are essential to one of the FIYC's fundamental priorities which is to train the next generation of sailors/boaters in the art of sailing, a high priority water dependent use as defined by all of the permit authorities and laws of the State. According to the Town of Southold Code Chapter 275-11 Section 2c, The Trustees may determine the permitted dock configuration based on the geometry and dry storage, as required of each of the sailboat types as well as with other docks in the waterway. This project supports one of the highest priority water dependent uses which is the art of sailing and promises to promote the next generation of conservation minded boaters. The sailing program dock facility has existed for 30 years or more and is still actively maintained with suitable decking and hardware and stays in the water all year long. Their longstanding presence has been acknowledged by all of the respective permitting agencies since our involvement with FIYC beginning in the late 1990s over a quarter of a century. Article 34 of the New York State Environmental Conversation Law,which is the basis for the establishment of the Town of Southold Coastal Erosion Hazard Program, has been reviewed in the preparation of this document.The proposed design meets these standards including the provision of reaching water of adequate depth to minimize bottom sediment disturbances while accommodating the sailboat training program objectives and recreational uses for the finger piers. The Sailing Program floating dock is unique. The large float accommodates a small fleet of one to two dozen boats which are dry sailed to minimize the need for bottom painting and the physical wear and tear of daily or weekly launching and hauling. The new proposed fingers have been designed so that three are removable and the remaining two,totaling less than 200SF,are not.The one finger is a fixed wood pile and timber pier and cannot be reasonably seasonally removed but three of the four floating fingers can be and so that balance has been struck. There is no work associated with the sailing program float,which is merely to be retained,as is.There will be no new habitat impacts. The construction scope of work and method for the fingers has been utilized specifically to create the strength of the interconnected floating dock to preserve the floating docks against damage from waves and to preserve existing coastal features, and resources, specifically tidal wetlands grass which grows beyond the west side of the FIYC facilities. Access and staging considerations are also compatible with these two goals. The four floating fingers will be premade and delivered on the barge, launched, floated into position and fastened to the main float,then, restraint piles driven.The fixed finger pier will have four support piles. The barge to conduct the finger pier work will be relatively light in draft, approximately two to three feet. The water depth will allow the barge to approach within 50 feet of the new finger pier construction area which is the reach of the crane. The barge will not contact the bottom during the construction. The barge will be relocated after work hours,at higher tides to remain clear of the dock facilities and existing eel grass beds scattered around the project site. After work hours the barge will be moved into West Harbor. The dock facility is to be built by Gwenmor Marine;the crew are experienced in these waters and familiar with all of the permits (including this appeal) which cover the scope of work. There is no removal of soil or sediment in the proposed scope of work, and there is no alteration of the shoreline proposed. Most of Fisher's Island's waters are recognized as valuable fish habitat. The fingers will provide water column diversity and shelter for juveniles; driven restraint and support piles will maintain waterflow and circulation.Tidal wetlands vegetation at the shoreline will be unaffected by construction and usage of these docks and only minimally to not at all,by the actual physical impact of the pile driving. The existing main pier has a slightly southwesterly alignment which allows for 6 hours of direct sunlight into the water column.The new fixed finger will be built at the same height and is only 4 feet wide so that 6 hours of sunlight will reach the underlying sediments in the afternoon.Benthic shading of the fixed finger will be minimal. The main pier height was previously established at about 6 feet above Mean Low Water, for the length of the fixed pier southeasterly alignment which will allow sunlight to reach the benthos through the water column from the south side of the pier during much of the day.The new finger pier is the same height which follows the "8 foot clear of bottom" standards promoted by the seagrass coalition and NOAA NMFS. If necessary, the "Thruflow" decking can be utilized as the walking surface is a textured grate, an open grate surface, so as to allow through effectively 60% of sunlight to reach the water column and bottom