McGinn o: 631.427.5665 smcginn@nelsonpopevoorhis.com September 21, 2022 Phase 1 Environmental Site Assessment 2425 Laurel Avenue 1.0 SUMMARY The subject property has been inspected and reviewed independently by Nelson, Pope & Voorhis, LLC (NPV) in order to determine potential environmental or public health concerns. This report is intended to identify Recognized Environmental Conditions (as defined in Standard Practice for Environmental Site Assessment; ASTM E 1527-21 and United States Environmental Protection Agency (USEPA) Standards and Practices for All Appropriate Inquiries (AAI)) on the subject property based on four (4) components of a Phase I Environmental Site Assessment (ESA): records review, site reconnaissance, interviews and evaluation and reporting. Appendix A provides a statement of limiting conditions. Appendix B includes the resumes of key personnel. The subject property is located in the Hamlet of Southold, Town of Southold, County of Suffolk, New York. The subject property consists of a 43.55 acre parcel of undeveloped land, located at 2425 Laurel Avenue. The subject property is situated on the west side of Laurel Avenue, approximately 400 feet north of Main Road. The property is more particularly described on the Suffolk County Tax Map as District 1000, Section 56, Block 1, p/o Lot 1. The subject property is currently undeveloped vacant wooded land with thick underbrush throughout. A small pond is located in the middle of the subject property. There was no evidence of discharge, staining, areas of stressed vegetation, residue of oils or other toxic substances, pools of discharge, petroleum or chemical odors, or other such indicators noted during the site reconnaissance. No other sources were utilized or available to assist with historic information regarding the subject property. An extensive government records search did not identify any sources of environmental degradation on the subject property. Several Federal, State and County documented regulated sites were noted in the vicinity of the subject property. Specifically, one (1) NYS Inactive Hazardous Waste Disposal Site Registry as well as no active and eight (8) closed spill incidents are located within one-half (0.5) mile of the subject property. In addition, one (1) RCRA Generator as well as one (1) Air Discharger are located within one-quarter (0.25) mile of the subject property. ;a NPV 2425 Laurel Avenue,Southold Phase I ESA This assessment has identified the following with respect to recognized environmental conditions, controlled recognized environmental conditions, historical recognized environmental conditions and de minimus conditions in connection with the subject property, subject to the methodology and limitations of this report. No recognized environmental condition was noted on the subject property based on the site reconnaissance, interviews and regulatory agency records review. NPV has performed a Phase I ESA in conformance with the scope and limitations of ASTM Practice E 1527-21 and USEPA AAI for 2425 Laurel Avenue, Southold. Any exceptions to, or deletions from, this practice are described in Section 6.0 of this report. In conclusion, this assessment has revealed no evidence of any recognized environmental conditions in connection with the subject property, subject to the methodology and limitations of this report. The purchase price for the 43.6± acre parcel is $1,250,000 (one million two hundred fifty thousand dollars)plus any acquisition costs associated with the purchase of this property. The purchase will be funded by the Town's Community Preservation Fund. The property is listed on the Town's Community Preservation Project Plan as property that should be preserved for open space preservation and the preservation of wetlands. The purpose of this acquisition is for open space, passive recreational purposes and wetland protection. Proposed uses of the property may include the establishment of a nature preserve, passive recreational area with trails and limited parking for access purposes, all subject to a Management Plan which will be developed for this property. And that he has now formed an LLC, called 2425 Laurel Avenue, LLC . And that is assigned to the contract of sale . So the acquisition is, as Councilman Doroski has read, is for the Town to purchase 43 August 23, 2022 Regular Meeting 9 acres . And it ' s part of a conservation subdivision. The applicant chose to do a conservation subdivision instead of a full density standard subdivision . Density must be reduced by 60% and 80% of the buildable land must be preserved. This project, the preservation requirement is being accomplished by the Town ' s purchase of the 43 . 6 acres . The 43 . 6 acre area includes the 40% of the buildable lands, plus the un-buildable land. Most notably the 10 acre wetland area . There is two maps in front . And i there is one put up on Zoom. The map with the white labels, that is the one on Zoom, shows the area to be preserved outlined in red. With the proposed lots sketched in broken white lines along Laurel Avenue . The property contains (inaudible) pools, wooded wetlands that are part of a larger complex woodlands and wooded wetlands . Second map, that is kind of a colorful map . There is a section of the Town ' s protective lands map, existing property shown in there in August 23, 2022 Regular Meeting 10 red without the sketched residential lots . And it ' s shown in the lower left color . The different colors represent preserved lands . As you can see on the map, this property is on the western edge of a significant amount of preserved lands . They stretch all the way down to Moore ' s woods in Greenport . Couldn ' t quite print that out on our map, but it ' s in that right upper hand corner . It ' s a lighter green . That is Moore ' s Woods . These lands have been preserved in various ways . It ' s hard to describe all the different colors . These protected lands include subdivision space, farmland easements . And for a really significant part of this area, open space lands that are either owned by the Town or County or both in partnership . Like I said, Moore ' s Woods you can ' t see on there but that is the Village of Greenport . The habitat supports many species, including threatened box turtles, endangered long eared bats, grey horn owls . Just to August 23, 2022 Regular Meeting 11 name a few of the species in that significant. area. The conservation subdivision is before the Planning Board. Once the subdivision design was determined, thecTown had the property appraised and the Town ' s purchase price of $1 . 