Dear Mr. Goggins:
The following resolution was adopted at a meeting of the Southold Town Planning
Board on Monday, April 8, 2024:
WHEREAS, this Amended Site Plan is for two roof additions at 24' x 32' and 24' x 28'
(1,440 total sq. ft.) to an existing 960 sq. ft. car wash facility on 0.918 acres in the
General Business Zoning District, Mattituck; and
WHEREAS, on January 8, 2018, the Planning Board granted approval with conditions,
to the site plan as shown on the survey for SCTM#1000-125.-1-19.5 prepared by
Nathan Taft Corwin III, Land Surveyor, dated November 30, 2015 and last revised
October 20, 2016; and
WHEREAS, on July 8, 2019, the site plan approval expired; and
WHEREAS, on March 20, 2024, William Goggins, attorney for the applicant, submitted
a letter requesting a site inspection for Certificate of Occupancy and an Extension of
Site Plan Approval with provided reasoning as detailed in the April 8, 2024 staff report;
and
WHEREAS, at a Work Session held on April 8, 2024, the Planning Board reviewed the
application and determined that the expired Site Plan remained in compliance with
current rules and regulations; therefore be it

RESOLVED, that the Southold Town Planning Board grants an Extension of
Amended Site Plan Approval for one (1) year from April 8, 2024 to April 8, 2025 to

Taft Corwin III, Land Surveyor, dated November 30, 2015 and last revised October 20,
2016.

Dear Mr. Watroba:
The following resolutions were adopted at a meeting of the Southold Town Planning Board
on Monday, January 8, 2018:
WHEREAS, this proposed Amended Site Plan is for two roof additions at 24' x 32' and 24'
x 28' (1,440 total sq. ft.) to an existing 960 sq. ft. car wash facility on 0.918 acres in the
General Business Zoning District, Mattituck; and
WHEREAS, on June 17, 2016, Roman Watroba, owner, submitted an Amended Site Plan
Application for review; and
WHEREAS, an July 8, 2016, the Planning Board found the application incomplete for
review and required revisions and additional information; and
WHEREAS, on July 19, 2016, Roman Watroba, owner, submitted revised Site Plans,
remaining application fee and additional information for review; and
WHEREAS, on August 8, 2016, the Planning Board formally accepted the Amended Site
Plan Application as complete for review; and
WHEREAS, on August 8, 2016, the Southold Town Planning Board, pursuant to State
Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617, determined that the
proposed action is a Type 11 Action, as it falls within the following description for 6 NYCRR,

Part 617.5(c)(7) construction or expansion of a primary or accessory/appurtenant, non-
residential structure or facility involving less than 4,000 square feet of gross floor area and
not involving a change in zoning or a Use Variance and consistent with local land use
controls, but not radio communication or microwave transmission facilities; and
WHEREAS, on August 15, 2016,the Planning Board, pursuant to Southold Town Code
§280-131 C., distributed the application to the required agencies for their comments; and
WHEREAS, the proposed action is exempt from review by the Suffolk County Planning
Commission (SCPC); and
WHEREAS, on August 25, 2016, the Southold Town Fire Inspector reviewed and
determined that there was adequate fire protection and emergency access for the site; and
WHEREAS, on August 25, 2016, the Architectural Review-Committee (ARC) approved the
proposed action as submitted; and
WHEREAS, on September 12, 2016, a Public Hearing was held and closed; and
WHEREAS, on September 20, 2016, the Mattituck Fire District determined there was
adequate fire protection for the site; and
WHEREAS, on September 22, 2016, the Southold Town Engineer reviewed the amended
application and required revisions to the Site Plan in order to meet the minimum
requirements of Chapter 286 for Storm Water Management; and
WHEREAS, on September 22, 2016, the Town of Southold Local Waterfront Revitalization
Program Coordinator reviewed the proposed project and determined the project to be
consistent with Southold Town LWRP policies with recommendations to the Planning
Board; and
WHEREAS, at a Work Session on September 26, 2016, the Planning Board reviewed the
proposed application and required revisions to the Site Plan and additional information;
and
WHEREAS, on October 25, 2016, Roman Watroba, owner, submitted revised Site Plans
and additional information as required; and
WHEREAS, on November 7, 2016, the Southold Town Planning Board determined that all
applicable requirements of the Site Plan Regulations,Article XXIV, §280— Site Plan
Approval of the Town of Southold,were met; and
WHEREAS, on November 16, 2016, a revised Notice of Disapproval was issued by the
Building Department requiring the applicant to obtain an area variance and special
exception from the Zoning Board of Appeals (ZBA) for the proposed action; and

