Please note. tqgause of changes re uired by the is ro a ui a r_ a v i the ZBA. Immediately after obtaining ZBA approval in 2019 we moved forward with all other permits required. It has taken over three years to gain all approvals needed, with our final approval coming on December 21, 2022. There were considerable delays for this project due to: 1) permits required by DEC and Southold Town Trustees which required subsequent redesigns (both now approved and fully compliant with these entities, attached). 2) the onset of the COVID-19 pandemic that happened within months of this approval and the long-ranging impact this had on the ability for the DEC, Trustees and also the Suffolk County Department of Health to review, respond and approve this project 3) the cyber attacks on Suffolk County departments that delayed the review and subsequent approval of the proposed site plan which was submitted in 2020 and was just granted on December 21, 2022 (attached). a) the special driveway covenant required by Suffolk County Health Dept to locate the septic system under drive as the only compliant location. This required the owner to hire a lawyer to produce. This covenant has now been approved (also attached). We're hoping that considering the many years it took for this project to receive all approvals, the Board will grant the extension of this approval not to exceed (3) consecutive years of(1)year terms. ZBA FILE : 7290 NAME OF APPLICANT: HC NOFO, LLC PROPERTY LOCATION: 6370 Skunk Lane, Cutchogue SCTM No. 1000-104-5-3.3 SEtRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without further steps under SEQRA. SDFFOLK COIN rY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated February 28, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP OLTERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 17, 2019. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. The coordinator indicated concerns with flooding and erosion hazards`of structures located within the FEMA Flood Zone AE El. 6 (Policy 4.1), and the quality and function of the Town's Ecosystem (Policy 6). In his report he copied a narrative from the Coastal Fish & Wildlife Habitat Assessment Form of 2002 which described the Cutchogue Harbor and Wetlands, and concluded with an impact assessment. The LWRP coordinator recommended that the Board require the installation of I/A OWTS to meet LWRP policy and support the functions and values of the wetland ecosystem. The Board finds that the application, as amended to include the installation of an Advanced IA Sanitary Systems approved by the Suffolk County Department of Health Services is CONSISTENT as recommended, and shall therefore be CONSISTENT with the LWRP- PROPERTY FACTS/DESCRIPTION: The subject property is a 24,561 sq. ft. parcel located in an R-40 Zoning District, with an upland area of 18,624 sq. ft. The parcel has a road frontage of approximately. 155.58 feet along Skunk Lane, then running 150.00 feet southwest to the rear property line, then 141.89 ft to the side yard, returning 204.10 feet back to Skunk Lane (also known as Bay Avenue). The property is improved with a single-family dwelling as shown on the survey prepared by Nathan Taft Corwin, III, L.S. RELIEF REQUF The applicant requests variances to locate a single-family dwelling 20 feet from the rear yard property line, where a 50-foot setback is required by code, and to allow an accessory building(garage) to be located in the side yard instead of the code required rear yard. AMENDED APRI.,LQLL1ON: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on July 11, 2019 submitted, a plan increasing the rear yard setback of the proposed two car accessory garage located in a side yard to 20 feet, which is the setback proposed for the new Single-family dwelling, thereby bringing the plan into more conformity with the Town Code. The site plan prepared by Isaac Clay Coffey was date stamped received July 11, 2019 to show the amended location of the accessory garage and the proposed I/A Onsite Wastewater Treatment System. ADDITIONAL INFQILMA'tIQN: As per testimony from the architect,the property is currently awaiting approval from the Suffolk County Department of Health Services for an FA sanitary system. The architect was questioned about making the setback of the proposed garage the same as the proposed residence. The architect was amenable to this change. The existing dwelling structure was built in 1959 and the certificate of occupancy for a seasonal dwelling was issued in 1960. In December of 1969, a certificate of occupancy was issued for an accessory storage building. The residence altered and expanded to be converted to a full-tirrie residence in 1972 with Certificate of Occupancy#Z- 4635. FINDINGS OF FACT/REA SON$l'OR BOA RD,ACT IL The Zoning Board of Appeals held a public hearing on this application,on July 3, 2019 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §207-b(3)(1))(I). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The surrounding neighborhood is comprised of small to large waterfront properties and houses. Most of the neighboring properties have been renovated and enlarged in recent times, and this project will not change the character of the neighborhood. 2. Town Law §267-b(��) 2 The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The property has a usable upland area that is approximately half the size of thel lot. It is because of this, that the house needs to be sited towards the rear of the property, which would not allow an accessory garage in the required rear yard. Also, a new FA sanitary system is proposed for this property, which also limits the area where the residence can be placed. There is no way to situate this residence, and accessory garage on the subject property without the need for an area variance. 3. Town Law '267-1a 3 1) The variances granted herein are mathematically substantial, representing approximately 601,1/0 relief from the code for the rear yard setback and 1000/'o relief for the proposed accessory garage in a side yard. However, due to the location of the Lisable upland area of the property, extensive wetlands on Page 3, August 1, 2019 #7290, HC NoFo, LLC SCTM No. 1000-104-5-3.3 site, and the siting of the IA sanitary system, the location of the residence, and the accessory garage cannot be located in a compliant location. 4. Town Law 267-b 3 b 4 . No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions set forth in this decision. The applicant is proposing an I/A sanitary system, which will mitigate the environmental effects of nitrogen loading in the adjacent creek and would bring this property into compliance with LWRP recommendations. The proposed residence has a proposed finished floor height of 10 ft above sea level, where a 6 ft height is required further mitigating the impact of the residence on the property. 5. Town Law 267-b 3 b 5 . The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a full-time residence with accessory garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Weisman (Chairperson), seconded by Member Dantes, and duly carried,to GRANT the variances as AMENDED, and shown on the site plan prepared by Isaac Clay Coffey, Architect, date stamped as received July 11, 2019. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall install a new IA sanitary system,as approved by the Suffolk County Department of Health Services and as indicated in above referenced site plan stamped received on July 11,2019. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree oj'nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Page 4, August 1,2019 #7290, HC NoFo, LLC SCTM No. 1000-104-5-3.3 Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. Vote of the Board: Ayes: Members Weisman(Chairperson), Dantes, Acampora and Lehnert.
