NAPPA, COUNCILMAN 20 21 22 23 24 25 FEBRUARY 28, 2023 REGULAR MEETING 2 1 SOUTHVIEW CUSTOM HOMES TWO, INC 2 That pursuant to the provisions of 3 Chapter 185 ( Open Space Preservation) 4 and Chapter 17 ( Community Preservation 5 Fund) of the Town Code , the Town Board 6 of the Town of Southold hereby sets 7 Tuesday, February 28 , 2023 , at 4 : 30 8 p .m. , Southold Town Hall , 53095 Main 9 Road, Southold, New York as the time and 10 place for a public hearing for the 11 purchase of property from Southview 12 Custom Homes Two , Inc . Said property is 13 identified as SCTM *1000- 87 . -5-21 . 7 and 14 87 . -5-21 . 9 , 21 . 10 , 21 . 11 , 21 . 12 , 21 . 13 . 15 The address of the property is 9230 , 16 9293 and no number Main Bayview Road, 17 Southold . The property is located within 18 the Agricultural-Conservation (A-C ) 19 zoning district . The proposed 20 acquisition is for the Town of Southold 21 to acquire fee title to the entire 22 combined property, totaling 23 approximately 14 . 54 acres , for open 24 space preservation . The exact area of 25 the purchase is subject to survey, The FEBRUARY 28, 2023 REGULAR MEETING 3 1 purchase price for the combined 14 . 54± 2 acre parcel is $2 , 195, 000 , plus 3 acquisition costs associated with the 4 purchase of this property . The purchase 5 will be funded by the Town ' s Community 6 Preservation Fund . The property is 7 listed on the Town ' s Community 8 Preservation Project Plan as property 9 that should be preserved for open space 10 and the preservation of fresh and salt 11 water wetlands . The purpose of this 12 acquisition is for open space, passive 13 recreational purposes , and wetland 14 protection . Proposed uses of the 15 property may include the establishment 16 of a nature preserve, wetland 17 restoration and passive recreational 18 area with trails and limited parking for 19 access purposes , all subject to a 20 Management Plan which will be developed 21 for this property . The Land Preservation 22 Coordinator has reviewed the acquisition 23 in accordance with Chapter 117 ( Transfer 24 of Sanitary Flow Credits ) of the Code of 25 the Town of Southold . Seventeen point FEBRUARY 28, 2023 REGULAR MEETING 4 1 two ( 17 . 2 ) Sanitary Flow Credits may be 2 available for transfer from the property 3 upon the Town ' s purchase of the 4 property . The transfer of the Sanitary 5 Flow Credits will not be finalized, and 6 shall not occur, until the Town closes 7 on the property, and the Town Board 8 passes a resolution allowing the 9 transfer of such credits into the Town 10 sanitary flow credit ( SFC ) bank . 11 SUPERVISOR SCOTT RUSSELL : Would 12 anybody like to address the Town Board? 13 MS . MELISSA SPIRO : Hi , I am 14 Melissa Spiro . Land Preservation 15 consultant . I apologize . There was 16 some technical difficulties and we can ' t 17 get the map on Zoom . So it ' s just the 18 map up here . As stated in the Public 19 Hearing notice, this is for an open 20 space acquisition using community 21 preservation funds . The property is on 22 Hogs Neck, off Main Bayview in Southold . 23 For those of you that can see the map, 24 the property is outlined in red . The 25 current property shows six tax parcels FEBRUARY 28, 2023 REGULAR MEETING 5 1 and the acquisition is including all of 2 the tax parcels . The property fronts on 3 Corey Creek and is in close proximity to 4 many protected properties . The yellow 5 property on the map comprises of two 6 different property positions that is 7 totaling 52 acres with significant 8 frontage on creek that were acquired 9 jointly by the Town and open space . It 10 enhances the existing preserved lands . 11 Not only for protecting the creek 12 frontage but also irrespective, the 13 property is also visible when you look 14 at Corey Creek from our preserved land . 