WHEREAS, on November 8, 2017; the ZBA granted the Special Exception and variances
as requested pursuant to ZBA files #7082SE and 7084; and
WHEREAS, on January 5, 2018, the Southold Town Chief Building Inspector reviewed and
certified the proposed automobile laundry, by special exception, as a permitted use in the
General Business (B) Zoning District pursuant to ZBA file#7082SE; be it therefore
RESOLVED, that the Southold Town Planning Board has determined that this proposed
action is consistent with the policies of the Town of Southold Local Waterfront
Revitalization Program; and be it further
RESOLVED, that the Southold Town Planning Board approves the Amended Site Plan
with one (1) condition, as shown on the survey for SCTM#1000-125.-1-19.5 prepared by
Nathan Taft Corwin III, Land Surveyor, dated November 30, 2015 and last revised October
20, 2016.
Condition
All exterior signage shall meet the requirements pursuant to Article XIX Signs
of the Southold Town Code.
Please also note the following requirements in the Southold Town Code relating to Site
Plans:
1. Any new lighting fixtures beyond those approved as part of the Lighting Plan
must conform to the Code and may require Planning Board approval depending
on their number, size, intensity and location. Fixtures shall be shielded so the
light source is not visible from adjacent properties and roadways and shall focus
and direct the light in such a manner as to contain the light and glare within
property boundaries and conform to §172 of the Town Code.
2. All storm water run-off from grading, driveways and gravel areas must be
contained on site.
3. Proposed storm water run-off containment systems must be inspected by the
Town Engineer at the time of installation. Please call the Southold Town
Engineer prior to beginning this work.
4. Approved Site Plans are valid for eighteen months from the date of approval,
within which time all proposed work must be completed, unless the Planning
Board grants an extension.
5. Any changes from the Approved Site Plan shall require Planning Board
approval.

6. Prior to the issuance of a Certificate of Occupancy, the Planning Board must
inspect the site to ensure it is in conformity with the Approved Site Plan, and
issue a final site inspection approval letter. Should the site be found not in
conformance with the Approved Site Plan, no Certificate of Occupancy may be
issued unless the Planning Board approves the changes to the plan.
A copy of the Approved Site Plan is enclosed for your records. One copy will also be sent
to the Building Department and the Town Engineer/Highway Department.

The daughter. Tisha Watroba, believed that her father recived all approvals and was
issued a certificate of occupancy. We received a title report, which alerted us to the fact
that it was not. A copy of the variance and special exception approvals are attached.
Given the circumstances, we respectfully request that the Board grant an extension of the
time to obtain a certificate of occupancy up to June 30, 2024. Hopefully-, it will give us
sufficient time to obtain a certificate of occupancy, and sell the property.

consideration in this application and determines that this review falls under the Type 1I category of

SUFFOL QCOQNTY ADMINISTRATI E CQD : This application was referred as required
under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County
Department of Planning issued its reply dated June 9, 2017 stating that this application is
considered a matter for local determination as there appears to be no significant county-wide or
inter-community impact.
LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is
listed under the Minor Actions exempt list and is not subject to review under Chapter 268.
TOWN" OF SOIJTHOLD PLANNING BOARD: The application was referred to the Southold
Town Planning Board for comments relating to the as built additions. The Planning Board, in their
memo dated September 28, 2017 stated that the board generally has no objection to the Special
Exception and side yard setback relief due to the fact that the existing building, and use thereof,
received site plan approval in 1985. Moreover, the site is being improved with additional roof
cover and will have space to accommodate sanitary;stormwater and parking requirements.
PROPERTY
AC"I"S/.bCRIPTION. The subject property is a conforming 40,005 square foot
parcel located in a General Business(B)Zoning District. The parcel measures 150.2 feet along the
southerly lot line fronting NYS Route 25, measures 251.08 feet along the westerly lot line,
measures 141.5 feet along the northerly lot Iine abutting Long Island Rail Road tracks, and
measures 305.19 feet along the easterly lot line. The property is improved with a one Story Stucco
building, a new roof structure attached to the easterly side of the principal building , a new roof
structure over concrete and metal rails attached to the rear side of the principal building, a frame
shed,a metal container, paver walls, and a sign. All is shown on a survey prepared by Nathan Taft
Corwin last revised October 20,2016.

