OF AP'PL1C IION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's January 12, 2024, Notice of Disapproval based roan an application for a permit to legalize an "as built" roofed over on grade patio addition attached to an existing single-family dwelling„ at; 1) Located less than the code required minimum rear yard setback of 35 feet; located at:60 Gage'ns Landing Road,Southold,Peconic,NY, SCT'M No. 1000-70-10-16. RELIEF REQUL—STE: The applicant requests a variance to legalize an "as built" roofed over on-grade patio addition attached to an existing single-family dwelling with a rear yard setback of 27.6 feet,where town code requires a minimum rear yard setback of 35 feet. ADDITIt NAL INFORM ATIQ1 L The applicant testified that the new covered patio was built to replace an old aluminum roof that previously existed on the rear of the house. However, without a survey, it is impossible to tell if the old aluminum structure had a pre-existing non-conforming rear yard setback similar to what the applicant is applying for in this application. Page 2,April 18,2024 #7895, Vella SCTM No. 1000-70-10-16 A Stop Work Order was issued April 7, 2023 to the property owner for work being done without first obtaining a Building Permit. The neighbor residing on the property adjacent to the applicant's rear yard wrote a letter of support for the application. FINDINGS OF FACT/ REASQNS FQR 130ARD ACTION:, The Zoning Board of Appeals field a public hearing on this application on April 4,2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 267-b(3lib)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a residential neighborhood consisting of single-family homes. Covered patios are common in residential neighborhoods. The construction of a new covered patio in the rear will not have any visual impact on the street or adjacent properties because the rear yard is totally screened by a high solid vinyl fence and very large evergreens on the neighbor property abutting the fence and the. house blocks the structure for the street view.Therefore,there will be no change in the character of the neighborhood, 2. Town Law 4267-lb(l)(b)(21. The benefit sought by the applicant can be achieved by some method, feasible for the applicant to,pursue, other than an area variance. The existing rear yard setback of the dwelling is 42.3 feet. The applicant could build a 7.3 feet long covered patio off the rear of the house and conform to code. 3. Town Law §267-b(31(b)(3). The variance granted herein is mathematically substantial, representing 21%relief from the code. However, the property line has substantial vegetative screening and the covered patio is an open-air structure that will not be enclosed. 4. Town Law §267-bL3)Lb)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law§267-bQAb)(5). The difficulty has been self-created. The applicant started the work without applying for a building permit. 6. Town Law §267-b Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a covered patio while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Dantes,seconded by Member Planamento,and duly carried, to GRANT the variance as applied for, and shown on the Architectural plans by Alexander Kahn, Architect, Sheets labeled Site Plan, Al, A2, & A3, dated October 17, 2023. SUBJECT TO THE FOLLOWING CONDITIONS: 1.