15 Southview Custom Homes is also in close 16 proximity to another 52 acres that are 17 comprised with preserved by Peconic Land 18 Trust . They are known as Wolf Preserve 19 and Reese Preserve, and they are labeled 20 in white . There are many other 21 preserved lands , but for the people that 22 can ' t see them, I can describe them all . 23 In addition to fronting on Corey Creek, 24 a significant amount of marsh lands and 25 wetlands are on this property for FEBRUARY 28, 2023 REGULAR MEETING 6 1 protection of the shoreline . It has 2 been included as a potential project for 3 restoration funding from the Peconic 4 Estuary partnership restoration . So 5 that is a good thing . I have been 6 involved one way or another for my 7 career here with the Town of Southold 8 for this property . For the 80 ' s and 9 90 ' s , it was owned by a man named Jim 10 ( inaudible ) . As a planner working in 11 the Planning Department in the 90 ' s , I 12 spent a lot of time with Mr . 13 ( Inaudible ) . He was trying to move 14 lines around and trying to subdivide and 15 re-subdivided the property over the 16 years . And then I was working in the 17 Land Preservation Department . When the 18 property was on the market, there was 19 several efforts to try and purchase and 20 preserve the property by the County, by 21 the Peconic Land Trust and trying to et 22 funding from New York State DEC . These 23 efforts by all these entities show the 24 significant preservation of this 25 property . Last year, Town Board members FEBRUARY 28, 2023 REGULAR MEETING 7 1 asked me to reach out to the land owners 2 and we were thankful that the land 3 owners were then ready to sell to the 4 Town and we ' re where we are today . The 5 Land Preservation Committees supports 6 this purchase and they recommend that 7 the Town Board proceed . As I mentioned 8 earlier, I am participating here as a 9 consultant . The Town has recently hired 10 Lily McCullough . She is here next to me 11 today to lead the Land Preservation 12 Department . Today is her first day . So 13 I didn ' t want to make her get up here 14 and do this . This is likely to be my 15 last time before the Town Board . And 16 for me, it ' s really significant that I 17 am here for this significant project . I 18 am happy to be here today for this 19 project that I have come across multiple 20 times and also always been a goal here . 21 I also thank the land owners and the 22 Town for preserving this property and I 23 do recommend the Town Board proceed with 24 it . And I am here to answer any 25 questions you may have . Thank you . JESSICA MICHAELIS : I am 4 Jessica Michaelis , Planning Department . 5 Also on behalf of Town of Southold CSEA. 6 Joe is not feeling well tonight . So 7 unfortunately he cannot be here . So I 8 have prepared a little something . Thank 9 you for the opportunity to speak . I am 10 here on behalf of the Town of Southold 11 CSEA . Many of us couldn ' t make it as 12 planned . A lot of the Highway guys , I 13 am sure you guys know, have been -- just 14 got home from a 16- 17 hour shift . They 15 kept the roads clear throughout the 16 night, throughout Southold Town . Clear 17 for us to be here tonight , at work . 18 Clear for emergency services to be able 19 to reach residents in an emergency . 20 Clear for the services for our kids and 21 community to be able to go to school . I 22 would like to thank them and show my 23 appreciation to them for the work that 24 they do . And I am here tonight to not 25 only ask for a fair contract for me, but FEBRUARY 28, 2023 REGULAR MEETING 10 1 to ask for a fair contract for them. 2 Before I finish, I just want to add one 3 thing . One of our recent supporters 4 spoke at the last membership meeting 5 last week . And they told us how well 6 kept the building was , the meeting was 7 in . How well kept Town Hall was when 8 they came for our showings in front of 9 you . And they even took a ride through 10 the Highway yard and complemented how 11 nice the trucks were parked . How well 12 things were organized and it really, 13 really nice shape . For this compliment, 14 I feel that it shows that the CSEA union 15 members care about the work that they do 16 respect the work that they do for the 17 Town . And I ask that you do the same . 