Box 1179 Southold, NY 11971 Re: Golf Simulators/ Times Review Building -7785 Main Road, Mattituck, NY Dear Mr. Verity: As requested, I reviewed the existing sewage disposal system for the above referenced property to determine if Suffolk County Department of Health Services (SCDHS) review is required. I spoke with Lewis, who is a reviewer with the commercial section at SCDHS, he told me that the existing sewage disposal system may be used if it was permitted by the SCDHS and if the proposed sanitary flow can be accommodated by the existing system. The existing sewage disposal system currently installed was approved by the Suffolk County Department(SCDHS) of Health Services at the time of the construction of the building in 1991. The existing sewage disposal system consists of a precast 900-gallon septic tank and two precast 8'diameter x 8'deep leaching pools. The system has a capacity of 450 GPO. The building will be used for office space and recreational space (golf simulators). The proposed sewage flow is 423 GPO which is less than 450 GPO. Based on my observations and to the best of my knowledge,the existing sewage disposal system on the property is adequate for the proposed uses and review by the SCDHS is not required for this project. The subject property is improved with a two-story frame office building, roof over open porches, brick pathways, access stairs to cellar entrance, asphalt pavement entrance drive and labeled parking spaces, various electric transformers, multiple air condenser units, parking area lamp posts, a metal 'walkway' connecting the subject property rear parking lot with the adjacent lot to the east's parking lot, and an elevated tennis court enclosed by fencing,as shown on the survey by Nathan Taft Corwin,III,Land Surveyor and dated April 27,2022. BASIS OF APPLICATION: Applicant requests a Special Exception under Article III, Section 280-48B(6) to establish and operate a fully enclosed commercial recreation facility;at:7785 Main Road,Mattituck,NY. SCTM No. 1000-122-6-29.1. RELIEF REQUESTED: The applicant proposes altering the use of a Town of Southold Planning Board approved commercial office building to a fully enclosed recreational membership facility golf simulator. No alterations of the exterior of the building,parking areas,access paints or to the raised tennis court are proposed by the applicant. Town of Southold Zoning Code,for the B (Business) zone allows the proposed use by Special Exception. Improvements on the subject parcel are covered by Certificate of Occupancy#Z-16874,dated May 16, 1988 for the construction of a`newspaper building'. The parcel is also the beneficiary of two prior decisions of this Board, #4069 dated December 16, 1991 permitting exterior lighting at the raised tennis platform with conditions and file #3420 dated December 20,1985 creating the lot as part of a subdivision where insufficient lot width exists. The applicant/tenant provided floor plans and a parking and site plan labeled A-1, A-2, & SP-1, prepared by Zackery E.Nicholson,Registered Architect and dated February 22,2023. The applicant proposes to establish four(4)golf simulator`bays' as Phase I of the interior alterations followed by Phase 2(at an unknown date)establishing an additional 4 golf simulator`bays:' During Phase 1 the property owner will maintain a private office in the future expansion area. The applicant has provided in excess of 25 parking spaces for the facility's patrons and employee use. An immediate neighbor addressed the Board during the public hearing relative to the raised platform tennis located at the rear of the subject-site. They indicated that the tennis platform was built encroaching on their property, by approximately 1.5 feet at one corner and its use is limited by ZBA decision 94069 in that exterior lighting may not extend after 1 Opm and that the improvement cannot be used commercially. The applicant stated that they have no intention of using the tennis court as part of their golf simulator business, that their business will be confined to the interior of the building,and that the platform tennis court was built with a valid Town of Southold Building permit and can continue to be used by the property owner and tenant. No other member of the public or an immediate neighbor spoke in favor of or against this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 1,2023 at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: The Board has reviewed the General Standards governing Special Exception uses set forth in Section 280-142 and finds: A. That the use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts. The existing building is approximately 6,400 square feet (footprint) and was constructed in 1998 for The Suffolk Times/News Review newspapers. The exterior of the building will not change or be altered in anyway;however,the interior will be reconfigured as follows: approximately 4,000 square feet to accommodate 4 separate golf simulator bays/partitions and a common area serving as a lobby, lounge and general congregation area. B. That the use will not prevent the orderly and reasonable use of permitted or legally established uses in the district wherein the requested use is located or of permitted or legally established uses in adjacent use districts. The property is zoned B and surrounded by commercial uses. The proposed recreational use will not interfere with the commercial uses in the district or in the surrounding area. The building is large with surrounding open space and generous setbacks. The building was constructed with 33%landscaping and only 13%lot coverage. The proposed operation will not interfere with the surrounding businesses. The surrounding buildings are medical and professional office buildings which have limited office hours and are generally closed on the weekend. The medical offices operate with scheduled appointments. The recreational use is inside the building and the building has sufficient parking,as evidenced in the Town of Southold Planning Board approved site plan and based on individual Board members site inspection. C. That the safety,"the