ZIMMERMAN oofhold Town Clerk Property Location: 500 South Lane, East Marion; CTM 1000-38-6-11 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's +/-12,000 sq. ft parcel has 67.34 ft. frontage along the south side of South Lane, in East Marion, and is improved with a two-story frame dwelling, breezeway and garage as shown on the July 28, 1995 survey prepared by Peconic Surveyors, P.C. The property is adjacent to Gardiners Bay and private beach area owned now or formerly by Old Orchard Association. BASIS OF APPLICATION: Building Department's July 29, 2003 Notice of Disapproval, citing Sections 100-33 and 100-242A, in its denial of a building permit application for " construction of a breezeway addition between the existing garage and the applicant s dwelling. The connection does not qualify as a dwelling addition between an accessory buildingiand principal building because the Code limits the size to 8'x 10'. The Building Department determines the garage an accessory building since it is not fully enclosed or attached:as living area, and accessory buildings are required by the Code to be located in the rear yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on September 25, 2003, at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant is requesting approval of a 10' x 9'6" breezeway between the existing detached garage and the applicant's dwelling. The breezeway is not enclosed as living area. The garage is in a front yard, north of the house, at 65'7" from the property line along South Lane, 27 feet from the westerly property line, and 21 feet from the easterly lot line (10 ft. wide right-of-way). REASONS FOR. BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: \ I � 0 Page 2—October 9,2003 Appl.No.5391 —Ellen Zimmerni''an 38.-6-11 at East Marion 1. Grant of the relief requested will notproduce an undesirable change e in the.character q 9 of the neighborhood or a detriment to nearby properties. The neighborhood is primarily developed with homes on nonconforming lots and of equal size. The applicant's home does not front directly on Orient Harbor, and is divided by a separately owned Association beach lot. There is no change in the yard location, setbacks or size of the garage, breezeway, or dwelling- that exists. On waterfront parcels, a garage may be located in.a front yard as an accessory building - without an 8 x 10' breezeway or fully enclosed addition to the dwelling. Applicant's property is only 12 feet from a private beach area and wood bulkhead adjacent to Gardeners Bay (a/k/a Orient Harbor), which 'technically is a non-waterfront parcel. On non-waterfront parcels, accessory buildings are a required to be located inrearr ye ard' and 'the arae is in a front yard, as an Q , e . , g g 'accessary, rather than as a fully enclosed addition to the dwelling. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant,to pursue, other than an area variance. The house has an existing breezeway between the house and garage. This,breezeway does not meet the code's definition of a breezeway which should be no more than 80 sq, ft. The applicant's breezeway is less than 100 sq. ft. (95 sq. ft;), and the garage and breezeway have existed for many years. 3. The variance granted herein is not substantial in relation to the code requirement. 4. The difficulty was self-created when the garage was built without conformity to the Town Code requirements. 5. There is no evidence that the grant of the relief will have an adverse effect or impact on physical or environmental conditions in the neighborhood or district 6. Grant of the relief requested is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage with breezeway, while preserving and protecting, the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Oliva, seconded by Chairwoman Tortora, and duly carried, to GRANT the variance as applied for, as shown on the 3/20/2003 plan prepared by Architechnologies and the July 28, 1995 survey prepared by Peconic Surveyors, P.C. The existing breezeway is noted as being 10 X 10 and therefore, creates a non-conforming accessory garage,which is not permitted pursuant to Article III Section 100-33, which states; "In the Agricultural-Conservation District and Low-Density Residential R-80, R-120, R-200 and R-400 Districts,accessory buildings and structures or other accessory uses shall be located in the required rear yard." The existing accessory garage is noted as being in the front yard. Total lot coverage,following construction, will be 13 percent. i. ZIMMERMAN: My understanding is that what we want to do is we've done 11 substantial renovations to my house, and as it turned out, there was never a C of 0 on the 12 garage and the breezeway. Why that was so, I don' t know. I bought the house in 1996 . The 13 house was built in 1967 . What we want to do now is fix up 14 the garage, reshingle it, change the roof line so it will conform with the house ' cause now 15 it' s a little askew and just leave the breezeway and the footprint of the garage the 16 way they exist . But my understanding is that the breezeway dimensions don' t conform to 17 current zoning regulations. I have a letter here from my 18 neighbor Edith Minnigan stating that they have owned their property since 1964 and that to 19 their knowledge the garage and the breezeway have existed as long as the house, and she has 20 no objection to my doing whatever I want to do. So I' ll give that to you (handing) . 