consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions,without further steps under SEQRA.
SUFFOLK' C D_-. 1I I `m w-" "CODE: This application was referred as required under
the Suffolk County Administrative Code Sections A 14-14 thru A 14-25 and the Suffolk County
Department of Planning issued its reply dated March 20, 2023 stating that this application is
considered a matter for local detennination as there appears to be no significant county-wide or inter-
community impact.
"-RZ—DE1ER.,._,, : The proposed action has been reviewed to Chapter 268, Waterfront
Consistency Review of the Town of Southold Town Code and Local Waterfront Revitalization
Program(LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency
Assessment Form submitted as well as the records available the LWRP Coordinator recommended
that the proposed action is INCONSISTENT with the LWRP because the structure was built without
the required permits. However, Building Permit 443202 was issued to the applicant prior to
construction on November 7,2018 and all required inspections were done by the Town of Southold
Inspector. The Suffolk County Board of Health issued a septic permit on September 22, 2021.
Therefore,this Board now determines that the proposed action is CONSISTENT with the LWRP.
PROPERTY FAC" The subject property consists of a nonconforming 22,995
square foot parcel located in the Residential R-40 Zoning District. The northerly property line
measures 83.61 feet adjacent to Richmond Creek.The easterly property line measures 312.94 feet;
the southerly property line measures 76.86 feet and is adjacent to a 20 foot Right of Way. The
westerly property line measures 293.81 feet. The parcel is improved with a one-story frame dwelling
with wood deck and stairs attached to the rear of the dwelling. There is a stone path walkway that
'leads to a wood deck on the westerly side of the residence with a long composite ramp that leads to
a wood floating dock. There is a 23.2 ft. by 14.3 ft. frame building south of the dwelling and north
of the gravel driveway. The accessory structure is located south of the driveway and,is 22.4 ft. by
34.2 ft.with three(3)doors, one Iarge glass door to the north, a regular entry door on the west side
and another entry door on the east side of the structure. There is an outdoor shower on a small deck

on the easterly side of the accessory structure. The property has deer fencing on both the east and
west sides up to the frame building south of the dwelling and along the front up to the frame building
on both sides. The east and west sides of the property from the driveway and deer fencing have split
raid fencing and split rail fencing in the front of the Right of Way leaving the gravel driveway open
as shown on the survey map prepared by John T. Metzger,LS and last revised-October 21,2018.
B S"JS 017 ,APPLICATION: Request for Special Exception per Code Section 280-13B(13). The
applicant is the owner of the subject property requesting authorization to establish an Accessory
Apartment in an existing accessory structure, located* 625 Woods Land, Peconic, NY.
SCTM#100086-6-7.
& "LI T_ 1 lES 113: The applicant proposes to lease the accessory structure to her son,Andrew
Burke who will live in the accessory structure. The applicant will install a kitchenette along with
expanding the existing powder room to a three piece bath by adding a shower as shown on the Floor
Plan prepared by Louis Schwartz, PE.
ADDITI NA F AT The Board received nine(9) letters along with testimony from a
neighbor who all support this application. Previously the applicant applied to the Board of Appeals
(ZBA file# 7651)to utilize the accessory structure for two (2) recreation rooms which was denied
on July 21, 2022 as recreational spaces are not a permitted accessory use. The applicant's agent
testified that the applicant's adult children used the accessory structure as temporary overflow
sleeping space during the COVID pandemic because the principal residence is small. The applicant
wished to continue to use the space as temporary overflow for family. However,pursuant to Town
Code, an accessory apartment in an accessory structure may only be occupied by a single family
member as the sole tenant with an annual lease agreement. Thus,alternatively the applicant wished
to renovate the accessory structure to create an apartment for her adult son, Andrew Burke.
Submitted with this application,is a one-year lease signed by Andrew Burke,as the lessee,and Nancy
Burke,the applicant/property owner.

