The LWRP Coordinator issued a recommendation dated December 29,2022. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. Based on prior variance approvals granted to this property, the proposed action is considered CONSISTENT with LWRP. The parcel is oddly shaped and has 32.29 feet of concrete retaining wall frontage on Orient Harbor. The parcel runs 59.88 feet along Oak Court, 325.14 feet on the East side,and 246.21 feet on the west side before turning 37.98 feet on the Northwest side and then running 80 feet on the west side back to oak court. The parcel is improved with a one-story frame house, a frame shed, a concrete retaining wall, and a wooden jetty as shown on a survey prepared by John Metzger, LLS, last revised July 15, 2021 BASIS OI APPLICATION: Request for Variances from Sections 280-124 and the Building Inspector's September 12, 2022, Notice of Disapproval based on an application for a building permit to construct additions and altcratiors g single-family g located less than the code required minimum side yard setback of 10 feet,;, to an existing si��t>le-fn�il dwelling, 1) 2) located less than the code required minimum combined side yard setback of25 feet; at: 120 South Lane, (Adj. to Orient Harbor) East Marion, 'NY, SCTM#1000-37-6-3.4. RELIEF REQUESTED: The applicant requests a variance to elevate the existing single-family residence two feet, and to reconstruct an existing concrete stoop with a non-conforming setback of.5 from the side yard property line Page 2,January 19,2023 #7733, Thorp SCTM No. 1000-37-6-4 which will also result in a combined side yard setback of 15.8 feet. The Town Code requires a side yard setback be at least 10 feet and the combined side yard setback to be at least 25 feet. ADDITIONAL INFORM l Lt : This application is exactly the same as previous amended variance# 7218. The applicant is proposing to raise the house and install a new foundation. The owner did not start the project in the allowable time frame for variance relief, therefore the variance expired. As with the previous application, the Building Department has determined that the applicant does not need variance relief for the non-conforming front yard setback since it is existing and will only be lifted, not moved. In the previous variance application, the LWRP concluded that the project was Exempt from LWRP review, and the current LWRP review it was determined that the application is Inconsistent with the LWRP. An email was received from the adjacent property owner who expressed concerns for the project damaging their underground sprinklers, while also having no objections to the project. The applicant has a moon-conforming sized lot that is oddly shaped, The house's side yard setback and combined side yard setback already exist as non-conforming and any demolition and reconstruction or additions and alterations avill require the benefit of"an area variance. 3. Town Law §267-b(3)(t.JC3J. The variances granted as amended hercin are mathematically substantial, representing 95% relief frorn the code for the single side yard setback and 38.8 % relief from the coda for the combined side yard setback. However, the single side yard setback exists, and tlae non-conforming combined side yard setback is characteristic of the neighborhood, Thera., is also a Coastal 1:'rosion Hazard. Area (CC:HA) line that crosses the property on a small flag portion of the property that extends to ,lardiners Bay. The house is set back apprroxinaately 2 19 feet from the high-water mask,and therefore dons not impact the residence, which is proposed to be raised to FEMA standards, thereby mitigating any inconsistencies with the LWRP. 4. Town Law 267-b 3 b' 4 . No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town''s Storm Water Management Code and install leaders and gutters and upgrade the existing septic system to an alternative waste water mana,gernent system approved by the Suffolk County Department of Health. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267 b Grant of the requested relief as amended is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new stoop on a raised and renovated house while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