health,the welfare,the comfort,the convenience, or the order of the town will not be adversely affected by the proposed use and its location. The use is a benefit to the community. Indoor recreational activities are very limited in Southold Town. The proposed use is an individual and household activity. The owners hope to coordinate with the local school's golf teams for practice and training during inclement weather. Community programs would be pre-scheduled and not adversely affect the Town at large. D. That the use will be in harmony with and promote the general purposes and intent of this chapter. As a Special Permit use,the use will be in harmony with the B zoning. Indoor recreational activities are generally welcomed in the community. This use is intended for individuals,households and friends to enjoy wholesome social/sport activities. There are no age restrictions for simulator golf. E. That the use will be compatible with its surroundings and with the character of the neighborhood and of the community in general, particularly with regard to visibility, scale and overall appearance. The existing building was designed and constructed for a newspaper(Suffolk Times)and has been unoccupied since the newspaper relocated elsewhere in Mattituck. The building is perfect for the proposed recreational use— offering high ceilings, extensive space, and good ventilation. The existing interior, as proposed to be partitioned for the golf simulators in private 17 feet by 18 feet areas, will maintain separate areas and the overall peace and quiet of the larger space identifying its unique bamlike design. F. That all proposed structures, equipment, and material shall be readily accessible for fire and police protection. The existing building was constructed to code and compliant with fire and handicap accessibility. The applicant has an adaptive re-use of an existing building. G.That the proposal shall.comply with the requirements of Chapter 236, Stormwater Management,because the existing building will not be changed. Any construction will be limited to the interior space. The existing building was constructed with a full drainage system/drywell, per town code, as shown in the building department records and issuance of the Certificate of Occupancy,#Z-16874,dated May 16, 1988"- In making such determination,consideration was also given to: A. The character of the existing and probable development of uses in the district and the peculiar suitability of such district for the location of any of such permitted uses. B. The conservation of property values and the encouragement of the most appropriate uses of land. C. The effect that the location of the proposed use and the location that entrances and exits may have upon the creation or undue increase of vehicular traffic congestion on public streets,highways or sidewalks to assure the public safety. D. The availability of adequate and proper public or private water supply and facilities for the treatment, removal or discharge of sewage,refuse or other effluent(whether liquid,solid,gaseous or otherwise) that may be caused or created by or as a result of the use. E. Whether the use or the materials incidental thereto or produced thereby may give off obnoxious gases, odors,smoke or soot. F. Whether the use will cause disturbing emissions of electrical discharges,dus; light,vibration or noise. G. Whether the operation in pursuance of the use will cause undue interference with the orderly enjoyment by the public of parking or of recreational facilities,if existing or if proposed by the Town or by other competent governmental agencies. Whether a hazard to life,limb or property because of fire,flood,erosion or panic may be created by reason of or as a result of the,use or by the structures to be used therefor or by the inaccessibility of the property or structures thereon for the convenient entry and operation of fire and other emergency apparatus or by the undue concentration or assemblage of persons upon such plot. J. Whether the use or the structures to be used therefore will cause an overcrowding of land or undue concentration of population. K. Whether the plot area is sufficient,appropriate and adequate for the use and the reasonably anticipated operation and expansion thereof. L. Whether the use.to be operated is unreasonably near to a church,school,theater,recreational area or other place of public assembly. M. Whether the site of the proposed use is particularly suitable for such use. N. Whether adequate buffer yards and screening can and will be provided to protect adjacent properties and land uses from possible detrimental impacts of the proposed"use. O. Our response: According to the Exception in Section 1004.5 of the BCNYS,the code official can approve a design occupant load that's smaller than the amount that's calculated using Table 1004.5 in the BCNYS.According to Section [NY1106.2.1 of the BCNYS,the code official can require whatever information they need to be assured that the reduced design occupant load satisfies the intent and at least maintains the level of safety of the Uniform Code. Code sections considered for our response included but were not limited to the following excerpt from the 2020 Building Code of NYS(BCNYS): --Section 1004.5 Areas without fixed seating. The number of occupants shall be computed at the rate of one occupant per unit of area as prescribed in Table 1004.5. For areas without fixed seating,the occupant load shall be not less than that number determined by dividing the floor area under consideration by the occupant load factor assigned to the function of the space as set forth in Table 1004.5. The rear corner portion of the building is going to remain a B occupancy used by the owner (golf recreational use is another tenant). These two uses will be fire separated. The question I have is regarding the calculation of the A-3 space in the golf bay areas. The architect states that each bay will hold 8 people and,the total occupant break down for the A-3 portion will be 61 people. I have attached the plan that was submitted with all of the breakdowns.