P_ D[NGS,.Q FACT`. The Zoning Board of Appeals held a public hearing on this application on
July 6, 2023 at which time written and oral evidence were presented.Based upon all testimony,
documentation,personal inspection of the property and the surrounding neighborhood,and other
evidence,the Zoning Board finds the following facts to be true and relevant.
In considering this application, the Board has reviewed the code requirements set forth pursuant to
Article III, Section 280-13(B)(13) to establish an Accessory Apartment in an Accessory Structure
and finds that the applicant complies with the requirements for the reasons noted below:
1. The Accessory Apartment unit will be located on the first floor of the accessory structure with a
-conforming area of 697.77 square feet, as described and shown on the floor plan signed by L.
Schwartz,P.E. and as confirmed at 719 square feet of livable floor area by the Building Inspector in
a memorandum titled"Verification of Livable Floor Area"dated April 18,2023 and received by the
Board of Appeals on April 18,2023.
2. The dwelling unit complies with the definition of same in §280-4 of the code and complies with
all code requirements as defined in Section 280-13(B)(13)of the Zoning Code. The owner confirms
that the accessory apartment shall not contain less than 450 sq.feet, will not exceed 750 square feet
of livable floor area,on one floor with only one full bathroom.

3. The applicant herein, owns and resides at the property and will continue to occupy the single
family residence as a principal residence in conformance with the code requirements as set forth in
Article III, Section 280-13(B)(13xj, 1-4), and as documented by copies of the applicant's driver's
license,voter registration card, property taxes, and two utility bills,all listing the applicant's name
and address on Woods Lane
4. The occupants of the accessory apartment will be either a family member or a resident who is
currently on the Southold Town Affordable Housing Registry, and the occupancy shall not exceed
the number of persons permitted, in conformance with the code requirements as set forth in Article
III,Section 280-13(B)(13)0, 1-4). The tenant of the accessory apartment will be the applicant's adult
son,Andrew Burke, as evidenced by copies of a signed, undated renewable annual lease agreement
for one(1)year and rent will be paid monthly.
5. The owners' plans comply with the on-site parking requirements and provide for a total of three
parking spaces,as shown on the survey by John T. Metzger,L.S.,dated October 21,2019.
6. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility,
as authorized by Section 280-13(B)(14) hereof shall be permitted in or on premises for which an
accessory apartment is authorized or exists.
7.This conversion is/shall be subject to a building permit, inspection by the Building Inspector,
and annual renewal of the Certificate of Occupancy.

documentation, personal inspection of the property and surrounding neighborhood, and other
evidence,the Zoning Board finds the following facts to be true and relevant:
1) The Accessory Apartment, as applied for, is reasonable in relation to the District in which is
located,adjacent use districts,and nearby adjacent residential uses.
2) This Accessory Apartment shall be in conjunction with the owner's primary residence, and as
proposed will not prevent the orderly and reasonable use of districts and adjacent properties.
3) No evidence has been submitted to show that the safety,health,welfare, comfort, convenience,
order of the Town would be adversely affected.
4)The special exception is authorized under the Zoning Code through the Zoning Board of
Appeals as noted herein,and issuance of a Certificate of Occupancy from the Building Inspector is
required by code before an Accessory Apartment may be occupied.
5)No adverse conditions were found after considering items listed under Sections 280-142 and
280-143 of the Zoning Code.

2 Pursuant to Town Code,the sole occupant/tenant of the accessory apartment shall be the
applicant's adult son,Andrew Burke.
3. This Special Exception Permit requires an annual renewal by a Code Enforcement
Officer. It is the applicant's res onsibili to apply to the Building Department each year
to renew the accessory apartment permit. Failure to do so may require a public hearing
before the Zoning Board of Appeals to review potential action to revoke the Special
Exception Permit granted herein.
4.This Special Exception permit cannot be transferred to new owners
That the above conditions be written into the Building Inspector's Certi cate of Occupancy, when
issued.
Any deviation from the survey„site plan andlor architectural drawings cited in this decision, may result
in delays and/or a possible dental by the Building Department of a building permit, and may require a
new application and public hearing before the Zoning Board ofAppeals.
In the event that this is a special permit subject to conditions, the approval shall not be deemed q ective
until such time that the foregoing conditions are met: and failure to comply therewith will render this
approval null and void.
Any violations of the conditions, occupancy or other requirements described herein, may require a public
hearing before the.Zoning Board of Appeals to review potential action to revoke the Special Exception
Permit granted herein.
