SPECIAL MEETING

A Special Meeting of the Southold Town Board of Appeals was
held on Wednesday, May 27, 1981 at 5=30 o'clock p.m. at the
Southold Town Hall, Main Road, Southold, New York 11971.
Present were= Charles Grigonis, Jr., Chairman; Serge Doyen,
Jr.; Robert J. Douglass; Gerard P. Goehringer; Joseph H. Sawicki.
RESERVED DECISION: Appeal No. 2821. By application of
~9~? & Helen Puric, 1250 Second Street, New Suffolk, NY for a
Variance to the Zoning Ordinance, Art. III, Sec. 100-31 for
permission to construct addition to dwelling with an insufficient
rearyard setback at 1250 Second Street, New Suffolk, NY: bounded
north by Capaldo; west by private right-of-way; south by Victoria;
east by Kinirsky; County Tax Map Item No. 1000-117-7-23. (by
Rudolph H. Bruer, Esq. as attorney).
After reviewing all documents and testimony given concerning
this appeal, the Board made the following findings and determina-
tion:
By this appeal, appellants seek permission to construct
an addition and square off the rear portion of the existing
one-family dwelling, leaving a rearyard setback of approxi-
mately 29 feet and maintaining the southerly sideyard at two
feet. The premises in question has 40.40 feet in width and
101.62 feet in depth, containing approximately 4,100 square
feet in area. The Board finds that the character of the neigh-
borhood is similar to the instant parcel.

The Board finds that the relief requested is not substantial
in relation to the Code requirements; that the relief requested
is within the spirit of the zoning ordinance; that the variance
if granted will not change the character of the neighborhood;
that no adverse effects will be produced on available govern-
mental facilities of any increased population; that the hardship
or practical difficulty is unique; and that the interests of
justice will be served by granting the requested relief.
On motion by Mr. Goehringer, seconded by Mr. Douglass, it
was
RESOLVED, that Peter and Helen Puric be g~anted a variance
to the zoning ordinance, Art. III, Sec. 100-31 applied for in
Appeal No. 2821, SUBJECT TO THE FOLLOWING CONDITIONS:
(1) That the total structures on the subject parcel not
exceed 20% lot coverage;
(2) That the deck addition shall not be permitted to be
constructed closer than 6 feet to the southerly sideyard property
line;
(3) That this matter be referred to the Suffolk County
Planning Commission pursuant to Sections 1323, et seq of the
Suffolk County Charter rules and regulations.
Location of Property: 1250 Second Street, New Suffolk, NY;
County Tax Map Item No. 1000-117-7-23.
Vote of the Board: Ayes: Messrs. Doyen, Douglass, Goeh-
ringer, Sawicki and Grigonis.
RESERVED DECISION: Appeal No. 2817. By application of
Stephen J. Kmetz, Jr., 652 Village Drive, Hauppauge, NY 11788,
for a Variance to the Zoning Ordinance, Art. III, Sec. 100-31
to construct dwelling with insufficient front and/or rear yard
setbacks at 550 Greenway West, Orient, NY; bounded north by
McCoughlin; west by Greenway West; south by Eufemia; east by
Stuke; County Tax Map Item No. 1000-15-1-19.
After reviewing all material concerning this application,
the Board made the following findings and determination:
By this appeal, appellant seeks permission to construct a
one-family dwelling with an insufficient frontyard setback of
42 feet and rearyard at the east side Of 35 feet. The premises
in question contains an area of approximately 21,250 square feet.
The proposed dwelling will be approximately 64 feet long by 34
feet. Upon inspection, the Board finds that neighborhOod to be
nearly all vacant parcels.

The Board finds that the relief requested is not substantial
in relation to the Code requirements; that the relief requested
is within the spirit of the zoning ordinance; that the variance
if granted will not change the character of the neighborhood; that
no adverse effects will be produced on available governmental
facilities of any increased population; that the hardship or
practical difficulty is unique; and that the interests of justice
will be served by granting the variance requested subject to
certain conditions, infra.
On motion by Mr. Douglass, seconded by Mr. Sawicki, it was
RESOLVED, that .Stephan Kmetz, be granted a variance to the
zoning ordinance, Art. III, Sec. 100-31 applied for in Appeal
No 2817, SUBJECT. TO THE FOLLOWING CONDITION:
(1) That the frontyard setback be a minimum of 50 feet;
(2) That the easterly (rear) yard setback be 35 feet.
Location of Property: 550 Greenway West, Orient, NY;
County Tax Map Item No. 1000-15-1-t9.
Vote of the Board: Ayes: Messrs. Doyen, Douglass, Goeh-
ringer, Sawicki and Grigonis.
RESERVE~ DECISION: Appeal No. 2810. By application of
Karl E. Frem~sson, 11 Dodge Drive, West Hartford, CT 06107 for
a Variance for approval of access, New York Town Law Section
280-a. Location of property: Private Road, Fishers Island, NY;
more particularly known as County Tax Map ItemNo. 1000,3-6-~
and bounded north by Private Road; south east and west-.:bF.

After reviewing all material concerning this matter and
further discussion, the Board made the following findings and
determination:

By this appeal, appellant seeks a variance for approval of
access, New York Town Law, Section 280-A to premises located on
a private road at the East End of Fishers Island, New York.
The access road in question is approximately 40 feet wide. It
is the feeling of the Board that the road is adequate for egress
and ingress.
The Board finds that the relief requested is not substantial;
that the relief requested is within the spirit of the ordinance;
that the variance if granted will not change the character of the
neighborhood; that no adverse effects will be produced on avail-
able governmental facilities of any increased population; that
the hardship is unique; and that the interests of justice will
be served by granting the variance as requested with the following
below-specified condition.
On motion by Mr. Doyen, seconded by Mr. Grigonis, it was
RESOLVED, that Karl E. Fransson, 11 Dodge Drive, West Hart-
ford, CT 06107 be granted a variance for approval of access,
SUBJECT TO THE FOLLOWING CONDITION:
That the access roads be maintained passable at all times
for emergency vehicles.
Location of Property: Private Road, Fishers Island, NY;
County Tax Map Item No. 1000-3-6-4.
Vote of the Board: Ayes: Doyen, Sawicki and Grigonis.
Nayes: Messrs. Goehringer and Douglass. (Messrs. Goehringer
and Douglass felt that the access road should be improved to
a width of 15 feet and maintained improved to insure easy
accessibility and safety.)
Being there was no further business to come before the
Board at this time, the Chairman declared the meeting closed
at 5:40 p.m.
