Site Plan Submission— Confirmation of Intended Uses (Winery & Farmhouse) LKMA No. 24082.000 Dear Amanda: As Consulting Engineers for North Fork Project 2 & 3 LLC we are submitting, on their behalf, an application for a Building Permit in order to receive a detennination (permitted use evaluation) whether the new winery with a 2-acre residence (Farmhouse) requires relief from the Zoning Board of Appeals. It should be known that a previous Lot Line Modification (Re-Subdivision Application)was submitted by the property owner in advance of this revised site plan submission. No decision has been rendered yet. Therefore it is at this time that we have attached a revised site plan with all zoning info (lot coverage, setbacks, height) and property survey so that your office can issue a SPUD to the Planning Department. Once acknowledged by Planning, we ask that the Building Department issue a determination whether an amended NOD is required. Currently the property is zoned R-80 (11.85 acres) and R-40 (0,74 acres) and the intended use is for a winery (10 acres) & residential farmhouse (2 acres). It is our contention that the proposed winery complies with the Town Code as per Chapter 280-13 (A) (4) conditions and just needs Planning approval prior to eventually obtaining building permits. This proposed winery is a place where wine is made from primarily Long Island grapes and is produced as well as sold. The Old Sound Winery shall is on a parcel which has at least 10 acres that is devoted to vineyard or other agricultural purposes, and which is owned by the winery owner. The winery structures shall be set back a minimum of 100 feet from Old Sound Avenue and lastly the winery shall obtain site plan approval. If for someone unknown reason relief is required, this Notice of Disapproval will enable our client to submit to the Zoning Board of Appeals for a variance. To support your determination our office has enclosed a site plan with site data table and zoning setbacks, an updated survey and a signed building permit application. A conceptual floorplan of the tasting room structure and storage barn can be provided in a supplemental submission if needed. The main purpose of this submission to your Department is to confirm that relief is not required based upon the two intended uses identified. Based upon our review of the Town Code we do not see how any relief would be needed unless identified by your office.
