A ~pecial Meeting of the Southold Town Board of Appeals was
held on Monday, June 1, 1981 at 4:30 o'clock p.m. at the Southold
Town Hall, Main Road, Southold, New York 11971.
Present were: Charles Grigonis, Jr., Chaiz~man; Gerard P.
Goehringer; ~oseph H. Sawicki. Absent were: Serge J. Doyen, Jr.;
Robert J. Douglass. The Waiver of Notice of this meeting was
executed by all Board members.
The Chairman opened the Special Meeting at 4:30 o'clock p.m.
Motion was made by Fm. Grigonis, seconded byMr. Goehringer,
that the following appeal be scheduled and advertised for public
hearing to be held at the next regular meeting of this Board, to
wit, June 11, 1981 at the Southold Town Hall, Main Road, Southold,
New York:

9. 0 ~.m. Appeal of Emanuel M. Kontokosta, To construct
additional residential units, a coffee shop, administra-
tion office and swimming pool in an M-1 Zoned DCstrict
(and deleting the 21 motel units as previously'~ranted
1/17/80). West side of Shipyard Lane, East Marion, NY.
Vote of the Board: Ayes: Messrs. Grigonis, Goehringer and
Sawicki. (Messrs. Doyen and Douglass were absent.)

On motion by Mr. Grigonis, seconded by Mr. Sawicki, it was
RESOLVED, to declare the following Negativ® Environmental
Declaration concerning the matter of Emanuel M. KOntokosta in Appe~'
~0- 2772:
E-~U~LRONMENTAL DECLARATION:
Pursuant to Section 617.13 of the N.Y.S. Department of
Environmental Conservation Act, Article 8 of the Environmental Conser-
vation Law, and Section 44-4 of the Southold Town Code, notice is
hereby given that the Southold Town Board of Appeals has determined
that the subject project as proposed herein is hereby classified as
a Type I Action not having a significant adverse effect upon the
environment for the following reason(s):
Au Environmental Assessment in the Long Form has been
submitted which indicates that no signifiCant adverse effects
were likely to occur should this project be implemented as planned.
This department is in receipt of correspondence dated
May 27, 1981 from the Suffolk County Department of Health Services
indicating a preliminary incurso~y review of this project indicates
the 45 condominium units equals 27,000 gallons per day ~ewage flow;
aucilliary buildings are rated at 2,450 gallons per day; indicating
a total daily sewage flow from the site at 29,400 gallons which is
under the Department's current limitation for use of individual
sanitary systems; and therefore their office has no objection to
the application.
This department has also been assured by the N.Y.S. Depart-
ment of Environmental Conservation by conversations had May 29, 1981
at the Stony Brook office that they also agree with this Board's
determination of non-significance for this amended project and that
written correspondence would be submitted as early as possible.
This declaration should not he,considered a determination
made for any other department or agency which may also be involved,
nor for any other project not covered by the subject appeal appli-
cation.
Vote of the Board: Ayes: Messrs. Grigonis, Goehringer and
Sawicki. (Absent were Messrs. Doyen and Douglass.)
The Chairman declared the meeting adjourned at approximately
~:~5 o'clock p.m.

WE, the undersigned, being members of the Board of Appeals of
the Town of Southold, Suffolk County, New Yo~k, do hereby severally
waive notice of the time, place and purpose of the meeting of the
Board of Appeals to be held at the Southold Town Halt, Main Road,
Southold, New York on Monday, Jtt~e i, i98i, at ~:30 ~.m.
and do hereby consent that the same be held on said date for the
transaction of any business which may properly come before said
meeting.
