No. 5401- PEAT Stetz Property Location: 270 North Sea Drive, Southold; 54-5-50. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 12,500 sq. ft. lot is improved with a single-family, two-story frame house with deck and garage as shown on the October 28, 2002 survey, revised November 12, 2002, by Joseph A. Ingegno, L.S. BASIS OF APPLICATION: Building Department's June 16, 2003 Notice of Disapproval, citing Sections 100-242 and 100-244 in its denial of a building permit, concerning a building permit application for a new stairway and landing addition at less than 35 feet from the rear yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 23, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a 4' x 7'6" landing and stairway with an overall length of 21 feet with a rear yard setback of 39.9 feet. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant indicated that his family has never had a rear door to their home. The addition is 4' x 7'6" landing plus stairway at the rear of the home for access purposes. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The home is 34.9 feet from the rear property line, and with the landing, the setback will be 30.9 feet. Page 2—November 6,2003 Appl.No. 5401—Paul Stetz. 54-5-50 at Southold 3. Although the relief granted is the minimum necessary, the landing results in a 4 ft. reduction of the 35 ft. code requirement. The relief requested is not substantial. 4. The difficulty was self-created in that the addition was designed after, the house,was,: built, and the fact that the house is 34.9 feet 34.9 feet from the rear property line in its present location. 5. No evidence was submitted to indicate wetland or environmentally sensitive areas, or that the grant of the relief requested will have an adverse effect or impact on physical or environmental conditions in the neighborhood or district in any other manner. The area is surrounding by a seasonal,residential community with many smaller one and two-story homes;on nonconforming,lots. 6. Grant of the.relief requested is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a landing and stairway, while preserving and protecting the,character of the neighborhood and the health, safety and welfare;of the community.