IKELIEF REQUESTED: The applicant has made improvements to an existing commercial car
wash and desires to legalize"as built" additions and alterations. The car wash originally received
site plan approval by the Southold Town Planning Board on July 25, 1983.
ADDITIONAL INFORMA.TIOM. The applicant testified that the intent of the addition to the
westerly portion of the parcel, i.e. new roof structure over concrete, and shed, is to provide shelter
for a New York State Department of Conservation required water recycling system. The applicant
testified that in order to install a water recycling system, and operate it efficiently, with an
enclosure over the system was constructed to protect it from the elements.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on October 5,2017 at
which time written and oral evidence were presented. Based upon all testimony, documentation,
personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning
Board finds the following facts to be true and relevant and makes the following findings:
The Board has reviewed the General Standards governing Special Exception uses set forth in
Section 280-142 and finds:
A. That the use will not prevent the orderly and reasonable use of adjacent properties or of
properties in adjacent use districts. The car wash originally received site plan approval in
1985 and has been in operation since then with no detrimental impacts.
B. That the use will not prevent the orderly and reasonable use of permitted or legally
established uses in the district wherein the requested use is located or of permitted or
legally established uses in adjacent use districts. The proposed car wash is a permitted use
in this zone and was established subsequent to a site plan approval in 1983.
C. That the safety, the health, the welfare, the comfort, the convenience or the order of the
town will not be adversely affected by the proposed use and its location. The car wash has
legally been in operation since 1983 and the use will not change.
D. That the use will be in harmony with and promote the general purposes and intent of this
chapter.
E. That the use will be compatible with its surroundings and with the character of the
neighborhood and of the community in general, particularly with regard to visibility, scale
and overall appearance. The size of the car wash conforms to zoning. The neighborhood
is a commercial neighborhood.
F. That all proposed structures, equipment and material shall be readily accessible for fire and
police protection.
G. That the proposal shall comply with the requirements of Chapter 236, Stormwater
Management .

prepared by James Deerkoski,PE and Nancy Dwyer Design Consultant,dated April 7,2017.
SUBJECT TC THE FOLLOWING CONDITIONS:
1. Pursuant to Section 280-141(C)"a special exception approval shall be valid for a
period of six months but may be extended for one additional six-month period by the
Zoning Board of Appeals within the requirement of new public notice of hearing.A
continuing or permanent land use authorized by a special exception approval,which
use is undertaken or begun during the period of validity of such approval,shall
thereafter be deemed a lawful use..."
2. The applicant must obtain site plan approval from the Planning Board.Failure to do