18 Thank you . 19 SUPERVISOR SCOTT RUSSELL : Thank 20 you . 21 MR . JERRY LARICCHIUTA: Good 22 evening, Supervisor Russell and Board, 23 Honorary Board . I just want to say that 24 we have bene here for a few times -- 25 SUPERVISOR SCOTT RUSSELL : Please FEBRUARY 28, 2023 REGULAR MEETING 11 1 state your name and representation -- 2 MR . JERRY LARICCHIUTA: Jerry 3 Laricchiuta . I am CSEA Long Island 4 Regional I Vice President at 46 , 000 5 members . From Montauk to Queens . We 6 are the largest public service union in 7 New York State . And in fact , I was just 8 up in Albany . I drove him in that snow 9 last night . But one of the things I 10 learned while I was up there , we have 11 been doing a lot of research to make 12 sure when we come to this Board, I don ' t 13 come up here to talk a bunch of 14 nonsense . People are coming to the 15 realization that it ' s time that we start 16 paying the workers that they deserve . 17 Contract talks have been going on for a 18 while . ' 17 and ' 18 . COVID hit the ' 19 19 and that was a nightmare . And this 20 union, statewide understood that . And 21 we did . We did concessionary agreements 22 throughout the State . It wasn ' t just 23 Long Island . From Buffalo all the way 24 down the strip of Long Island Region I . 25 The time has come now . I have to tell FEBRUARY 28, 2023 REGULAR MEETING 12 1 you, the average raise that is coming 2 across from Buffalo , all the way down to 3 here , is over 3 percentage points per 4 year . In fact, the State contract which 5 is usually -- we don ' t usually brag 6 about too much, that 13% raise over 4 7 years . That is the New York State 8 workers . And I am so proud for that . 9 They deserve it . Those are the guys 10 that are out there all year long in the 11 winter . They are out plowing Buffalo , 12 all the way to Region V, IV. Capital 13 District . All night long . We finally 14 got the pay -- the recognition that they 15 deserve . Supervisor Russell , before I 16 go any further, I understand we asked 17 you not to kick the can down the road 18 and call for mediation, but we did have 19 a mediation anyway . We had a mediation 20 on February 15th . CSEA gave it ' s final 21 offer on the table . And we were 22 expecting some results from that . For 23 some reason, and it ' s not acceptable, 24 the next meeting mediation is not going 25 to be heard until March 16th . Have you FEBRUARY 28, 2023 REGULAR MEETING 13 1 discussed the terms of what ' s going on 2 the table with the Board? 3 SUPERVISOR SCOTT RUSSELL : Yes . 4 Actually, I am not going to negotiate 5 the contract in public but the 6 discussions are going well . Mediation, 7 I will stand by it . 8 MR . JERRY LARICCHIUTA: Well , I can 9 tell you a couple of facts that I know . 10 And this is very reprehensible in my 11 opinion . It ' s been over 10 years -- for 12 the last 10 years , the average raise in 13 this township is less than 20 . Not hit 14 20 in the last years . Now that is not 15 negotiating in the public . That is a 16 fact and putting it right in front of 17 your face to see and say this is 18 unacceptable, because going through the 19 COVID, okay . But to add to that, no 20 difference . Now we come to this time 21 where townships , cities and county ' s are 22 now recognizing that and saying, hey, we 23 need to recognize our workers and start 24 paying them. We just heard some great 25 propositions here about open space . You FEBRUARY 28, 2023 REGULAR MEETING 14 1 have a wonderful town here . Everyone 2 does a great job . You guys were out 3 there last night , all night long . You 4 have a -- they ' re out there breaking 5 their chops and making sure that the 6 work of the township gets done to keep 7 it safe for the residents . To keep it 8 looking good for the residents . And yet 9 I can ' t get you