and all the estate and rights of the party of the first part in and to said premises;TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part,the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will

ALL that certain plot, piece or parcel of land, situate, lying and being at Cutchogue, Town of Southold, County of Suffolk
and State of New York, being known and designated as and by Lot 3 on a certain subdivision map entitled, "Map of Major
Subdivision prepared for Francis Greenberger, prepared by Roderick Van Tuyl, P.C. last dated 1/27/92"and filed in the
Office of the Clerk of the County of Suffolk on 4/30/93 under File No. 9350, which is bounded and described as follows:
BEGINNING at a pipe on the westerly side of a 50 foot private right of way, said point being the southeasterly corner of the
premises about to be described herein and the northeasterly corner of Lot 2 on the aforesaid map;
RUNNING THENCE North 77 degrees 52 minutes 20 seconds West,along the division line of Lot Nos. 2 and 3 on the
above mentioned map 554.73 feet to land (now or formerly)of Vivano;
THENCE North 19 degrees 06 minutes 30 seconds East, along last mentioned land 300.00 feet to the division line of Lot
Nos. 3 and 4 on the above mentioned map;
THENCE South 72 degrees 36 minutes 20 seconds East, along last mentioned division line 478.69 feet to a pipe;