sediments beneath the pier, based by studies utilized by the NYSDEC during the approval process of"Thruflow"decking for this purpose.The new fingers will accommodate 10 boats,a loss of two slips over the existing 12 slips with no net difference in shading. This project will result in no loss of waters as defined in U.S. Army Corps of Engineers General Permit Number 3, under which this project is being reviewed and the project complies with the criteria. Boat currently bath in this area using tie off lines. This construction project represents minimum encroachment into the navigational waters of the State which is already occupied by berthed boats on pulley lines and waters deep enough to minimize bottom impacts due to boat contact, pier shading and propeller drive system scour.The new finger piers basically terminate at the outer limits of the pulley tie-off line limits,an area where navigation is already limited to this purpose. There are no known dock remains or artifacts of archaeological significance.The shoreline of West Harbor has been eroding for centuries. Based on the number of rocks in the shallow inter-tidal zone and sub-tidal zone, the shoreline historically may have been out further in the distant past, however,the shoreline does not seem to have eroded to a significant extent since the 1950s when some of these docks were installed. The shoreline appears to be stable and protected from waves, especially by the sailing program float which again, is not being changed in this project; coastal erosion forces are minimal and attenuated by the club's docks. There are no known endangered species in the project area. This construction project has been determined to be compliant with new policies related to the preservation and enhancement of natural resources including tidal wetlands,shellfish and submerged aquatic vegetation. The Sailing Program floating dock has existed in this facility and its current location for more than 25 years just based on survey records complied by Docko,Inc.and it was not new when we first observed it in about 3 1999. It has weathered a dozen significant coastal storms during that period,the most significant of which was Hurricane"Sandy"which made landfall in late October of 2012 and had sustained winds for a duration of 22 hours.The east to west wave field refracted around Clay Point at the northeast quadrant of the Harbor and came directly to this facility. Clearly the facility has demonstrated its toughness and resiliency,and no changes are proposed. The new finger pier will be pile supported, with piles in bents or pairs, at 10-foot intervals. "ThruFow" (slotted plastic) or gapped timber decking will be used for the minimal 24 foot length of the pier seaward of the Mean High-Water Line."Thruflow"decking is not required for this location and has not been utilized for any of the existing piers at this site."Thruflow"decking, if utilized in this project, will have two minor benefits;allow sunlight to pass through the decking and into the water column and by providing relief from hydrostatic (wave) forces to maximize pier resilience and minimize wave uplift forces which sometimes damage piers. Three of these float finger piers will be hinged for removal seasonally and the fourth will be fixed to the main float to improve its roll stability, all in accordance with the CEZ Regulations. The proposed dock site is the best option available at this shoreline because these are supplements to the existing dock facilities.The remaining shoreline is even more heavily obstructed by boulders or hosts tidal wetlands or SAV growth areas.The survey which makes the basis for the application drawings is accurate. The actual boulder locations were surveyed and plotted, as were the limits of the tidal wetlands grass, so that the pier and tie off pile locations are established and reproduceable in the field using standard survey techniques which will be done at the time of layout work by the surveyor. Embedded stone in the benthos is to remain,as normally requested by the DEC. This will maintain existing benthic habitat as is.The total area of pile contact with the bottom sediments will be less than 1 OSF in total where the piles are driven. The Trustees have agreed, in their approval of the Tidal Wetlands Permit,that the length and configuration of this dock facility are appropriate to reach appropriately deep water within the confines of the dock facilities and that this project is suitability designed for and consistent with their tidal wetlands permitting standards of the LWRP once the 200SF requirement is addressed,as requested in this appeal. Structural Considerations: In accordance with the policies of the National Marine Fisheries Service, piles will be wood, 12 inches in diameter or less at the point of contact with the water, and no larger. It is anticipated that these piles will be Class B pressure treated Southern Yellow Pine. The New York State Department of Environmental Conservation conducted an extensive study in 