Dear Ms. Setchell:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, August 14, 2024 regarding the above matter:
WHEREAS, Taplow Consulting, Ltd. on behalf of WATERVIEW REVOCABLE TRUST
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold, and
Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas, application
dated February 2, 2024, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: no disturbance of Bank Swallows in
accordance with DEC regulations; and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on May 15, 2024, again on July 17, 2024, and again on August 14, 2024, at
which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the project complies with the standards set forth in Chapter 275 and
Chapter 111 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees APPROVE the application of WATERVIEW
REVOCABLE TRUST to install 120 linear feet of rock revetment consisting of boulders
at a maximum of 2.5 tons per lineal foot along existing bottom of bluff with 4"-12"
bedding stone atop stabilization fabric continuous under revetment; importing 40 cubic
yards of clean sand fill from upland sources and re-vegetating disturbed bluff areas with
Cape American beach grass plugs at 12" on center for entire disturbed area; install non-
treated 2"x12" terrace boards every 10' along bluff face in un-stabilized areas only;
shave back areas of top of bluff to create a new bluff crest; along new top of bluff, install
a 1' high berm with approximate base of 5' at top of bluff, cover with one layer of jute
matting O/E; and install and perpetually maintain a vegetated non-turf buffer seaward of
the house at top of the bluff using native vegetation; with the conditions that the rock
revetment start at the existing toe of bluff and not exceed more than 6' seaward of the
existing toe; no disturbance of the Bank Swallows in accordance with DEC regulations;
inspection one-week prior to construction with the area staked-out; and as depicted on
the site plan prepared by Taplow Consulting Ltd., received on October 25, 2024, and
stamped approved on October 29, 2024.
Permit to construct and complete project will expire three years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.

TERMS AND CONDITIONS
The Permittee Waterview Revocable Trust, 905 Aquaview Avenue East Marion New York as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed.pursuant to this permit, and the said Permittee will,at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 36 months,which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the ctnirfiire nr nrniPrt.invnlvPr�-,tp provide evidence to anyone concerned that

authorization was.originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7: That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar y
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
11. No right to trespass or-interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

Permits: TIDAL WETLANDS
1. Conformance With Plans All activities authorized by this permit must be in strict conformance
with the approved plans submitted by the applicant or applicant's agent as part of the permit application.
Such approved plans were prepared by Taplow Consulting Ltd., last revised August 20, 2024, stamped
approved by NYSDEC on September 23, 2024.
2. Post Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous
location on the worksite and adequately protected h•om the weather.
3. Notice of Commencement At least 48 hours prior to commencement of the project, the permittee
and contractor shall sign and return the top portion of the enclosed notification form certifying that they
are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion
of project, the bottom portion of the form must also be signed and returned, along with photographs of
the completed work.

4. Prohibition Period for Nesting Birds To protect nesting bank swallows, no regulated activities
may occur between May I and August 31, inclusive, oFany calendar year.
;. No Construction Debris in Wetland or Adjacent Area Any debris or excess material Prom
construction of this project shall be completely removed from the adjacent area (upland) and removed to
an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas.
6. Materials Disposed at Upland Site Any demolition debris, excess construction materials, and/or
excess excavated materials shall be immediately and completely disposed or In an authorized solid
waste management facility. "These materials shall be suitably stabilized as not to re-enter any water
body, wetland or wetland adjacent area.
7. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal
wetlands or protected bUlTer areas as a result of the permitted activities.
8. No Unauthorized Fill No [ill or back-Fill is authorized by this permit without Further written
approval from the department (permit, modification, amendment).
9. Excavation for Bulkhead/Structure Prior to any construction or removal of bulkhcads and other
shoreline stabilization structures all backfill shall be excavated landward ofthe structure and retained so
as not to enter the waterway. tidal wetland or protected buffer area.
lo. Wood Preservatives
a. Pressure treated wood used for construction of in-water structures must have undergone a
treatment process approved (stamped or otherwise marked as certified) by the American Wood
Preservative Association.
b. Wood treated with Pentachlorophenol (PCP) must not be used in marine or brackish waters. Wood
treated with PCP must be aged in the open air for at least three months prior to in-water use.
c. The use of creosote treated wood is prohibited both in the water and upland areas.
d. Chr•omated Copper Arsenate (CCA) pressure treated wood must be clean and free of CCA surface
deposits. Wood with surface deposits trust be washed for at least 5 minutes under running water
prior to use. The washing must occur greater than 100 feet landward of any regulated wetland
and/or water body. (Note "E." below For handling wash water.)
e. Any wood debris such as sawdust or wash water must not enter any water body, including
wetlands or protected buffer areas.