to agree to a fair 10 contract and I don ' t -- and I disagree 11 with you totally . If you call what 12 happened at that February 15th 13 mediation, good, then we need to have a 14 discussion on what the hell "good, " is 15 because that is not good . You know, we 16 have people here tonight from the Town 17 of Hempstead, from Long Beach, from 18 Riverhead, Nassau County . I know I am 19 missing a few . But these folks came out 20 here to show for some reason Southold 21 sticks out like a sore thumb . And the 22 reason is , because your workers feel 23 disrespected . And you ' re going to 24 continue to kick the can down the road 25 by going to March 16th . That is just FEBRUARY 28, 2023 REGULAR MEETING 15 1 another mediation hearing . So this can 2 go on forever . We know that . The offer 3 that we made on the 15th, I am told by 4 our union and -- that was CSEA ' s final 5 offer . So we need to get down and see, 6 are we serious about getting this done 7 or are we just keep doing this because I 8 don ' t want to keep doing this quite 9 frankly, but I got to be honest with 10 you, it ' s getting -- disrespectful is 11 being kind about it . You know, really, 12 it ' s not just disrespectful to the union 13 but more importantly to your members . 14 And to your residents to a certain 15 extent . I got to tell you, they ' re not 16 happy with the fact that in today ' s 17 time , living on Long Island, you can ' t 18 get a 20 raise for over 10 years from a 19 Township that is doing pretty well . 20 They have a healthy budget . God bless 21 you . You ' re doing a good job . They 22 brought it up at the last meeting, 23 Supervisor, 340 over the past 10 years 24 for yourself . We don ' t begrudge you for 25 that . You work hard . That is 40 over FEBRUARY 28, 2023 REGULAR MEETING 16 1 the 10 years . That is 3 . 40 . I can ' t 2 get a 20 out of this Town . So I don ' t 3 know what else to say to you other than, 4 this is just a small sample . We ' re 5 going to have to come back out here 6 again, and this is the last thing that 7 we wanted to do but we don ' t seem like 8 we ' re getting anyone else ' s attention 9 from this Board or especially this -- 10 you, who oversee all of this thing . 11 Unless you want to make an amendment to 12 your agenda tonight and call for a 13 review of what was negotiated and see if 14 we can finish this , because I think -- 15 you said it was good . Closer I would 16 say, but not good . That can stay this 17 way for a long time . So you ' re saying 18 that you ' re not going to negotiate in 19 public . I get it . I heard that a 20 million times . But I have also felt 21 with supervisors , for some reason you 22 feel it ' s important to keep the numbers 23 down when it ' s not even justified . When 24 it ' s justified -- we have agreed when 25 it ' s justified during COVID . During the FEBRUARY 28, 2023 REGULAR MEETING 17 1 recession when money is tight . There is 2 no reason for that now . When I have the 3 average raise in New York State , the 4 average raise over 3% a year -- so you 5 have no excuse other than just don ' t 6 care . You don ' t want to do it . You 7 just don ' t have any respect for these 8 members , your workers or my members . 9 And you ' re going to continue to play 10 hard ball because I am here and now 11 we ' re going to butt heads and this union 12 showed this loud mouth up . You ' re not 13 going to shut me up . I am trying to be 14 respectful as possible , but I am looking 15 at a man that is not showing respect 16 back . I am looking at a man that is 17 showing content back . And content not 18 for me but for the people in this room 19 and the people that work for you . You 20 know, Southold is getting a reputation . 