SALICE 2315 PINE TREE ROAD, CUTCHOGUE SCTM# 1000-104-3-1 Dear Mr. Just: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, June 12, 2024 regarding the above matter: WHEREAS, JMO Environmental Consulting on behalf of CHARLES V. SALICE applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated March 22, 2024, and, i WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 12, 2024, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, 2 WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees APPROVE the application of CHARLES V. SALICE to construct a second-story addition onto existing dwelling with gutters to leaders to drywells; convert existing attached garage to living space; construct a detached garage with walk and step; construct a terrace on landward side of dwelling; remove existing gravel driveway and install a crushed stone driveway; abandon existing sanitary system and install a new I/A OWTS; and install two drywells for roof runoff; with the addition of a 10' wide vegetated non-turf buffer along the top of bluff; all as depicted on the revised site plan prepared by Kenneth M. Woychuk Land Surveying, PLLC, received on December 4, 2024, and stamped approved on December 10, 2024. Permit to construct and complete project will expire three years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of$50.00 per inspection. (See attached schedule.) The existing overhead electrical wire that currently leads to a utility pole on the neighbor's property will be removed,and underground service will be installed. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 2,2023 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This neighborhood along the shore of Little Creek is comprised of mid to large size homes which are all two stories in height. The subject lot is very long and narrow measuring 70 feet in width and 292 feet deep.The setback variance for the existing accessory garage is a technical variance,as the structure already legally exists with a non-conforming side yard setback which will be maintained when it is attached to the existing dwelling thereby extinguishing the accessory use.Additionally,the attached garage,to be converted to a guest suite, is proposed to remain a one-story structure and the large home on the adjacent lot has a very large side yard setback from the subject property. The side yards are also very well screened by mature vegetation The proposed new accessory garage will have the same side yard setback as the existing accessory garage, will be the same size as the current detached garage,and will be sited to avoid obstructing the existing entrance to the dwelling, Granting the side yard variances for both the existing garage,and the proposed accessory garage will not change the character of this neighborhood,and would be aesthetically more appealing. 2. Town Law§267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue,other than an area variance. Due to the non-conforming setback of the existing accessory garage,any proposed alterations to it would require variance relief. Since this property is waterfront,the proposed new accessory garage will be in a conforming front yard,but as stated above,the proposed accessory garage if placed with a conforming side yard setback minimum of 10 feet would block the entrance to the current residence and obstruct the desirable entry views to the creek. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial. a) The attached garage represents an 80% relief from the code. However, the structure is currently existing with a valid certificate of occupancy, and the proposal is to attach it to the house. This proposal will not increase the level of non-conformance of the structure which is proposed to remain one-story,and the subject . side property line is densely planted with mature landscape screening. b) The proposed accessory garage represents an 80%relief from the code. However,the proposed structure is located in the conforming front yard with a set back from the street of approximately 122 feet, is proposed to be one story and is adjacent to a lot with a very large two story dwelling that is sited at a far distance from the shared property side line, 4. Town Law 42674(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 2,2023 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 5267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This neighborhood along the shore of Little Creek is comprised of mid to large size homes which are all two stories in height. The subject lot is very long and narrow measuring 70 feet in width and 292 feet deep.The setback variance for the existing accessory garage is a technical variance,as the structure already legally exists with a non-conforming side yard setback which will be maintained when it is attached to the existing.dwelling thereby extinguishing the accessory use.Additionally,the attached garage,to be converted to a guest suite, is proposed to remain a one-story structure and the large home on the adjacent lot has a very large side yard setback from the subject property. The side yards are also very well screened by mature vegetation The proposed new accessory garage will have the same side yard setback as the existing accessory garage, will be the same size as the current detached garage,and will be sited to avoid obstructing the existing entrance to the dwelling, Granting the side yard variances for both the existing garage,and the proposed accessory garage will not change the character of this neighborhood,and would be aesthetically more appealing. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue,other than an area variance. Due to the non-conforming setback of the existing accessory garage,any proposed alterations to it would require variance relief. Since this property is waterfront,the proposed new accessory garage will be in a conforming front yard,but as stated above,the proposed accessory garage if placed with a conforming side yard setback minimum of 10 feet would block the entrance to the current residence and obstruct the desirable entry views to the creek. 3. Town Law 5267-b(3)(b)(3). The variances granted herein are mathematically substantial. a) The attached garage represents an 80% relief from the code. However, the structure is currently existing with a valid certificate of occupancy, and the proposal is to attach it to the house. This proposal will not increase the level of non-conformance of the structure which is proposed to remain one-story,and the subject side property line is densely planted with mature landscape screening. b) The proposed accessory garage represents an 80%relief from the code. However,the proposed structure is located in the conforming front yard with a set back from the street of approximately 1.22 feet, is proposed to be one story and is adjacent to a lot with a very large two story dwelling that is sited at a far distance from the shared property side line; 4. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.