12. Long-term Plant Survival The bluff and berm shall be planted with American beachgrass and the
permittee shall enSUre a mrnlmUm Of 85% survival of plantings by the end of Five growing seasons. If
this goal is not met, the permit holder shall re-evaluate the restoration project in order to determine how
to meet the mitigation goal and submit plans to be approved by the office, OIL

13. No Runoff down Bluff or onto Beach There shall be no discharge of runoff or other effluent on,
in or down the bluff face or onto the beach.
1=4. Install, Maintain Erosion Controls Necessary erosion control measures, i.e., straw bales, silt
fencing, etc., are to be placed on the downslope edge of any disturbed area. This sediment barrier is to
be put in place before any disturbance of the ground occurs and is to be maintained in good and
functional condition until thick vegetative cover is established.
t5. No Alteration of Bluff for Stairway Alteration of the existing grade of the bluffor hill during
construction of the stairway is prohibited.
16. Stairway Design The stairway must be elevated a minimum of 4 feet over grade to minimize
disturbance or loss of the natural vegetation and reduce the potential for causing or accelerating erosion
of the bluff or hill. Disturbance to the natural vegetation or topography seaward of the crest (top) of the
bluff or hill must be restricted to an 8-foot wide area, including the width of the stairway, as shown on
the approved plans.
17. Equipment, Material Stored Away from Crest of Bluff The storage of construction equipment
and materials shalt be confined to upland areas landward of the crest of the bluff or hill.
18. Incidental Disturbance to Vegetation It is the responsibility of the applicant to remedy any
incidental disturbances resulting in damage or removal of wetland vegetation. Upon completion of
construction activities, any disturbed areas shall be planted with the appropriate marsh vegetation.

t9. Contain Exposed, Stockpiled Soils All disturbed areas where soil will be temporarily exposed or
stockpiled for longer than 48 hours shall be contained by a continuous line of staked haybales/ silt
curtains (or other NYSDEC approved devices) placed on the seaward side between the fill and the
wetland or protected buffer area. Tarps are authorized to supplement these approved methods.
20. Maintain Erosion Controls All erosion control devices shall be maintained in good and functional
condition until the project has been completed and the area has been stabilized.
21. Precautions Against Contamination of Waters All necessary precautions shall be taken to
preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents,
lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleteriOus materials
associated with the project.

22. State Not Liable for Damage The Slate of New York shall in no case be liable for any damage or
injury to the structure or work herein authorized which may be caused by or result from future
operations undertaken by flip, Stnle for the conservation or improvement of navigation, or for other
purposes, and no claim or right to compensation shall accrue from any such damage.
23. State May Order Removal or Alteration of Work If future operations by the State of New York
require an alteration in the position of the structure or wort: herein authorized, or if, in the opinion of the
Department of Environmental Conservation it shall cause unreasonable obstruction to the free
navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the
State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the
Department to remove or alter the structural work, obstructions, or hazards caused thereby without
expense to the State, and if, upon the expiration or revocation ofthis permit, the structure, till,
excavation, or other modification of the watercourse hereby authorized shall not be completed, the
owners, shall, without expense to the State, and to such extent and in such time and manner as the
Department of Environmental Conservation may require, remove all or any portion of the uncompleted
structure or fill and restore to its former condition the navigable and flood capacity of the watercourse.
No claim shall be made against the State of New York on account of any such removal or alteration.
24. State May Require Site Restoration If upon the expiration or revocation of this permit, the
project hereby authorized has not been completed, the applicant shall, without expense to the State, and
to such extent and in such time and manner as the Department of Environmental Conservation may
lawfully require, remove all or any portion of the uncompleted structure or till and restore the site to its
former condition. No claim shall be made against the State of New York on account of any such
removal or alteration.

I. Facility Inspection by The Department The permitted site or facility, Including-rele.vant_records,
is subject to inspection at reasonable hours and intervals by an authorized representative of the w.. ....._..
Department of Environmental Conservation (the Department)to determine whether the permittee is
complying with this permit and the ECL. Such representative may order the work suspended pursuant
to EC 71- 0301 and SAPA 401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection
to the permit area when requested by the Department.
A copy of this permit, including all referenced maps, drawings and special conditions, must be available
for inspection by the Department at all times at the project site or facility. Failure to produce a copy of
the permit upon request by a Department representative is a violation of this permit.
2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly
provided for by the Department, issuance of this permit does not modify, supersede or rescind any order
or determination previously issued by the Department or any of the terms, conditions or requirements
contained in such order or determination.