SUFFOLK COUNTY ADMINISTRAT VE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 1.4-14 to 23, and the Suffolk County Department of Planning issued its
reply dated June 9,2017 stating that this application is considered a matter for local determination as there appears
to be no significant county-wide or inter-community impact,
LM� DFTER1w�IINATION: The relief, permit, or interpretation requested in this application is listed-under the
Minor Actions exempt list and is not subject to review under Chapter 268.
TOWN OF SOUTIQLD PLANNING BOARD- The application was referred to the Southold Town Planning
Board for comments relating to the proposed building addition, The Planning Board, in their memo dated
September 28, 2017 stated that the board generally has no objection to the Special Exception and side yard setback
relief due to the fact that existing building, and use thereof,received site plan approval in 1985, Moreover,the site
is being improved with additional roof cover and will have space to accommodate sanitary, stormwater and parking
requirements,
PROPERLY.. "ACTS/D SCRIPTION.• The subject property is a conforming 40,005 square foot parcel located in a
General,Business (B) Zoning District. The parcel measures 150.2 feet along the southerly lot line fronting NYS
Route 25, measures 251.08 feet along the westerly lot line, measures 141.5 feet along the northerly lot Iine
abutting Long Island Rail Road tracks, and measures 305.19 feet along the easterly lot line. The property is
improved with a one Story Stucco building, a new roof structure over concrete attached to the easterly side of the
principal building , a new roof structure over concrete and metal rails attached to the rear side of the principal
building, a frame shed, a metal container, paver walls, and a sign. All is shown_ on a survey_prepared by Nathan
Taft Corwin last revised October 20,2016.
BASIS OF APPLLQA"I ION: Request for a Variance under Article XI, Section 280-49 and the Building Inspector's
May 11, 2017, Notice of Disapproval based on an application for a permit to legalize "as-built" additions and
alterations to an existing car wash (automobile laundry; at: 1) less than the code required minimum side yard
setback of 25 feet; at: 6565 NYS Route 25,Laurel NY. SCTM41000-125-1-19.5.

RE' REQUESTED: The applicant requests a variance to legalize"as built"construction to the westerly side of
the principal structure measuring 16 feet from the side yard property line where the code requires a minimum
distance of 25 feet
A:DDrrlONAL INFORMATION: The applicant testified that the New York Department of Environmental
Conservation required the car wash to install a water recycling system. In order for the system to operate
efficiently the applicant installed it on the west side of the building. The applicant built an enclosure over the
system to protect it from the elements and this enclosure is what is creating the non-conforming side yard setback.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on October 5,2017 at which time written
and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property
and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
1. Town Law 26'7-b 3 b 1 . Grant of the variance will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. The subject business is surrounded by primarily commercial
and business operations. The applicant was required to install the water recycling system in order to protect the
neighborhood's ground water. The as built addition built to shelter a water recycling system will not produce an
undesirable change since the side yard has a large berm and mature landscape screening that shields the addition
from view of the adjacent property and a legal fence that shields the view from Main Road/NYS Route 25.
2. Town Law 267-b b 2 .The benefit sought by the applicant can be achieved by some method, feasible for
the applicant to pursue, other than an area variance. The applicant could install the water recycling system and
cover in a code conforming location. However, this would require the.applicant to pump the water further away
from the washing system and the system would not function as effectively or efficiently.
3. Town Law 7-bl3JlbJQ The variance granted herein is mathematically substantial,representing 46%relief
from the code. However, the non-conformity was created by the New York State Department of Conservation's
(NYSDEC) regulation and the need for the equipment to function efficiently by being in close proximity to the
other mechanical systems used in the car wash..
4. Town Law 267-b 3 b 4 No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the Town's Storm Water Management Code and obtain an updated site
plan approval from the Planning Board.
5. Town Law 267-b b 3 .. The difficulty has not been self-created. The applicant purchased the parcel after
the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.However the
applicant could not foresee what environmental regulations would take effect and how he would best be able to
meet the environmental regulations.
6. Town .Law 267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a shelter to house a required water recycling system while preserving and
protecting the character of the neighborhood and the health, safety and welfare of the community.

RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Planamento, and duly
carried,to
GRANT the variance as applied for, and shown on the survey prepared by Nathan Taft Corwin, III, L.S., last
revised October 20, 2016, and the architectural plans (pages key and 1 thru 4) prepared by James Deerkoski, P.E.,
and Nancy Dwyer Design Consultant,dated April 7,2017.
Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays
and/or apossible denial by the Building Department of a buildingpermit, and may require a new application and
public hearing before the Zoning Board of Appeals.
Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey
cited above, such as alterations, extensions, or demolitions, are not authorized under this application when
involving nonconformities under the zoning code. This action does not authorize or condone any current or future
use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does
not increase the degree of nonconformity.
Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the
Board of Appeals shall become null and void where a Certificate of Occupancy has not been
procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three
(3) years from the date such variance was granted. The Board of Appeals may, upon written
request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one
(1)year terms.