21 I told you . Great place to work . Great 22 place to come and visit . But let me 23 take the first one back . Great place to 24 work where it doesn ' t respect its 25 workforce and doesn ' t pay a fair wage . FEBRUARY 28, 2023 REGULAR MEETING 18 1 And I don ' t think you want that . So I 2 leave you at that . I am not going to go 3 any more into this . And you ' re going to 4 see us again . We got the truck from 5 Nassau County . We got the people from 6 Long Beach here . A good amount too . 7 Those are the things that will happen . 8 You ' re not seeing that anywhere in the 9 state except for here . Honestly, I am 10 part of CSEA. I am 100 of CSEA 11 corporation as a region president . I 12 know what the numbers are across the 13 State . You ' re not making it . Then the 14 whole kicking the can down the road . 15 Let ' s go to mediation . Let ' s go to 16 mediation . That is going to last 17 another six months , year . And I don ' t 18 know what the outcome is going to be . 19 So I am asking you, make me look stupid . 20 Make me look foolish . Come back with a 21 fair contract . These guys -- these 22 ladies that work hard every day . They 23 make you look good . They make the 24 township look good . So I got to tell 25 you, do the right thing . I got to ask FEBRUARY 28, 2023 REGULAR MEETING 19 1 you, do the right thing and let ' s get 2 this done . So I don ' t have to come out 3 here again . Thank you . 4 SUPERVISOR SCOTT RUSSELL : Who else 5 would like to address the Town Board on 6 any issue? You just have to state your 7 name for the record . 8 MR . ROBERT BOLGANTE : Robert 9 Bolgante, Town of Hemsptead, Local 880 . 10 I am showing off to the lady on the 11 screen over there too . It ' s nice to see 12 how you treat the workers here, talking 13 to them nicely and everything . Where we 14 are, it ' s not like that . We have a much 15 more adversarial relationship with our 16 supervisor and our Board . Not that we 17 mind . We ' re strong there . We are the 18 largest municipality in the country . 19 This place looks so strange to us means 20 you have not seen us here before . 21 You ' ll be seeing us again . We ' re good 22 at things like this . ( Inaudible ) was the 23 supervisor in Hempstead, you can look up 24 and see what we did to her . Goodness , 25 we destroyed that poor woman ' s life . FEBRUARY 28, 2023 REGULAR MEETING 20 1 Just know that we will be back and that 2 this is serious to us . This kind of 3 stuff . 4 SUPERVISOR SCOTT RUSSELL : Let me 5 ask, were you required to work during 6 the shutdown? I don ' t know what job you 7 work during the Town of Hempstead, which 8 by the way, I am from Hempstead . Were 9 you required to work? Because a lot of 10 the people that are from the Local CSEA 11 were required to work during the COVID 12 shutdown . We actually passed a policy, 13 that not only did we continue to pay to 14 work, we paid them an additional day for 15 every date we work . We gave out 17 , 000 16 hours of Comp time . So a tax payer cost 17 of $ 698 , 000 . That is not -- 18 MR . ROBERT BOLGANTE : We wrote the 19 book on that . 20 SUPERVISOR SCOTT RUSSELL : No . We 21 had no contract obligation of -- we did 22 that to be fair . $ 698 , 000 in Southold, 23 it isn ' t chump change . We have a very 24 small budget out here . To be fair, that 25 is not a lack of respect . It was a FEBRUARY 28, 2023 REGULAR MEETING 21 1 voluntary act on our part and our Board 2 for the people that were out there 3 working hard on line during the height 4 of COVID . And again, let me suggest 5 again, they not only earned their 6 salary, they earned twice their salary . 7 There were people losing their jobs and 8 losing a lot of things . That is 9 respect . We tried to do the best we 10 could . 11 MR . ROBERT BOLGANTE : Regardless 12 with all due respect, it is 13 disrespectful . 14 SUPERVISOR SCOTT RUSSELL : I 15 disagree . 16 MR . ROBERT BOLGANTE : To not give 17 them the proper wages that they deserve . 18 I don ' t mean to be adversarial . I am 19 not from here . 20 SUPERVISOR SCOTT RUSSELL : That is 21 what contract negotiations are about . 