(631) 765-1809 6ho)1&dbwn Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF MAY 16, 2024 ZBA FILE: 7903 NAME OF APPLICANT: John Lauretti PROPERTY LOCATION: 295 Vista Place, Cutchogue SCTM No. 1000-83-1-20 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated February 15, 2024 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 21,138 sq. ft. non-conforming parcel located in an R-40 Zoning District. The parcel has 183.68 feet road frontage on Vista Place, then turns 113.18 feet southwest, then runs 201.65 feet along the rear property line before returning 100 feet back toward Vista Place. The property is improved with an existing two-story residence as shown on a survey prepared by Ralph Heil, LS, of Aerial Land Surveying, D.P.C. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; Article XXIII, Section 280- 124; and the Building Inspector's January 24, 2024 Notice of Disapproval based on an application for a permit to legalize an"as built"covered porch attached to an existing single family dwelling, and to construct an accessory in- ground swimming pool; at; 1) "as built" construction is located less than the code required minimum front yard setback of 40 feet; 2) swimming pool is located in other than the code permitted rear yard; located at: 295 Vista Place, Cutchogue,NY. SCTM No. 1000-83-1-20. RELIEF REQUESTED: The applicant requests variances to legalize an "As-built" front porch addition having a front yard setback of 29.5 feet where a minimum of 40 feet is required. There is a proposed accessory swimming pool to be located in the secondary front yard where a rear yard location is required. ADDITIONAL INFORMATION: The existing residence currently exists with a Certificate of Occupancy# 5785 dated February 6, 1974, as well as a Certificate of Occupancy 4 35258 dated October 27, 2011, issued for a Page 2, May 16,2024 #7903,Lauretti SCTM No. 1000-83-1-20 replacement of an existing deck. The current pool is proposed in the secondary front yard which faces Glen Court, which is a private road. The property line abuts an area of undeveloped property adjoining the road. The owner of the property stated at the public hearing that he would plant evergreen screening around the pool to block the view from Glenn Court. The applicant stated he is working with his Homeowners Association for the location of the screening. However, applicant understands that regardless of exact location, applicant is required to have the screening at all times around the pool as per this decision. The applicant's representative presented prior comparable variances that were granted to neighboring properties, #6865, dated August 6, 2015, for a reduced front yard setback. The Site Plan prepared by Anthony Portillo,Architect,dated December 20,2023 depicts a proposed two-story garage that is depicted as conforming to the Town's Zoning Code. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 2, 2024 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The as built front porch is an open covered portico that is common on many houses in the neighborhood. The pool is proposed in a secondary front yard on the subject corner ' lot that is a private dead-end road, Glen Court, that does not connect to Vista Court. The pool would be set back from Glenn Court and there would be evergreen screening so the pool will not be seen from either Vista Place or Glenn Court. This placement of the pool and proposed screening will not produce an undesirable change in the character of the neighborhood. 2. Town Law U67-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue,other than an area variance. The existing residence is set closer to the property line than the required 40 ft, and anything added to the front of the house would require variance relief. The proposed pool is to be located in a secondary front yard along Glen Court because there is ample room and the conforming rear yard already contains existing structures and a proposed accessory garage. However, any proposed construction in a secondary front yard requires variance relief. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial: a. The as-built front covered porch represents 26% relief from the code. b. The proposed accessory pool located in the secondary front yard represents a 100% relief from the code. However, the as built porch is actually a covered, non-habitable open entry portico supported by two masonry columns and is only 15 feet in width of the existing dwelling's 42.3-foot-wide front elevation. The proposed pool is to be located in a secondary front yard that is in the architectural side yard of the dwelling and convenient to the steps from the existing deck located on the north side of the house, which is the most desirable location for an accessory pool. Additionally, the proposed pool will be well screened from view by plantings and is a two- dimensional non-habitable accessory structure with little visual impact. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and conditions of this Board. Page 3,May 16,2024 #7903,Lauretti SCTM No. 1000-83-1-20 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law U67-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a covered front porch and an accessory swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Lehnert,seconded by Member Acampora,and duly carried, to GRANT the variances as applied for and shown on the Site Plan and Architectural Plans prepared by Anthony Portillo,Architect, dated December 20,2023. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Evergreen screening shall be planted along and continuously maintained parallel to both Glen Court and Vista Place to create visual privacy and block the view of the pool from both roads. 2. 