(631) 765-1809 outhold Town Clerk FINDINGS,DELIBERATIONS AND DETERMINATION MEETING OF MAY 16, 2024 ZBA FILE: #7898 NAME OF APPLICANT: Heather Romanelli PROPERTY LOCATION: 3535, Cedar Beach Road(Adj. to Shelter Island Sound) Southold,NY SCTM: 1000-93-1-6.3 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determined that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated February 15, 2024 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated April 23, 2024. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject, 55,604.65 square feet, 1.28 acre, irregular-shaped, waterfront parcel located in the R-80 Zoning District measures 476.97 feet along Cedar Beach Road to part of the Peconic Bay known as the Shelter Island Sound,then continues along a tie line below the mean high water mark 65.87 feet,37.02 feel, then returns along a residentially developed parcel to the north 300.72 feet, along a slight bend 21.35 feet and continues 120.00 feet along the same neighbor and returns south 135.00 feet back to the roadway. The parcel is developed with a two-story frame dwelling with covered front porch, attached pergola and 1-bay garage, concrete and slate patio, outdoor shower, brick outside oven, generator, three sheds and a gravel driveway as shown on the survey prepared by Kenneth M. Woychuk, and dated December 13, 2023. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124; and the Building Inspector's December 22,2023 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling;at 1)located less than the code required minimum front yard setback of 50 feet; located at: 3535 Cedar Beach Road (Adj. to Shelter Island Sound), Southold, NY. SCTM No. 1000-93- 1-6.3. Page 2,May 16,2024 #7898, Romanelli SCTM No. 1000-93-1-6.3 RELIEF REQUESTED: The applicant requests a variance for a reduced front yard setback of 30.4 feet where a minimum front yard setback of 50 feet is required for lots containing between 40,000 and 59,999 square feet in total size to accommodate the alteration and expansion of an existing garage (measuring 12 feet by 18 feet) attached to the residence via a breezeway. The proposed new garage,to be located partially on the original footprint will measure 18 feet by 24 feet when completed and attached to the residence by a new, open-air, covered breezeway measuring 9 feet by 15 feet. ADDITIONAL INFORMATION: The applicant provided architectural drawings,labeled A-1 through A-5,prepared by Richard M. Mato, Registered Architect, and last revised January 7,2024. The existing garage has a pre-existing setback of 37.1 feet based upon the Pre-Certificate of Occupancy,#Z-26368, dated April 12, 1999 which covers a one-family dwelling built before zoning with an accessory garage and accessory sheds. Prior Zoning Board of Appeals relief for the subject property was granted under file #5513 dated May 13, 2004, allowing for reduced setbacks for the primary residence; File 44685 was withdrawn, dated March 23, 1999; and #1453 was denied on August 19, 1971, disallowing permission to occupy a second residence with insufficient lot area. An open building permit, #Z-50154 dated December 26, 2023 per Zoning Board of Appeals file No. 5513 (2004), covers alterations and additions to an existing dwelling. No member of the public or an immediate neighbor spoke in favor of or against this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 2,2024 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law t 267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Cedar Beach neighborhood consists of many single-family residences of varying style and size built prior to zoning or recently renovated, located both on upland or waterfront parcels. Many homes in the general area have non-conforming setbacks or other non-code compliant improvements. The neighborhood is densely wooded and the lot size varies substantially from smaller than the zone allows to larger, more estate-like parcels that exceed the zone requirements. Additionally, a substantial waterfront county park and beach is located in the neighborhood and is immediately across the street from the subject parcel. While the existing garage has a non-conforming setback,the further reduced setback of 30.4 feet will be undiscernible to passersby and those using the roadway to access the county park. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The existing as built residence does not face the roadway; it is sited to take advantage of views over the Shelter Island Sound. As such, the existing garage access is on the side of the house but has a setback from the street which creates the designated front yard.The proposed new garage will replace the existing garage in the same location and will be attached to the dwelling by an open covered walkway. Any further expansion to the garage will require some form of Board variance relief. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 39.2%relief from the code. However, the applicant proposes a modest expansion of the existing garage by 6.7 feet, establishing r Page 3, May 16,2024 #7898, Romanelli SCTM No. 1000-93-1-6.3 a new 30.4 feet setback, which will be is undiscernible since there are very tall hedgerow plantings that screen the existing garage from the road and will also do so for the proposed new garage 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect before or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an expanded 1.5 car garage measuring 18 feet by 24 feet(attached to the residence via breezeway measuring 9 feet by 15 feet) with a reduced front yard setback of 30.4 feet while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Planamento, seconded by Member Acampora, and duly carried,to GRANT the variance as applied for, and shown on the survey prepared by Kenneth M. Woychuk -and dated December 13,2023 and Architectural Drawings,Labeled A-1 through A-5,prepared by Richard M.Mato,Registered Architect, and last revised January 7, 2024. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the.State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 55,604 sq. ft. lot has 476.97 ft. of frontage along the north side of Cedar Beach Road, is 135 feet deep along the westerly lot line, and 102.89 feet along the east lot line at high water of the Shelter Island Sound, Southold. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 22, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants plan are to remove the existing screen porch and 700 sq. ft. of the existing second floor, and to build a new 1658 sq.ft. second floor area (with net increase of 958 sq. ft.). The requested setbacks vary as shown on the site map prepared by Thomas Samuels, Architect, with 14'9" and 15'8" from the side lot line, and with a 10' side yard setback for the new basement access door.
