Dear Mr. Kelly,
Thank you for the pre submittal of the proposed site plan and assorted materials on the
above referenced agricultural site.
Per Town Code section 100-254 (A) the Planning Board reviewed the proposed site plan
application~nd materials received· The Board held a work session on March 15, 2004 to
review thy'site plan application at a pre-submission conference. The review on the site
plan nmr,/ed BriarcliffSurvey dated March 1, 2004, along with associated file materials
clearly i~lentify the use of tins structure as an agricultural storage building. The letter
from Morton Buildings, Inc., dated March 12, 2004, lists the farm equipment to be stored
in the new building. On March 10, 2004, the Land Preservation Deparunent approved the
use and location of this agricultural eqmpment storage building on land encumbered by a
development easement. The Board agreed no additional site plan reqmremems are
applicable under this article and decided to reject the application.
The decision rendered by the Planning Board for tins application does not condone any
other changes or deviations from the proposed construction of one 42'x90' agricultural
storage building. Please refer to Town Code section 100-253 on approval of a site plan,
if any other changes or deviations from the proposed construction occur at tins site.

On March/2, 2004, Bill Kelly, agent for Briarcliff Nursery/Frank C~chanowlcz, ser~a letter to
the Land Preser~ation Committee together with a revised site plan showing a revised I~cation for a
proposed AgricUltural Equipment Storage Building~ L
The building is shown as a 42' x 90' agricultural equipment storage building and is
proposed to be located within the existing Town Development Rights Easement. The location of
such is shown on a survey dated 3-01-04, of which your office already has a copy; however, I've
attached a copy of the proposed building location for your convenience.
The Land Preservation Committee, in accordance with Section 25-50 C. (2) [3] of the Town
Code, reviewed the request for the revised location at the March 9, 2004, Land Preservation
Committee meeting. The recorded easement for this property allows land within the easement to
be used for the purpose of agricultural production. The Committee determined that the requested
agricultural equipment storage building is allowed within the easement area. A motion was
presented and unanimously adopted to recommend approval and construction of the agricultural
equipment storage building in the proposed location, in accordance with all applicable Code
requirements.

haven't had time to review this yet. However, I'm assuming that unless the building is right n the middle of the farm
(which I don't think it is...) that the LPC Will ok the location.
I think that it would be a good thing for yOL TO proceed with PB review at the 8th work session. That way, if the PB has
issues I will know about them at the LPC meeting.
Review of ag structures in general is an interesting thing, think that the LPC should be reviewing to see: 1) if the easement allows structures
2) if the use is that of Agricultural Production (otherwise it definitely would not be allowed within easement
area
3) if the location is of such nature that it interferes with farming
I think that the PB should be reviewing the site plan in accordance with all of the site Dian stuff .....
So, it is difficult to determine which group should review first.
There is no point in PB reviewing if the structure is not allowed in the first place ....
There is no point in the LPC reviewing if the structure doesn't meet code setbacks em ....
Probably the best thing is that staff (you and I) do our reviews before either meeting, and let each other know if we see
any major problems...

I was told by Mr. Kelly this would be submitted to you for review. We may have a copy similar to
the plan submitted and should compare it. This new revised plan appears to be what they want
approved and is different from what the Land Preservation approved. Will you be over at this end