2000 and determined that such piles are recognized as essential to the long-term structural stability of marine structures and has indicated that the environmental impacts of such treated piles are minimal and thus consistent with DEC environmental policy. This DEC document is on file with the Trustees office. The structure will be fastened together a single one inch or with double 3/a inch bolts at each pile bent,split cap and cross brace, each of which will be 4x10 timbers. This will be stout structure for these site characteristics. The decking will be supported with 3 x 10 stringers at 16-inch centers suitable for wood decking,or if required by the"ThruFlow"decking.The outside stringer will be bolted to the piles.Decking will be screwed down with two screws per stringer(8 screws per 4-foot-wide deck piece). With regard to structural integrity,the 12-inch piles will be driven to a depth of 10 to 15 feet of embedment, with a bearing capacity of 20 tons, and a pull-out resistance of 10 tons for each pile. The deck elevation will keep the bulk of the structure above the wave high energy zone for standard conditions of high tide, 4 plus one-foot storm surge, plus three-foot waves. In cases of severe coastal storms and hurricanes, there are more significant(three foot)surge tides and the fixed pier deck will be below most of the wave energy. The strength of each bolted connection of timbers to the pile is in excess of a ton. Therefore,the total uplift force exerted on the decking and the framing should be well within the capacity of each of the bolted connections. The Blizzard of `78, Hurricane Gloria in 1985, Hurricane Bob and the Halloween Storm (Perfect Storm) in 1992, Hurricane Floyd in 1999, Hurricane Irene in 2011 and Hurricane Sandy in 2012, nor'easters in March/April of 2018 and the Christmas and Thanksgiving storms of 2022 and 2023 give testament to the appropriateness of these historic dock building standards we have utilized. Turbidity will be minimal. The bottom sediments are silty, sandy gravel with stone and rock and the area of contact of the piles is approximately 3/4 of a square foot per pile. This results in a bottom sediment impact area of less than 10 square feet seaward of the Mean High-Water Line for this proposed structures based on pile contact area. Barge operations will be kept to daily high tides. The whole project will take two to three days. �:��rtlarderr r C�crr°rle�rr: Chapter I I I of the Town Code requires that a dock facility over 200 SF be removable. In order to make a fixed pier dock removable it must be built of fairly lightweight materials with minimal embedment which can be removed seasonally or in advance of danger, and yet firmly founded and fastened so as to provide stable support even considering berthing forces and incessant rhythmic loading due to wind and wave.The 200SF removable parameters can be accommodated in protected bays and estuaries such as Gardner's Bay, Long Beach Bay and Orient Harbor. Long Island Sound and Fishers Island Sound, however, are not mentioned in Section 111-5 A, and rightfully so. These are open waters which frequently experience developed waves of considerable size and energy induced by strong winds, or considerable fetch of 10 to a hundred miles or storms coming from the Atlantic Ocean and shoreward water bodies of Block Island and Long Island Sounds. These conditions are rarely seen in the Peconic Bay and Shelter Harbor embayments which are specifically referenced in Chapter 11 l; it is clear that this reference was not intended to cover the higher energy water surface conditions of Fishers Island Sound. Deep driven piles for support, and their bracing elements,are essential components for this exposure.Piles driven to 6,7 or 8 foot embedment can be pulled up by significant repetitive storm driven waves and so piles in this exposure must be driven deep and therefore they must be tough enough to handle the driving forces of installation by high impact energy hammers, the resistance to deformation caused by subsurface rocks andboulders, and resistance to pulling out. These very attributes make removal infeasible. Even if it was feasible,repetitive pile driving and extraction would decrease the subsurface support capability of the sediments and render the structure more likely to be pulled out by waves or otherwise damaged.In order to make the pier less susceptible to damage in severe storm conditions of the surge tide and waves, the pier height will be kept as low as practical and permittable so that these worst-case storm conditions will have their most damaging energy over the top of the pier rather than striking the pier directly. To have to make this pier removable would not be environmentally, physically or economically appropriate; this is the hardship created by Chapter 111. Other Permit Requiremeyotv: A pre-construction notice will be issued in accordance with each of the respective permits. It is anticipated that work will be avoided between March 1st and June 30th of next year, in accordance with standard permitting conditions for fish spawning as noted in the record of their May 15,2024 decision. 