'Pool pump equipment/mechanicals must be located a minimum of 20 feet from any property line or be contained in a shed type enclosure with a lot line set back that is in conformance,with the bulk schedule for accessory structures 3. Drywell for pool de-watering shall be installed. 4. The applicant must apply to the Building Department for a building permit for the "as built" improvement(s)within 90 days of the date of this decision and submit same to the Office of the Zoning Board of Appeals or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a building permit in the time allotted. 5. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s)and submit same to the Office of the Zoning Board of Appeals within 12 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s) why the applicant was unable to obtain a Certificate of occupancy in the time allotted. 6. The front covered porch shall remain open and not to be enclosed into habitable space. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. IMPORTANT LIMITS ON THE APPROVAL(S) GRANTED HEREIN Please Read Carefully Any deviation from the survey,site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. We previously sent out a sketch of our proposal as it affects Glen Court to all of the. Members of the Association asking their approval for the proposed work. On November 26, 2023 at a meeting, our proposal was approved by the Members of the Association. We will complete the work at our expense and continue to maintain it as long as we own the property at no cost to the Association. ARTICLE EIGHT—OPERATIONS (1) Each lot owner shall be responsible for the upkeep,maintenance and safety of their particular lot(s), including,but not limited to,preventing any trees,bushes or shrubs from encroaching upon or interfering with the traveled roadway. In the event there is an encroachment or interference with the traveled roadway,the Board must notify the lot owner,in writing,to remove the encroachment or interference.In the event the lot owner refuses or neglects to remove same within thirty(30)days after notice,the Board is authorized to hire a contractor to clear up to seven(7)feet from the curb line or traveled pavement at the lot owner's expense. 4 a ARTICLE NINE — OFFICERS (1) No officer or director shall be entitled as such to receive any salary or compensation. + However,nothing herein shall be construed to prevent an officer or director for receiving reimbursement of approved expenses or for receiving any compensation from the membership or Board of Directors for duties performed other than as a director or officer. (2) The officers of the association and their duties shall be as follows: PRESIDENT The President shall: (a) preside at all membership meetings; (b) present a report at the Annual Meeting of the work of the association for the preceding year; (c) appoint all committees;. Suffolk County Soil and Water Conservation District issued a report dated July 27, 2015. The report in part stated that: "The foremost objective with the proposed construction is maintaining the current level of bluff stability. Currently the stability has been achieved through toe protection via the bulkhead and stability of the top of the bluff by limiting disturbance and surface water from traveling onto the bluff.The dense vegetation occurring on the bluff face while critically important to maintaining this stability is of secondary importance to the stabilization of the toe and top of the bluff' and "The demolition of the existing house and the reconstruction of a new residence has the potential to help protect the bluff and the residence by increasing the structural distance from the bluff top edge,as long as the demolition, reconstruction, and maintenance of the proposed infrastructure does not catalyze bluff erosion." The SWCD recommended the installation of a 10 foot wide buffer, landward of the existing vegetation and fencing, having a"bow diversion"(1' high x 3' wide)sited at its center with natural buffer vegetation occurring in front of the diversion as well as behind. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 2,2015, at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law V67-b(3)(b)(1). Grant of the variances or will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. All of the other developed Sound front properties along Glenn Court have similar nonconforming"Top of Bluff'and front yard setbacks to what the applicant proposes. 2. Town Law&267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than area variances. The depth between the front property line and the "Top of Bluff'measures only 125 feet.The code required"Top of Bluff'setback(100 feet)and front yard setback(40 feet) combined require a 140 foot depth, therefore the placement of any dwelling and related structures anywhere on the subject property would unavoidably require a "Top of bluff' and/or front yard setback variance. The applicant could feasibly construct a new dwelling that would not require a Iot coverage variance. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing a 50% variance for a "Top of Bluff' setback, a 37.5% variance for a front yard setback and a 25.5% variance for lot coverage. However, the proposed "Top of Bluff' setback of 50 feet to the nearest corner of the proposed pool and deck represent a 25 foot setback increase to the `Top of Bluff' compared to the existing deck. The proposed lot coverage (25.1%) will be a decrease compared to the existing lot coverage of 25.3%. The proposed front yard setback of 25 feet represents a 9.4 foot decrease compared to the existing front yard setback of 34.4 feet. However, this proposed setback allows for a more substantial "Top of Bluff' setback and is consistent with the front yard setbacks of other properties in this community. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law $267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code.