25 million dollars is in accordance with the appraised value . As noted, the Town is using our Community Preservation Funds for this important acquisition. On a personal note, as a planner with the Planning Department many, many years ago before the Community Preservation Fund was enacted, we spent a lot of time with the planner reviewing this property. As it had a pending major subdivision with 18 � proposed lots and new roads . That subdivision was not completed and I am glad to be here instead and asking the Town Board to proceed with this land acquisition for open space purposes . The land owners are in the process of completing the final conservation subdivision stages . Once that August 23, 2022 Regular Meeting 12 subdivision gets approved, the Town will be in a position to close on the property. Box 1452 Mattituck, NY 11952 Re: Conditional Final Plat Approval Messina Conservation Subdivision 705, 751 & 2425 Laurel Avenue, Southold SCTM#1000-56-1-1, 55-6-35 & 36 1 Dear Mr. Finnegan: The Southold Town Planning Board adopted the following resolution at a meeting held on Monday, September 12, 2022: WHEREAS, this 80/60 conservation subdivision proposes to subdivide 50 acres into eight (8) residential lots of approximately 35,000 sq. ft. each, and one 43.6-acre parcel to be preserved as open space by the Town; and WHEREAS, on February 7, 2022, the public hearing on the subdivision application was held and closed during the Sketch Plat phase; and WHEREAS, on March 14, 2022, at their work session, the Planning Board reviewed the Public Hearing comments and the comments returned from the applicable and involved agencies including the Suffolk County Planning Commission, and all comments were incorporated into the application to the satisfaction of the Planning Board; and ` Messina Conservation Subdivision Page 12 i September 13, 2022 WHEREAS, on March 14, 2022, the Planning Board at their public meeting made a Park & Playground Finding, found the application consistent with the Local Waterfront Revitalization Program, granted a Negative Declaration under SEQRA after a coordinated review as Lead Agency, and granted Conditional Sketch Plat Approval; and WHEREAS, on July 29, 2022, the applicant submitted a Final Plat application and fee; and WHEREAS, at their work session on August 8, 2022, the Planning Board found the application complete; and WHEREAS, a public hearing was already held during the Sketch Plat phase, and the Final Plat is substantially in agreement with the Sketch Plat, therefore the public hearing on the Final Plat can be waived; and WHEREAS, on September 12, 2022, at their work session, the Planning Board found that this Final Plat application is ready for a determination pursuant to Town Code §240 Subdivision of land; therefore be it RESOLVED, that the Southold Town Planning Board grants a Conditional Final Plat Approval upon the map entitled, "Messina 80/60 Clustered Conservation Subdivision", prepared by Nathan Taft Corwin III, Land Surveyor, dated September 20, 2021 and last revised July 6, 2022, with the following conditions: 1. Make the following revisions to the Final Plat: a. Add the building envelopes to the lots: i. Front yard: 50' ii. Rear yard: 60' iii. Side yard: 1. Lot 1 northern side yard: 30', southern side yard: 15' 2. Lots 2-8: side yard: 20' b. Vary the street tree species to include at least three species including the following: i. Quercus palustris (pin oak); ii. Northern Red Oak; iii. Acer rubrum (red maple). c. Add the words "Final Plat" to the title of the subdivision map d. Add the word "Parcel" to the Open Space Table Title e. Add the notation "To be purchased by the Town of Southold" to the open space parcel. Close on the open space parcel with the Town. 4. Pay the Administration Fee of$16,000. 5. Pay the Park & Playground fee of$17,500. 6. Install the concrete monuments as shown on the Final Plat. 7. Require a split-rail or similar fence to be installed on the rear property line of the lots to clearly delineate and prevent future encroachment into the Town's open space. This fence will be installed by the applicant, and maintained in the future by the Town. 8. Plant 37 street trees as shown on the Final Plat. 9. Items 6, 7, & 8 above can either be in the covenants to be done prior to any building permits being issued, or done prior to Final Plat Approval. 1 10.Obtain subdivision approval from the Suffolk County Department of Health Services. 11.Submit 12 paper copies and 4 mylars of the Final Plat with the approval stamp of the Suffolk County Department of Health Services. 12.File the covenants and restrictions for the residential lots after review and approval by the Planning Board. A draft will be provided by the Planning Department. The covenants will include, but not be limited to the following: a. No further subdivision of the lots. b. Landscaping & irrigation restrictions as outlined in the LWRP report. c. Detailed description of the meaning of"brush and deadfall to be removed". d. Details on requirements before clearing is allowed (marking trees and shrubs and clearing limits for inspection). e. Maintain street trees. f. Utilities must be underground. g. Items listed above in conditions 6, 7 & 8 as optional to be in the covenants. Final Plat Approval shall expire six months from the date the Planning Board adopted its resolution of approval unless extended by further resolution of the Planning Board.