3. Applications For Permit Renewals, Modifications or Transfers The permittee must submit a
separate written application to the Department for permit renewal, modification or transfer of this
permit. Sueh application must include any forms or supplenlenlal inlormation the Department requires.

4. Submission of Renewal Application The permittee nlLlst submit a renewal application at least 30
days before permit expiration for the following permit authorizations: Tidal Wetlands.
5. Permit Modifications, Suspensions and Revocations by the Department The Department
reserves the right to exercise all available authority to modify, suspend or revolve this permit. The
grounds for modification, SLISI)CIISI011 or revocation InClllde:
a. materially false or inaccurate statements in the permit application or supporting papers;
b. failure by the permittee to comply with any terms or conditions of the permit;
c. exceeding the scope ol�the project as described in the permit application;
d. newly discovered material inrormation or a material change in environmental conditions,
relevant technology or applicable law or regulations since the issuance of'the existing permit;
e. noncompliance with prevlOLlSly ISSLIed permit conditions, orders of the commissioner, any
provisions of the Environmental Conservation Law or regulations of the Department related to
the permitted activity.
h. Permit Transfer Permits are transferrable unless specifically prohibited by statute, regulation or
another permit condition. Applications for permit transfer should be submitted prior to actual transfer of
ownership.

Jeffrey Patanjo on behalf of WATERVIEW REVOCABLE TRUST requests a Wetland Permit and a Coastal
Erosion Permit to install 120 linear feet of rock revetment consisting of boulders at a maximum of 2.5 tons per
lineal foot along existing bottom of bluff; importing 40 cubic yards of clean sand fill from upland sources and
re-vegetating disturbed bluff areas with Cape American beach grass plugs at 12" on center for entire
disturbed area; install non-treated 2"x12"terrace boards every 10' along bluff face in un-stabilized areas only;
and install and perpetually maintain a 10'wide non-turf buffer along the landward edge of the top of the bluff.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The
proposed action is recommended as INCONSISTENT with Policy 6 Protect and restore the quality and
function of the Town of Southold's ecosystem of the LWRP.
A bank swallow colony was reported nesting (burrows) in the bluff. Bank swallows are federally
protected by the Migratory Bird Treaty Act The action includes manipulating the bluff face and slope
and disturbing the soil. It does not meet the policy below in that a physical loss to the bank swallow
habitat would occur.
A. Avoid adverse changes to the Long Island Sound and the Peconic Bay ecosystems that would
result from impairment of ecological quality as indicated by:
1. Physical loss of ecological components
Physical loss is often the most obvious natural resource impairment to identify. It
usually results from discrete actions, such as filling or excavating a wetland or
clearing an upland forest community prior to development.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

Jeffrey Patanjo on behalf of WATERVIEW REVOCABLE TRUST requests a Wetland Permit and a Coastal
Erosion Permit to install 120 linear feet of rock revetment consisting of boulders at a maximum of 2.5 tons per
lineal foot along existing bottom of bluff; importing 40 cubic yards of clean sand fill from upland sources and
re-vegetating disturbed bluff areas with Cape American beach grass plugs at 12"on center for entire
disturbed area; install non-treated "°x12"terrace boards every 10' along bluff face in un-stabilized areas only;
and install and perpetually maintain a 10'wide non-turf buffer along the landward edge of the top of the bluff.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The
proposed action is recommended as CONSISTENT with the LWRP provided the following is required to
meet Policy 6.
1- Prohibit the use of boulders occurring on the beach.
2. Prohibit impeding shoreline access from revetement to the high water mark.
3. Establish survivability rates for planted materials.
4. Consider the"tie-in"with the shoreline erosion controls on the left and right of the parcel.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

At the meeting of the Southold Town Conservation Advisory Council held on Wed., May 8,
2024, the following recommendation was made:

The project includes the installation 120 LF rock revetment consisting of boulders at a maximum of 2.5
tons per lineal foot along existing bottom of bluff, importing 40 CY of clean sand fill from upland sources
and re-vegetating disturbed bluff areas with cape America beach grass plugs at 12"on center for entire
disturbed area,to also install un-treated 2"x12"terrace boards every 10'along bluff face in un-stabilized
areas only, install a 10'wide non-turf buffer at top of bluff.

Permit to install 120 linear feet of rock revetment consisting of boulders at a
maximum of 2.5 tons per lineal foot along existing bottom of bluff; importing 40 cubic
yards of clean sand fill from upland sources and re-vegetating disturbed bluff areas
with Cape American beach grass plugs at 12" on center for entire disturbed area;
install non-treated 2"x12" terrace boards every 10' along bluff face in un-stabilized
areas only; and install and perpetually maintain a 10' wide non-turf buffer along the
