DETERMINATION: The determination of the Southold Town Board of Trustees is reversed and the application for a Coastal Erosion Hazard Area (CEHA) permit is hereby approved as a Type II action under SEQRA. PROCEDURAL HISTORY Upon the application of East End Seaport Museum for a permit to remove and replace an existing timber pier within a Coastal Erosion Hazard Area (CEHA), for the purpose of support and access to this navigational lighthouse, the Southold Town Board of Trustees conducted a public hearing on April 17, 2024 The record included the submissions of L.K. McLean Associates Engineering & Surveying on behalf of the applicant, in addition to the written comment of the Local Waterfront Revitalization Program (LWRP) Coordinator. On April 17, 2024, the application of East End Seaport Museum for a CEHA permit was denied. Applicant now appeals that determination to the Town Board, acting in its capacity as Coastal Erosion Hazard Board of Review. Unrelated to this proceeding, the record also indicates that the companion application of East End Seaport Museum for a wetland permit to conduct the requested activity was approved by the Board of Trustees action of April 17, 2024. In accordance with Town Code Section 111-25, East End Seaport Museum appealed the denial of its request for a CEHA permit to the Town Board in its capacity as the Coastal Erosion Hazard Board of Review. The public hearing on this request was conducted on July 2, 2024. The record includes the underlying record of the Board of Town Trustees, in addition to the multiple written submissions of the applicant including its Application for Appeal dated May 8, 2024. The record also includes the testimony taken on behalf of the applicant at the time of the public hearing on appeal. On July 16, 2024,the Board voted unanimously to reverse the determination of the Board of Trustees and to grant the requested CEHA permit, under the specific considerations presented. DETERMINATION ON APPEAL Upon all of the evidence submitted and the testimony adduced at the public hearing conducted in connection with this application, and upon due deliberation thereon, the Town Board, in its capacity as the Coastal Erosion Hazard Board of Appeals, hereby finds as follows: FIRST: The East End Seaport Museum proposes the removal and replacement of the existing timber pier with a new pile supported pier at the Long Beach Bar Lighthouse located off of Long Beach Island in Gardiner's Bay. The lighthouse is utilized as a navigational aid around the existing sandbar located between Gardiner's Bay and Orient Bay and was originally constructed in 1871. The lighthouse is owned by the applicant and is also utilized for cultural and educational purposes. The proposed action will reinforce the foundation of the structure and allow for better access by boat. SECOND: By decision dated April 17, 2024, the Board of Trustees granted the Wetlands permit for the proposed action but denied the CEHA permit because of the location of the proposed activity within the Coastal Erosion Hazard Area. THIRD: The applicant is therefore before the Town Board seeking an appeal from the denial of the Board of Trustees dated April 17, 2024. As such, the application is considered under Section 111 of the Town Code. That Chapter designates the Town Board as the Coastal Erosion Hazard Board of Review, requiring it to decide appeals that the Trustees erred in applying the following criteria: A. No reasonable, prudent, alternative site is available. B. All reasonable means and measures to mitigate adverse impacts on natural systems and their functions and values have been incorporated into the activities design at the property owner's expense. C. The development will be reasonably safe from flood and erosion damage. D. The variance requested is the minimum necessary to overcome the practical difficulty or hardship which was the basis for the requested variance. E. Where public funds are utilized, the public benefits must clearly outweigh the long-term adverse effects. [Southold Town Code § 111-20] AVAILABLE, REASONABLY PRUDENT ALTERNATIVE SITES FOURTH: The Board accepts the testimony offered on behalf of the applicant that the proposed development is required to ensure the continued viability of the navigational lighthouse and its continued use as a cultural and educational resource. ALL REASONABLE MEANS OF MITIGATION HAVE BEEN INCORPORATED FIFTH: The Board notes that while the replacement pier (453SF) is proposed to be larger than the existing pier (148SF), that the replacement pier will be constructed with fiberglass grating, which will allow natural light to pass through to minimize impacts to wetlands and marine vegetation. In this regard, applicant's representatives contend that all reasonable means of mitigation have been incorporated into the development plan. THE DEVELOPMENT WILL BE REASONABLY SAFE FROM FLOOD AND EROSION DAMAGE. SIXTH: According to applicant's representatives, the proposed action includes the installation of a new timber wave screens in an effort to protect against wave action. In addition, 113 cubic yards of heavy granite stone will be placed to support the lighthouse foundation. Upon consideration of the e v record, the Board is satisfied that the proposed development plan is intended to be reasonably safe from flood and erosion damage. THE RELIEF REQUESTED IS THE MINIMUM NECESSARY SEVENTH: In determining the minimum relief necessary, applicant must establish that the size and scale of the development proposal in a protective area is the minimal relief necessary to overcome the hardship or practical difficulty. East End Seaport Museum seeks to take action to strengthen this important marine navigational aide lighthouse for the common good, and to provide for better accessibility to the structure for cultural and educational purposes. The Board accepts that the proposed action is the only method of achieving those goals. As such, the Board finds the proposed activity to represent the minimal relief necessary. CONCLUSION In accordance with the powers vested with this Board pursuant to §220-24 of the Code, as the Coastal Erosion Hazard Board of Review,to hear, approve with modification or deny requests for variances or to affirm, wholly or partly, or modify the order, requirement, decision, or determination of the Administrator, by written decision, after public hearing, the Board hereby concludes as follows: The Administrative determination of the Board of Trustees is hereby reversed. Applicant's request for a Coastal Erosion Hazard Area Permit to conduct the work identified herein is hereby approved. Therefore, upon motion duly made and seconded,the members of the Board present and having voted to reverse the determination of the Board of Trustees and to grant the appeal, the application for a Coastal Erosion Hazard Area Permit is hereby granted as a Type II action under SEQRA.