21 CHAIRWOMAN TORTORA: Thank you very much. Couple of questions . 22 MS . ZIMMERMAN: Sure . CHAIRWOMAN TORTORA: I confess, 23 I'm a little confused on the notice of disapproval on this. I read it . I visited 24 the site, and I also studied the file quite extensively and apparently I understand that 25 the breezeway does not meet the definition of a breezeway because instead of being a maximum COURT REPORTING AND TRANSCRIPTION SERVICE (631) 878-8047 As 36 1 2 of 80 square feet, or eight by ten; it' s ten by ten, that much `i understand, but the notice 3 of disapproval also says that the existing accessory garage is noted as being in the 4 front yard. It' s a waterfront lot; is it not? MS . ZIMMERMAN: Yes, it 5 CHAIRWOMAN TORTORA: Your property Ir directly abuts Gardiner' s Bay or is Lot Number 6 10 in separate ownership? MS. ZIMMERMAN: The beach and the 7 right-of-way next to my house are owned by the homeowner' s association: I I , al 8 CHAIRWOMAN TORTORA: That' s the question. Then your property does not -- 9 MS. ZIMMERMAN: My property technically does not abut the bay. 10 CHAIRWOMAN TORTORA: I see. So that is where we come into the issue that it 11 is no longer a waterfront lot . MS. ZIMMERMAN: That' s correct . 12 Although there would be no other place to put a garage. 13 CHAIRWOMAN TORTORA: I understand that . We' re talking about a situation that' s 14 existing. That clarifies that because it is not directly abutting Gardiner' s Bay and I see 15 Mr. Notaro shaking his head. CHAIRWOMAN TORTORA: Somehow we 16 now have the accessory garage as being in the front yard. Over the breezeway, is it 17 enclosed? MS. ZIMMERMAN: It is enclosed. 18 Yeah. CHAIRWOMAN TORTORA: There' s a 19 roof on it? BOARD MEMBER OLIVA: There' s a 20 roof and no sides . There' s no sides . It doesn' t connect . You don' t have a door. No 21 windows because I was there . MS. ZIMMERMAN: That' s right . And 22 my neighbor, Mrs . Minnigan, has basically the same situation with her garage in her front 23 yard, and she also does not own -- the beach in front of her house is also owned by the 24 neighborhood association. Ma' am, you made statements this morning that 6 you' re doing major renovations to your house and garage; is that correct? 7 MS. ZIMMERMAN: Major renovations to the house have been completed. We had the 8 proper approvals for that, and now that the house is done, the garage looks a little on 9 the shabby side . But it also has -- the roof line is a little askew, and we want to even 10 that out . BOARD MEMBER HORNING: Will it 11 remain a garage? MS. ZIMMERMAN: It will remain a 12 garage. BOARD MEMBER HORNING: So while 13 you' re doing this roof work, could you not tear down the breezeway and make a conforming 14 size breezeway? MS . ZIMMERMAN: I suppose we 15 could, but I don' t really want to make any 3 more changes to the footprint of the garage 16 than I need to. ZIMMERMAN: Well, the only way 18 to make it fit the right dimensions would be to make the garage -- move the garage to the 19 house . CHAIRWOMAN TORTORA: She would 20 have to shorten it, I believe . BOARD MEMBER HORNING: I thought it 21 was ten feet wide and ten feet from the garage to the house . 22 MS. ZIMMERMAN: My understanding is that that makes it too -- 23 BOARD MEMBER HORNING: Wide . MS . ZIMMERMAN: No . The distance 24 between the house and the garage is too large . The July 28, 1995 survey prepared by Peconic Surveyors, P.C. shows that the subject premises is improved with a two-story, single-family dwelling and garage. Also shown on the sur'ey along the easterly property line are: (a) a 10'wide right-of-way to the beach, and (b) beyond the southerly property line of the applicant's property are wood bulkheads extending to the high water mark of Gardiners Bay. AREA VARIANCE.REL•IEF I1tEQUESTED BY APPLICANT: Applicant is-requesting a �ariaitce to•idcate`a priiposed 12'by 22'wide unroofed deck addition with a setback at approximately 28 feet from the rear property line, instead of the code required 35 feet, and at approximately 40'feet from the bulkhead, instead of the code required 75 feet. Note:The'bulkhead is shown to be beyond the rear property line towards Gardeners Bay). REASONS/FINDINGS'FOR ACTION DESCRIBED BELOW: 1. Grant of the two area variances will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties because the deck addition is modest in size and similar In location in proximity to the rear yard property lines,bulkhead and beach as other decks in the neighborhood. 2. The benefit sought by the applicant cannot be achieved by som e methold, feasible - for-applicant,to pursue,-other;than an area variance.
