Sawicki Southold Town Board of Appeals MAIN ROAD- STATE ROAD 25 SDIJTHDLD, L.I., N.Y. 11971 TELEPHONE (516] 765-1809 MINUTES SPECIAL MEETING HELD FEBRUARY 24, 1981 A Special Meeting of the Southold Town Board of Appeals was held on Tuesday, February 24, 1981 at 4:00 o clock p.m. at the Southold Town Hall, Main Road, Southold, New York 11971. Present were: Charles Grigonis, Jr., Chairman; Douglass; Gerard P. Goehringer; Joseph H. Sawicki. was: Serge Doyen, Jr. (Fishers Island). Robert J. Absent PENDING APPLICATION: Appeal No. FA-5. Goldsmith Building and Construction, Inc. (for George and Jane Sweeney). WHEREAS, on February 12, 1981 this Board referred applicants to the N.Y.S. Department of Environmental Conservation for their consideration inasmuch as the property in question is waterfront property without a substantial or function seawall or bulkhead; and WHEREAS, on February 19, 1981 this Board has received a written response from the N.Y.S. Department of Environmental Conservation, Regulatory Affairs Unit, indicating that no permit is necessary under Article 25 of the Tidal Wetlands Act for the project proposed in the within application; and WHEREAS, applicant(s) have submitted an environmental assess- ment in the short form which indicates that no adverse effects were likely to occur to the environment if the project is imple- mented as planned herein; On motion by Mr. Goehringer, seconded by Mr. Grigonis, NOW, THEREFORE, be it RESOLVED, that in.Appeal No. FA-5, application of Goldsmith Building and Constr~ction, Inc. for George and Jane P. Sweeney for a Variance to the Flood Damage Prevention Law of the Town of Southold, Sections 46-5 and 46-7, to alter existing structure by more than 50% of the market value of the existing structure located at Mason Drive, Cutchogue, New York, this Board determines that this project if imolemented as planned Page 2 Southold Town Board of Appeals February 24, 1981 Special Meeting herein is classified as a Type II Action, not having a significant effect upon the environment; and pursuant to the N.Y.S. Environ- mental Quality Review Act (SEQRA), Sections 617.13 and 617.5(a), and the Southold Town Code, Section 44-4, no further determination or procedure is required by this department concerning the SEQRA standards of process. [This declaration should not be considered a determination made for any other department or agency which may also be involved, or any other project not covered by the within application.] Vote of the Board: Ayes: Messrs. Grigonis, Douglass, Goeh- ringer and Sawicki. Absent was: M.r. Doyen. Re: Appeal No. 2729. Nanc~ J. Rodillo & William Mercurio, et al. The Board acknowledged receipt of certified surveys mapped February 6, 1981. Upon reviewing the surveys, it was noted that the setbacksdistances to property lines were not shown for the proposed locations of the two houses if the variance were granted, and the Board again requested same, prior to making a decision on this matter. Being there was no further business to come before the Board at this time, the Chairman made a motion, seconded by Mr. Sawicki, to declare the meeting closed. The motion was duly carried.