5 This project conforms to all existing agency terms and conditions for construction and maintenance of a dock facility structure. It also accommodates stated preferences of permitting agencies, including the NY DEC, NY DOS, USACE and the Town Trustees. Trustees Tidal Wetlands Permit No. 10167 has been received and is attached and the Trustees fully supported our pursuit of this appeal. Summary: The emphasis of Chapter I I I is to regulate development activities and to implement standards which will help to minimize and prevent damage to natural protective physical site features as well as manmade structures from coastal flooding and erosion and to protect natural resources and human lives. These and nearby dock facilities built to these same standards stated above have withstood the test of time and, in the case of the half dozen piers along the east shore of the Harbor and a dozen or so along the south shore west to the yacht club facilities which have existed for years,if not decades.The finger piers proposed as protected by the most frequent adverse climatic forces and will continue to do so. The small piers will have attributes which will help to maintain environmental quality in general. The Town Trustees have issued the Wetland permit for this new floating dock and finger pier construction project acknowledging structure attributes required for this exposed site and high priority water dependent uses offered by the Yach Club facilities while preserving and protecting the environmental resources at the site and how the resources will not be adversely affected and thus benefit from the design features and materials specified for use in the construction. This section 111-10 B appeal request is based on the factors for consideration in section 111-9: A:The pier construction project is reasonable and necessary for boating access beyond the intertidal field.The structure design has been minimized and will be suitably stout or removable and environmentally appropriate in view of resource protection standards applicable to these site conditions.The Sailing Program float has existed without storm damage and been maintained for more than a quarter century. B: The structure will not cause erosion at the yacht club's property or at adjacent properties. This project is suitably designed for the "nearshore" site in accordance with section I I IA I and there is no excavation,dredging or fill proposed. C: The new finger pier features of 6 foot pier height, narrow piers and floats and use of '/2 inch gaps for decking will help to maintain environmental and habitat quality of the intertidal and shallow subtidal zone waters and sediments in accordance with current State, Federal and Town standards for approval. The use of piles for support maintains fairly bright conditions to the bottom sediments and will also maintain water flow and circulation. The decking will not focus rainfall runoff in a manner which might induce erosion. It is agreed by the permitting agencies that these features will not significantly degrade or adversely impact the environment and habitat quality of the Harbor.The dock approach/berthing restraint piles for the facilities protect bottom sediment characteristics accounting for avoidance of the eel grass with pile locations as well as directing approach and departure routing by alignment. This project complies with the provisions of the US Army Corps of Engineers, NY DEC, and NY DOS programmatic standards as well as the requirements of the Town's Tidal Wetlands Law and support of this appeal was voiced by the Trustees in their May 15, 2024 meeting. The existing Sailing Program floating dock is larger than 200 SF but is not any larger than necessary for existing training programs,not requiring any structural or restraint changes, and it has existed at this site and has been documented in permitting drawings for the past 22 years with no change in benthic characteristics or quality.It has demonstrated safe and secure accommodations for a very high priority water dependent use for more than a quarter of a century and is appropriately sized to accommodate the sea conditions of the site and the demands of the young 6 sailors who train from it each year. This'dock facility should be recognized as being in acceptable with the Coastal Erosion Zone permitting program policies based on its longstanding history of structural integrity which was the basis of the Coastal Erosion Zone regulations. The permanent fingers, one floating and one fixed, pile supported, represent less than 200SF of permanent structure in accordance with the regulation, and these remaining floating fingers will be seasonally removable as required by the regulations. In order to be in compliance with the codified regulations and recommended best management practices in these site conditions,the entire structure cannot be removeable.
