THIS INDENTURE, made as of the -5'4A day of April, 2024,
between Robert K. Howard as successor Trustee of THE ILSE TROMBONE LIVING TRUST under
Agreement June 30, 2014, of 1601 Veterans Memorial Highway, Suite 425, lslandia, New York 11749,
party of the first part, and
F I ASCARI, LLC, a New York limited liability company, of 8980 Nassau Point Road, Cutchogue,New
York 11935,
party of the second part;
WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by a
certain trust agreement dated June 30, 2014 and/or by Article I 1 of the Estates, Powers and Trusts Law,
and in consideration of the sum of three million two hundred ($3,200,000.00)dollars and no cents lawful
money of the United States, paid by the party of the second part,does hereby grant and release unto the
party of the second part, the distributees or successors and assigns of the party of the second part forever;
ALL that certain plot, piece or parcel of land, situate, lying and being in the Town of Southold,
County of Suffolk, State of New York,more particularly described in Schedule A annexed hereto;
BEINGAND INTENDED TO BE the same premises conveyed to the party of the first part by deed
in Liber 12822 page 638;
TOGETHER with all right,title and interest, if any,of the party of the first part in and to any streets
and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances,and all the estate which the grantor of said trust had in the
premises, and which the party of the first part has or has power to convey or dispose of, whether
individually, or by virtue of said trust agreement or otherwise;
TO HAVEAND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to receive
such consideration as a trust fund to be applied first for the purpose of paying the costs of the
improvement and will apply the same first to the payment of the cost of the improvement before using
any part of the total of the same for any other purpose.

BEGINNING at a monument on the westerly line of Nassau Point Road at the northeasterly corner of Lot
#92, as shown on "Amended Map A of Nassau Point,"filed in the Suffolk County Clerk's Office as Map
#156, said point of beginning also being where the division line between the premises described herein
and land now or formerly of Michael Thompson and Debra A. Stabile intersects the westerly side of
Nassau Point Road;
RUNNING THENCE from said point of beginning along said Lot#92, South 54 degrees 43 minutes 00
seconds West, 608.47 feet(actual) (635.00 feet, deed)to the mean high water line of Great Peconic Bay;
THENCE along the mean high water mark of Great Peconic Bay, North 35 degrees 17 minutes 00 seconds
West, 200.00 feet to a point;
THENCE along Map of Harry G. and Janet Hohn, Map No. 9172, North 54 degrees 43 minutes 00 seconds
East, 708.50 feet(actual) (732.16 feet,deed)to a point on the westerly side of Nassau Point Road;
THENCE along the westerly side of Nassau Point Road, South 08 degrees 42 minutes 40 seconds East,
223.62 feet to the point or place of BEGINNING.
TOGETHER with a right-of-way or purposes of ingress and egress over the southerly portion of the
premises immediately adjoining on the north of premises herein conveyed as shown on survey of
Roderick Van Tuyl, P.C. dated August 9, 1974.