22 And mediation went well . And again, I 23 am not going to negotiate a contract, 24 but by all accounts , besides -- the 25 conversations were going well . That is FEBRUARY 28, 2023 REGULAR MEETING 22 1 what mediation does . 2 MR . ROBERT BOLGANTE : We hope that 3 is the case . Have a good day . 4 SUPERVISOR SCOTT RUSSELL : Thank 5 you . 6 MS . The money that was 9 paid our during COVID, did that not get 10 reimbursed through -- 11 SUPERVISOR SCOTT RUSSELL : No . No . 12 There was no reimbursement for the 13 salaries that were paid . It wasn ' t 14 reimbursed . 15 MR . FELIX SANDINO : Hello . My name 16 is Felix Sandino . I work for the Town 17 of Southampton . I work for the Highway 18 Department out there . I am a little 19 disappointed myself hearing this . We 20 got a 2 . 5% raise and we also got what 21 you just said for COVID . We got days 22 paid also . I don ' t understand how that 23 can be . We got the same thing and we 24 got paid one day out and one day here . 25 We still got the 2 . 50 . So I don ' t even FEBRUARY 28, 2023 REGULAR MEETING 23 1 understand, they not even got 2 . We got 2 2 . 50 . People say, you guys have money . 3 You got money also . 4 SUPERVISOR SCOTT RUSSELL : I didn ' t 5 say that . 6 MR . FELIX SANDINO : My thing is 7 this . I worked 19 hours and I am here . 8 19 hours , haven ' t slept and I am here 9 supporting these guys because just as I 10 work hard for my Town, I represent the 11 Town, like a person like yourself, look 12 good in the papers and shine . I think 13 they deserve it because they work hard . 14 Thank you . 15 SUPERVISOR SCOTT RUSSELL : Who else 16 would like to address the Town Board? 17 MR . BROWN : ( Inaudible ) Brown . One 18 first Vice President of the Town of 19 Oyster Bay President . Talk about COVID . 20 Not laying anybody off . I do agree with 21 Hempstead back there . They were the 22 originators . Working through COVID . 23 Making sure they kept their jobs . We 24 followed that lead . Not only did we 25 follow that lead, we also knew it was FEBRUARY 28, 2023 REGULAR MEETING 24 1 COVID money returned back to us as 2 members . We were able to negotiate in 3 our contract for our members . Where we 4 did something differently and unique and 5 we gave them more than they ever saw in 6 their life in their contract . What I am 7 saying to you, Supervisor Russell , at 8 the end of the day, and with all due 9 respect , the way that the mediation 10 started was disrespectful to come back 11 with the same proposal you gave when we 12 actually started . 1 . 5 was unbelievable 13 unacceptable . Can ' t take care of our 14 families . Can ' t do what we got to do 15 with our families and our household . We 16 need more . We deserve more . They work 17 hard for you . Okay . They appreciate 18 what you give them, but at the end of 19 the day, when they ' re seeing lower 20 raises and lower percent raises , it 21 doesn ' t feel very well , they going to be 22 able to go home and take care of their 23 families . When they got 2 , 3 , 4 jobs , 24 it ' s almost impossible to keep doing 25 that . They ' re not here tonight because FEBRUARY 28, 2023 REGULAR MEETING 25 1 they ' re working for this administration . 2 Yes , they got paid for it . Every one is 3 paying at some point . We understand 4 what you guys go through . It doesn ' t 5 make sense what we ' re fighting for small 6 increments . All right . Let ' s be fair . 7 Let ' s be forward . We want a fair 8 contract and we want it now . No reason 9 to go to March 16th . There is no reason 10 to push this down the road . You heard 11 our proposal . We heard your proposals . 12 For 7 hours in that room. And we went 13 back and forth and back and forth for a 14 membership that has earned it, that has 15 deserved it . You know that . I know 16 that . I negotiate all of Long Island . 17 It is now unacceptable . March 16th, 18 that day needs to be thrown in the 19 garbage , it should be today right now 20 telling us you agree to our last 21 proposal . It ' s not a threat . It ' s not 22 a warning .
