This Agreement made this 3 day of November 2023 by and between
ROGER G.BEST REVOCABLE TRUST AGREEMENT DATED AUGUST 11,2000 with an
address at 230 Kimberly Lane, Southold, NY 11971 (hereinafter called "Seller")the party of the
first part),at MARGARET VADEN and STEVE CHENG,with an address at 380 Kimberly Road,
Southold,NY 11971 (hereinafter called "Neighbor"), the party of the Second Part.
WHEREAS, Seller is the owner in fee simple of the premises described above more
particularly described on Schedule A attached hereto (hereinafter described as "Premises")
designated on the Suffolk County Tax Map District: 1000 Section: 070.00 Block 13.00 Lot 020.019
and Neighbor is the fee owner of the premises described above designated on the Suffolk County
Tax Map District: 1000 Section: 070.00 Block 13.00 Lot 020.018 each of the parcels being
contiguous to the other; and

WHEREAS a survey map prepared by Nathan Taft Corwin III land survey dated October 12,
2023,a copy of which is attached hereto as Exhibit A,discloses that a fence lies up to 3.5 feet north
of the Seller's southerly property line apparently restricting access to a port of the Premises; it is
hereby;
AGREED that Neighbor makes no claim of title to that portion of the Premises that lies
between the fence and the record line shown of the Survey. Neighbor further agrees that Seller, or
Seller's successor may relocate fence in a workmanlike manner, without undue damage, to the
agreed boundary line at any time,upon reasonable notice to Neighbor or to Neighbor's successor in
interest.
